CITY OF MEDINA
RESOLUTION NO.2007-10
RESOLUTION APPROVING A PUD (PLANNED UNIT DEVELOPMENT)
AMENDMENT FOR RYAN COMPANIES US, INC FOR "MEDINA RETAIL"
TO ALLOW A DRIVE -THROUGH USE ON PROPERTY GENERALLY
LOCATED NORTHWEST OF STATE HIGHWAY 55 AND COUNTY STATE
AID HIGHWAY 101
WHEREAS, Ryan Companies US, Inc, has requested approval of a PUD
Amendment for "Medina Retail" on property which is described as Block 2, Lot 2 of the
Medina Clydesdale Marketplace; and
WHEREAS, the PUD Amendment was reviewed by the Planning Commission at
its meeting on December 12, 2006 and following a public hearing thereon as required by
law, the Planning Commission recommended denial thereof; and
WHEREAS, the City Council on January 2 and February 6, 2007, reviewed the
PUD Amendment for its conformance with the City's ordinances, considered the
recommendations of the Planning Commission and heard comments from the Applicant
and other interested parties.
WHEREAS, the PUD Final Plan for the Medina Retail development, Resolution
Number 2005-55, shall not be altered from the original agreement except for the changes
identified in the following conditions and shall apply only to the described Block 2, Lot 2
of the Medina Clydesdale Marketplace.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF MEDINA, MINNESOTA, that it should and hereby does approve the
request by Ryan Companies US, INC for a PUD Amendment, subject to the following
conditions:
Lighting
1. The Applicant shall specify if the proposed signage is to be lit. The signage must
meet the requirements of the lighting ordinance.
2. The lighting fixture schedule does not specify the color of the poles. The color
should the same as others within the Medina Clydesdale development.
3. The Applicant shall provide details on any proposed building mounted lights and
canopy lights.

Architectural and Design Standards:
1. The elevations must be revised to identify the percentage of building materials
used.
Signage
1. The Applicant shall provide details for the menu board sign and directional
signage for the drive -through.
Other
1. The Applicant shall comply with the engineer memo dated January 26, 2007.
2. The Applicant shall comply with the building inspector/fire marshal memo dated
August 30, 2006
3. Approval for a drive -through business granted pursuant to this PUD Amendment
is specific to a coffee shop and does not allow any other type of drive -through
business to be located on the property. The operator of the coffee shop may be
changed, so long as the use remains essentially similar to that which has been
presented to and approved by the city council but any other type of drive -through
business will require another amendment to the PUD and may or may not be
granted, at the discretion of the city.
4. The Applicant must modify the Operation and Easement Agreement applicable to
the Property to restrict the drive -through to a coffee shop. The amended OEA
must be in a form acceptable to the city and must be recorded against the
property.

The motion for the adoption of the foregoing resolution was duly seconded by member
Cavanaugh and upon vote being taken thereon, the following voted in favor thereof:
Smith, Weir, Cavanaugh, Johnson
and the following voted against same: (Absent: Crosby)
None
Whereupon said resolution was declared duly passed and adopted.
