COUNCIL MINUTES
MARCH 21, 1988 - SPECIAL MEETING
A special meeting of the Bal Harbour Village Council was
held on Monday, March 21, 1988 in the Village Hall Council
Chamber. The meeting was called to order at 5:15 p.m. by Mayor
Richard H. Olsen and the roll was called. Those present were:

Also present: Louise K. Miller, Village Manager
Richard J. Weiss, Village Attorney
Carole S. Morris, Village Clerk
As a quorum was found to be present the meeting was
commenced.
II. Ordinances - First Reading: An ordinance was read by
title, by the Village Clerk, which would provide for changes in
the zoning requirements in the Ocean Front District by increasing
the permitted height and changing the side setback regulations.
Mayor Olsen then opened the public hearing on this ordinance.
Mr. Shepard Broad, representing the Regency Spa, requested that
the Council table consideration of this ordinance until the
completion of construction of the Bal Harbour Tower. Mr. Taplin
explained that the intent of this ordinance is to discourage
construction of the long, box type buildings. Mr. Broad
countered that the best method of accomplishing this would be to
leave the current code intact. This way, economics would
prohibit construction of a building. Mayor Olsen explained that
the ordinance would accomplish two primary items: 1)it would
require buildings be constructed in the middle of the lot; and
2)it offers the developer a bonus of additional height for moving
the building further back from Collins Avenue. The proposed
ordinance is in accordance with the recommendations offered by
Harland Bartholomew and Associates. A motion was offered by Mrs.
Stern to amend the ordinance such that building height is not
restricted, i.e. continuing the existing setback/height bonus
formula, and seconded by Mr. Taplin. This motion carried
unanimously (5-0). Mr. Frank Crippen, 262 Bal Bay Drive,
suggested that the side setback requirements were too extreme and
suggested that they be reduced somewhat. Mr. Taplin concurred.
Mrs. Stern read, for the record, the letter dated March 16, 1988
from Malcolm Drummond of Harland Bartholomew and Associates on

this matter (a copy of this letter is on file in the Clerk's
Office). This letter supported the 27.5% side setback. Mr.
Boggess suggested that a 25% side setback, as long as the
building is centered on the lot, would be adequate. After some
further discussion, a motion was offered by Mr. Boggess that the
ordinance be amended to provide for 25% side setbacks and
seconded by Mr. Blank. Mrs. Stern expressed concern that this
reduction would lead to still further reduction, through
variances, of the side setbacks. Mr. William Whitman, 169 Bal
Bay Drive, spoke in favor of the amendment. There being no
further discussion, the question was called and the motion to
amend the ordinance carried unanimously (5-0). A motion to
approve the ordinance, as amended was offered. The motion
carried unanimously (5-0) and the ordinance entitled
ORDINANCE OF BAL HARBOUR VILLAGE AMENDING
APPENDIX A, SECTIONS 6-9(g), 6-9(k), AND 6-
9(m) OF THE BAL HARBOUR VILLAGE CODE BY:
DECREASING THE PERMITTED BUILDING COVERAGE
AND INCREASING THE MINIMUM FRONT AND SIDE
SETBACKS FOR BUILDINGS EXCEEDING SEVENTEEN
(17) STORIES IN THE OCEAN FRONT DISTRICT;
CLARIFYING THAT CABANAS ARE PERMITTED IN THE
SIDE SETBACK PORTION OF REAR SETBACK AREAS;
REMOVING RESTRICTIONS ON PERMITTED BUILDING
HEIGHT IN THE OCEAN FRONT DISTRICT;
PROVIDING FOR SEVERABILITY; INCLUSION IN THE
CODE AND AN EFFECTIVE DATE.
was approved on first reading.
III. Announcement of Second Reading: Mayor Olsen announced
that the second reading and public hearing on this ordinance
would be held in the Council Chamber at Village Hall, on Monday,
April 4, 1988 at 5:15 p.m.
IV. Other Business: Mrs. Miller reported that the Sheraton
Bal Harbour is unable to indemnify the Village for liquor
liability coverage for the Beautification Dinner. A rider to our
existing policy for the evening could be obtained for a cost of
approximately $500. Mayor Olsen expressed the opinion that the
Village's liability on this issue is remote. A motion was
offered by Mr. Blank that the Village reject this liability
coverage and seconded by Mr. Taplin. The motion carried
unanimously (5-0).
Mayor Olsen read a proposed proclamation naming Dan Rather
as the first dubious recipient of the Villages' "Cheapshot
Title". Mrs. Stern offered a motion that this proclamation be
conferred to Mr. Rather. This motion died without a second.
V. Adjourn: A motion to adjourn the meeting was offered by
Mr. Taplin and seconded by Mrs. Stern. The meeting adjourned at
