RESOLUTION NO. 19-9592
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF OPA-LOCKA, FLORIDA, AUTHORIZING THE
BROWN LAW GROUP, LLC, TO REPRESENT THE CITY
OF OPA-LOCKA IN KRAVICH VS CITY OF OPA-LOCKA,
FLORIDA ET. AL., CASE NUMBER 2018-039141 CA-27;
PROVIDING FOR INCORPORATION OF RECITALS;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on December 19, 2018, the Plaintiff served the City of Opa-locka
("City") with a Complaint; and
WHEREAS, the City Commission finds that it is in the best interest of the City to
authorize The Brown Law Group, LLC to provide representation to the City in Kravich vs
City of Opa-locka, Florida et. al., Case Number 2018-039141 CA-27, to be capped at
$2000.00 in attorney's fees.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA:
Section 1. RECITALS ADOPTED.
The recitals to the preamble herein are incorporated by reference.
Section 2. AUTHORIZATION
Pursuant to the agreement the City has with The Brown Law Group, LLC, the City
Commission authorizes The Brown Law Group, LLC to represent the City in Kravich
vs City of Opa-locka, Florida et. al., Case Number 2018-039141 CA-27 to be capped
at $2000.00 in attorney's fees.
Section 3. SCRIVENER'S ERRORS.
Sections of this Resolution may be renumbered or re-lettered and corrections of
typographical errors which do not affect the intent may be authorized by the City
Manager, or the City Manager's designee, without need of public hearing, by filing a
corrected copy of same with the City Clerk.
Section 4. EFFECTIVE DATE.
This Resolution shall take effect immediately upon adoption and is subject to the
approval of the Governor or his designee.

COMPLAINT TO QUIET TITLE AND FOR OTHER RELIEF
COUNT
Plaintiff(s), by and through its undersigned attorney(s), sues the above-named Defendant(s)and
allege:
1. This cause is brought pursuant Section 65.081, Florida Statutes, to quiet and confirm the title
of Plaintiff(s) in certain real property located in Miami-Dade County, Florida, more particularly described
as follows:
Lot 26, Block 357, RESUBDIVISION OF BLOCKS 350,351 &A PORTION OF BLOCKS 345,348&349,
MAGNOLIA GARDENS, according to the plat thereof as recorded in Plat Book 49, Page 71, Public
Records of Miami-Dade County, Florida.
2. Plaintiff(s) has acquired or otherwise claims title to the subject property under a tax deed(s)
dated 09/07/18 and which has been filed in O.R. Book 31131, at Page 3441, of the Public Records of
Miami-Dade County, Florida. A true copy of the recorded tax deed is attached hereto and made a part
hereof.
3. The tax deed was applied for with the Miami-Dade County Tax Collector,by the holder of Tax
Certificate No. 20198 because of non-payment of real property taxes assessed against the above-
described real property. After the application for tax deed was received, the Tax Collector made a
determination of those parties in interest entitled to notice as defined by Section 197.502, Florida
Statutes. Then this matter was referred to the Clerk of the Circuit Court, Miami -Dade County, Florida,
who arranged for the publication of a Notice of Application for Tax Deed pursuant to Section 197.512,
Florida Statutes. Finally, notices of the application for tax deed were mailed or otherwise processed to
those parties in interest at the time the tax deed was applied for pursuant to Section 197.522, Florida
Statutes,also by the Clerk.
4.Evidence of compliance can be found in tax deed file no.2018A00025 maintained by the Clerk
of the Circuit Court, Miami - Dade County, Florida and which is also recorded in the Public Records of
Miami-Dade County,Florida.
5.The delinquent real property taxes and the property itself were not paid or redeemed prior to
the sale, issuance and recording of Plaintiffs tax deed and, therefore, no defense thereto is available as
provided by of Section 65.081(3),Florida Statutes.
6. All actions or procedures prior to the sale, issuance and recording of the subject tax deed
were in strict compliance with those provisions of Chapter 197, Florida Statutes, and otherwise validate
the tax deed purchased by Plaintiff. The tax deed itself is prima facie evidence of its regularity, all as
provided to Section 197.552, Florida Statutes. Furthermore, Plaintiff, as the grantee under the tax deed,
is entitled to immediate possession of the property acquired pursuant to the provisions of Section
197.582, Florida Statutes.
7. Defendant(s), VINCENT McKNIGHT, may claim some interest in the subject real property as
owners)of record at the time of the application for tax deed.
8. Defendant(s), CITY OF OPA LOCKA, may claim some interest in the subject real property as
to those code enforcement liens filed in O.R. Book 18913, Page 4021;O.R. Book 23781, Page 113; O.R.
Book 29611, Page 4440; O.R. Book 29677, Page 1269 and O.R. Book 29945, Pag 715, all of the Public
Records of Miami-Dade County,Florida.
9. Defendant(s), MIAMI-DADE COUNTY, may claim some interest in the subject real property,
although not specific to the subject property, as to those notice(s)of lien code enforcement filed in O.R.
Book 23122,Page 4938 and O.R. Book 31130, Page 18,Public Records of Miami-Dade County, Florida.
10.The claims of all Defendant(s)are prior to the tax deed under which Plaintiff(s)claims its title.
As a matter of law, these are extinguished by the tax deed under the provisions of Chapter 197, Florida
Statutes. The lien of real property taxes are superior in dignity to any claims of any Defendants)
heretofore mentioned,and all parties claiming by,through or under said Defendant(s).
WHEREFORE, Plaintiff(s)demands judgment against Defendant(s) removing the clouds from its
title to the land and quieting title in Plaintiff, all consistent with the provisions of Section 65.081, Florida
Statutes,and confirming the validity of the tax deed under which Plaintiff(s)now claim title.
COUNT II
11. Plaintiff(s) re-alleges and incorporates the allegations set forth in Paragraphs 1 through 6
above. -
12. Defendant(s), HARVEY RUVIN, as Clerk of Courts, Miami-Dade County, Florida, conducted
the tax deed sale referred to herein.
13. That due to the tax deed sale and after payment of the tax deed applicant, and associated
fees/costs of sale, there remains a surplus of funds subject to claim and disbursement under the
provisions of Section 197.582, F.S.
14.Defendant(s)is presently holding said surplus funds.
15. That as a matter of law and in consideration of claims/priorities with respect to the surplus
funds, Plaintiff(s) has an interest in the disposition of the surplus funds relative to the payment of
additional year's taxes and municipalcounty liens of record.
16.That the said surplus funds should not be disbursed pending the conclusion of this cause and
any claims/payments must be made consistent with the applicable statutory provision(s).
WHEREFORE, Plaintiff(s)would respectfully request:
a. That the Court takes jurisdiction over the issue of surplus funds and the claims to and
disbursement thereof;
b. That Defendant(s) Clerk be enjoined from disbursement of any surplus funds pending a final
determination of claims relative thereto;and
c.That the Court grant such further relief as it may deem appropriate.
