IN THE MATTER OF THE PROPOSED IMPROVEMENT OF
ALMA AVENUE BETWEEN LONG BEACH BOULEVARD AND
CALIFORNIA AVENUE BY THE CONSTRUCTION OF CURBS,
DRIVEWAYS, SIDEWALKS, AND GUTTERS, AND THE RE-
MOVAL OF EXISTING DRIVEWAYS AND TREES, IN-
CLUDING ALL INCIDENTAL.AND APPURTENANT WORK.
RESOLUTION ASCERTAINING AND DETERMINING RATE
OF PER DIEM WAGEH AND THE GENERAL PREVAILING
RATE OF PER DIEM WAGES FOR LEGAL HOLIDAYS AND
OVERTIME WORK IN THE LOCALITY FOR EACH CRAFT
OR TYPE OF LABORER, WORKMEIN, OR MECHANIC NEEDED
TO EXECUTE THE CONTRACT FOR FURNISHING AND DE--
LIVERING CERTAIN MATERIALS AND SUPPLIES IN CON-
NECTION WITH THE ABOVE MENTIONED IMPROVEMENT IN
ACCORDANCE WITH PLANS AND SPECIFICATIONS N0.
1954-J-3.
, BE IT RESOLVED by the City Council of the City.of Lynwood,
Cali£ornia, as follows:
WHEREAS, pursuant to an Act of the Le$islature of the State
of California, approved April 24, 1937,_and known as the,"Labor Code", .
the City Council of the City of Lynwood is required to ascertain the
general prevailing rate of per diem wages and the general prevailing
rate of per diem wages for legal holidays and overtime work, in this
locality for each craft or type of laborer, worlrnian, or mechanic
needed to execute the proposed contract for the construction of curbs,
driveways, sidewalks,.and gutters, and the removal of existing driveways
and treet, including all incidenta� and appurtenant work in Alma Avenue
between Long Beach Boulevard and California Avenue, in accordance with
Plans and Specifications No 1954-,7-3 on file in the office of the
City Clerk of the said City of Lynwood,
NOW, THEREFORE, the City Council of the City of Lynwood
does hereby resolve as follows:
Section l: The City Council of the City of Lynwood does
hereby ascertain and determine that the general prevailing rate of
� hourly wages, in the locality in which said work or improvement is to
be done, for each craft or type of laborer, worlrinan, or mechanic needed
to execute the contract for furnishing and delivering certain materials
and supplies in connection with improvement hereinabove described

and in accordance with Plans and Specifications No. 1954-J-3 on file
in the office of the City Clerk of said City, is as follows, to-wit:

Provided that not less than one and one-half times the prevailing
rate shall be paid for any working time more than eight hours durin$
any one calendar day, and for time on Saturdays, Sundays, and the
several legal holidays, to-wit: New Years Day, Memorial Day, Fourth
of July, Labor Day, Armistice Day, Thanksgiving Day, and Christmas.
Provided that notwithstanding the general provision contained
herein, flagmen, guards, and watchmen shall be paid one and one-half
times the prevailing rate for overtime (overtime shall be time worked
in excess of eight hours per day or forty hours per week), and the

straight prevailing rate for time worked on Saturdays, Sundays,
and holidays where such time does not constitute overtime.
The foregoing prevailing wage schedule is based upon a
working day of eight hours, and in the event that laborers, workmen,
or mechanics are employed less than eight hours per day, the rate
of per diem wa�es shall be deemed to be that fraction of the fore-
going rates that the number of hours of employment bears to eight,
The rate of compensation for any classification not listed
in the schedule, but which may be required to execute the proposed
work, shall be commensurate and in accord with the rates. spec3fied
for similar and comparable classificatiori or for those performing
similar or comparable duties.
