PROPOSED II�'ROVENI�:NT OF PORTiONS OF P�NDLETON
AVET�TUE BY THE CONSTRUCTION OF CEMEDT'P CODiCRETE

WHEREAS, the City Council of the City of Lynwood did, on
the 16th day of December, 195z approve an investigation report under
the provisions of Division 4 oi the Streete and Hig�hwa;�e Code, cited
as �'Special 9asessment Investigation, Limitation and l�ta,jo Protest
Aet of 1931", ae amended, upon the proposed improvement of nortions
oY Pendleton Avenue from Sampson Avenue to [4ashington Avenue by the
construction of cement concrete curbs and gutters, including al1 in-
ciclertal and. apnurtenant work, all as shown on Plan nro. 1952—R—z in
the oPiice of the City Clerk of said City; and
WHEREAS, said report naving been duly prepared and filed,
a hea was held b,y said City Council on the_3rd da,y oi' February,
1953 �n the na.nner provided in said_ Act above referred to; and
WHEREAS, more than thirt,y da�rs nave expired since the date
of mailing notices of hea.ring on said repo
DiOW, THEHEFORE, the Cit,y Council of the Cit,y of Lynwood
does hereb,y resolve ae Pollowe: �
� 1. That the protests made at said hearing on said investi-
gation report be and the same are herebv overruled;
2. That the nublic interest, convenience, and neceasity
require the doi!Zg and making of tne public improvement set °orth and
described in said report above referreo_ to �nd subatantially in the
manner set �orth;
3, That the project consiating of the proposed imnrovement
above referred to is feasible and that the lands to be assessed will
be a.b7_e to carr,y the burd.en of said proposed as�esament, and the
limitations on the amounts of assessmente provid.ed for in this part
may be clisregarded, both with respect to the limitationa on the dis-
trict ae a wnole and. as to the 1'Ymitation on individval apecific
assessments.
4. That the estimated tota.l amovnt proposed to be a,esessed
upon any or all lots or parcels of land for the coate and ex�enses of
aaid proposed impr.ovement does not exceed the limitation of indebted-
ness established and set £orth in said Act above referred to and will
not, b,y the levy thereof, cauae said. limitation to be exceeded in any
instance;
5. That no written protests were filed with the clerk of
the legislative body by the owners of a ma�orit,y of the fror.tage of
the property fronting on said propoaed improve�ent.
6. That it is hereby ordered that the Aroceedinga for the
making of said proposed improvenent be u.nderta_ken pursu.ant to the pro-
visions of an Act of the Legislature of the State of California, des-
ignated as Divieion � of the Streeta and Highways Code, cited as the
°Irrrorovement Act of 1911, and amendments thereto�'. '
