Hearing Meeting, Tuesday, September 27, 2016
PRESENT: Rich Nadler, Chair; Kevin Galligan, Vice-Chair; Judith Bruce; Jim O'Brien;
Judy Brainerd; Mike Brink; Charles Ketchuck; Ginny lannini, Associate; Walter North,
Associate; & John Jannell, Conservation Administrator.
ABSENT: Donelle Denery, Associate.

Jim O'Brien recused himself. For the purpose of this hearing, Ginny lannini will be a
voting member.

Douglas Brennan, 317 South Orleans Road. by Ryder &Wilcox, Inc. Assessor's
Map 69, Parcel 13. The proposed relocation of an existing guesthouse, the
replacement of concrete steps with dug in timber steps, addition to the existing dwelling
with site improvements, & mitigation. Work will take place within 100' of the Top of a
Coastal Bank, on a Coastal Bank, in Land Subject to Coastal Storm Flowage, &within
the Pleasant Bay A.C.E.C. David Lyttle of Ryder& Wilcox, Inc., and Caitrin Higgins of
Wilkinson Ecological Design, were present. David Lyttle and Caitrin Higgins outlined
the changes made to the site plan, and David Lyttle reiterated that the view corridor was
a part of an open Order of Conditions. Charles Ketchuck inquired about the location of
the fire pit and the reduction of the patio from the previous plan to the current plan.
David Lyttle replied that the fire pit was in the center of the proposed patio on the north
side, and the proposed patio coverage went from 725' to 441'. Ginny lannini pointed
out that the Sorbello Landscape Plan had a note about the existing garden beds which
had been removed from the site plan, and David Lyttle replied that it could be corrected.
Judith Bruce confirmed that the topping of the oak trees would cease, and Caitrin
Higgins replied that coppicing would be practiced for those trees outside of the view
corridor. Judith Bruce questioned the difference between coppicing and topping, and
John Jannell explained that coppicing is an old forestry technique used to cut a species
to the ground. John Jannell asked how they would choose which tree would receive
this treatment, and Caitrin Higgins stated that they would focus on the trees that needed
it most, and consult with the Conservation Administrator. John Jannell suggested that
any concerns that arose in the field would come back in front of the Commission for
their approval. Rich Nadler questioned if the work could be phased to reduce the
overall visual impact of the work, and Caitrin Higgins explained that the proposed work
would take time, and that not all of the vegetation would be removed on site. Rich
Nadler suggested moving the triangular patio away from the Top of the Bank, and David
Lyttle replied that this was a stable flat area that the homeowners liked to utilize.
Charles Ketchuck inquired about the aesthetic impact of the work to the house, and
questioned when it would be done. David Lyttle anticipated a time of year restriction for
the work on the Coastal Bank to the cottage, and they planned to protect the Marsh with
plates as needed. Kevin Galligan voiced concern over the removal of the raised garden
beds, and asked if the Leyland cypress proposed could be changed to a different

species. David Lyttle suggested it could be switched to Eastern Red Cedar, and that he
could provide a revised Sorbello Landscape Plan. Ginny lannini asked if there were any
paths proposed, and David Lyttle replied that the applicants would be traversing over
existing Cape Cod Lawn. Judith Bruce voiced opposition over the modification to a
patio that had been installed without Conservation Commission approval, and David
Lyttle replied that the applicants were not the ones who had built the unpermitted
structure. Mike Brink suggested that the trim of the cottage blend into the Bank, and
David Lyttle was comfortable with it being natural siding and natural trim. Judith Bruce
asked about the addition, and John Jannell explained the conversion of the
entranceway to a mudroom had come into the Department initially as an Administrative
Review filing. Charles Ketchuck inquired about the size of the addition, and David Lyttle
replied it was 204'. Judith Bruce asked if the trees would be marked that would be
coppiced. John Jannell thought that it may be an in-the-field decision, and if any
concerns arose, he would bring it back to the Commission for review.
MOTION: A motion to close the hearing was made by Judith Bruce and seconded by
Judy Brainerd.
VOTE: 6-0-0 Unanimous.
MOTION: A motion to approve the Land Management Plan and Restoration Plans,
subject to receipt of a revised Site Plan, a revised Sorbello Landscape Plan, with
special conditions that the topping of the oaks on the Bank to cease, the screened area
of the cottage to remain screened, the demolition of and construction of the cottage pile
foundation will only take place from November 1st to April 1st of any given year, and that
natural siding and natural trim are to be used on the cottage was made by Kevin
Galligan and seconded by Judith Bruce.
VOTE: 6-0-0 Unanimous.
Jim O'Brien returned.
Administrative Reviews
Dr. Olivier& Lynn de Weck, 561 South Orleans Road. The proposed trimming and
removal of trees. Work to be done by Davey Tree. John Jannell read into record
correspondence from the applicant about the specific trimming requested.
MOTION: A motion to approve this work was made by Jim O'Brien and seconded by
Judi Brainerd.
VOTE: 7-0-0 Unanimous.
Louise Aver, 22 Horseshoe Lane. The proposed completion of a cobble edge and
gravel driveway. Work to be done by Betsy Furtney and Crossroads Landscaping.
Betsy Furtney was present.
MOTION: A motion to approve this application was made by Kevin Galligan and
seconded by Judy Brainerd.
VOTE: 7-0-0 Unanimous.
Stephen H. McCutchen Jr.. 29 Shoreview Drive. The proposed removal of 2 trees.
Work to be done by applicant.
MOTION: A motion to approve this Administrative Review was made by Judith Bruce
and seconded by Judy Brainerd.
VOTE: 7-0-0 Unanimous.

Kenneth NI. Johnson, 19 Gosnold Road. The proposed trimming of trees and
bushes. Work to be done by Black Duck Landscape.
MOTION: A motion to approve this work was made by Charles Ketchuck and seconded
by Judy Brainerd.
VOTE: 7-0-0 Unanimous.
Robert & Sandra Clark, 184 Tonset Road. The proposed creation of a public walking
path.
MOTION: A motion to approve this application was made by Charles Ketchuck and
seconded by Judy Brainerd.
VOTE: 7-0-0 Unanimous.
Barbara Barnette, 66 Tides End Lane. The proposed re-roofing of an existing barn.
Work to be done by Tom Hughes.
MOTION: A motion to approve this Administrative Review was made by Charles
Ketchuck and seconded by Judith Bruce.
VOTE: 7-0-0 Unanimous.
Chairman's Business
Approval of the Minutes from the Meeting on September 20, 2016.
MOTION: A motion to approve this set of minutes was made by Charles Ketchuck and
seconded by Judy Brainerd.
VOTE: 6-0-1; Mike Brink abstained, motion approved.
Other Business
Mike Brink wanted to announce that Doug Tallamy would be speaking at the Eastham
Library on Friday, September 30th, 6pm at the Eastham Town Hall.
Kevin Galligan announced that during the Annual Committee Orientation on September
26th, it was announced that new Open Meeting Law Regulations would be coming
forward on January 1, 2017.
John Jannell noted that correspondence regarding Eversource had been provided to the
Commission, and noted that two members, Judith Bruce and Charles Ketchuck, had
volunteered to attend the upcoming meetings.
The meeting was adjourned at 9:45am
