HomeMy Public PortalAbout2007-016 Resolution Granting Approval of a CUP to RJ Ryan Contruction & Peter Hasselquist 2705 Willow DrMember Weir introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2007-16 RESOLUTION GRANTING APPROVAL OF A CONDITIONAL USE PERMIT TO RJ RYAN CONSTRUCTION AND PETER HASSELQUIST FOR CONSTRUCTION OF AN ACCESSORY STRUCTURE LOCATED AT 2705 WILLOW DRIVE WHEREAS, RJ Ryan Construction and Peter Hasselquist (collectively, "Applicants") have requested approval of a conditional use permit to construct an accessory structure with a footprint of 7,400 square feet at the property legally described in Exhibit A attached hereto; and WHEREAS, the city's zoning ordinance requires a conditional use permit under such circumstances; and WHEREAS, the Planning Commission has reviewed the request at duly called public hearings on January 9, 2007 and February 13, 2007, and the Planning Commission recommended approval thereof, subject to certain terms and conditions, and WHEREAS, the City Council, on March 6, 2007 reviewed the application for conformance with city ordinances and considered the recommendations of the Planning Commission and heard comments from the applicant and other interested parties, NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Medina, Minnesota that a conditional use permit is granted to RJ Ryan Companies and Peter Hasselquist subject to the following conditions: 1) The applicants and owners shall warrant that the building proposed is for private use only, and that no commercial and/or fee -based horse boarding or training, storage or other activities shall occur; 2) This CUP permits the following accessory structures on the property at a maximum, as shown within the plans received on January 22, 2007: a 7,400 sq. ft. barn, a 2,900 sq. ft. pool with surrounding pool deck; a 260 sq. ft. pool house/porch; a 110 sq. ft. play house; a 130 sq. ft. gazebo; and a 120 sq. ft. corn crib; 3) Plans submitted and approved by the City do not propose human dwelling as a use and do not meet regulations for such as use; 4) The applicants shall install fencing in order to prevent grazing within the wetlands on the property; 5) The applicants shall meet requirements of the MPCA with regard to manure management; 6) The applicants shall submit a septic design acceptable by the City, prior to issuance of a building permit for the proposed barn. This design should identify both the proposed septic location and an alternate septic site; Resolution 2007-16 March 20, 2007 7) The applicants shall obtain a permit and demolish the existing 1,532 sq. ft. accessory building before construction of the proposed barn; 8) The applicants shall obtain all necessary permits for construction; 9) The applicants shall plant a mix of 8-foot coniferous and red oak deciduous trees on the southeast of the proposed barn to improve screening; 10) The applicants shall abide by all regulations of the Section 828.43 regarding tree preservation; 11) All exterior lighting shall be fully shielded on all sides except the bottom so that no light can be seen from adjacent properties or right-of-way and abide by all regulations of Section 829; 12) If a second curb cut is requested off of Willow Drive, the applicants shall execute a driveway agreement with the City as required by Medina Code section 410.11; 13) If the area disturbed by grading is greater than 1 acre in area, the applicants shall present the city with a Storm Water Pollution Prevention Plan (SWPPP) and also proof that the SWPPP was approved by the Minnesota Pollution Control Agency; 14) The applicants shall obtain all necessary permits from the Minnehaha Creek Watershed District; and 15) The applicants shall pay to the City a fee in the amount sufficient to pay for all costs associated with the review of the Conditional Use Permit application.
