Review of Rising Sun Memorial Park ProjectMember Weir introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2006-91 RESOLUTION RECEIVING CITIZEN PETITION FOR ENVIRONMENTAL REVIEW REGARDING RISING SUN MEMORIAL PARK PROJECT WHEREAS, on December 12, 2006, the city of Medina received a citizen petition for environmental review of the Rising Sun Memorial Park project, which petition requested that the City complete an Environmental Assessment Worksheet ("EAW") on the project; and WHEREAS, City staff have reviewed the petition's contents and are of the opinion that the City is the appropriate Responsible Governmental Unit ("RGU") to determine whether an EAW should be completed on the project because the City has the most authority to approve or deny the Rising Sun Memorial Park project; and WHEREAS, that pursuant to Minnesota Rules, RGUs must make a decision on whether an EAW is needed within 15 business days from the date of receipt of the citizen petition for environmental review but the Minnesota Rules also allow an RGU to grant itself an additional 15 business days to make this decision. NOW, THEREFORE, BE IT RESOLVED by the city council of the city of Medina, Minnesota, as follows: 1. The city of Medina is the appropriate RGU to determine whether an EAW should be completed on the project. 2. Pursuant to Minnesota Rules, the City shall have an additional 15 business days in which to make the decision regarding whether an EAW is needed for this project. 3. City staff shall evaluate the citizen petition and provide a recommendation to the city council on whether an EAW is needed for this project within the appropriate period of time. 4. In the event that City staff do not have the resources needed to evaluate the petition, the city administrator is authorized to seek additional professional support to complete the review and provide a recommendation to the city council.
