HomeMy Public PortalAbout2007-022 Resolution Granting Site Plan & Variance Approval for Hamel Station Retail Devel at 3575 Sioux DrMember Johnson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2007-22 RESOLUTION GRANTING SITE PLAN AND VARIANCE APPROVAL FOR THE HAMEL STATION RETAIL DEVELOPMENT LOCATED AT 3575 SIOUX DRIVE REPRESENTED BY UNITED PROPERTIES WHEREAS, United Properties (the "Applicant") has requested approval for a site plan with variances to operate a multi -use retail development with drive-in uses located at 3575 Sioux Drive (the "Subject Property") which is legally described on Exhibit A attached hereto; and WHEREAS, the site plan with variances of the Subject Property was reviewed by the Planning Commission at its meeting on February 13, 2007 and, following public hearing thereon as required by law, the Planning Commission recommended approval thereof, subject to certain terms and conditions; and WHEREAS, the City Council on March 6, 2007 and April 17, 2007 reviewed the application for conformance with city ordinances, considered the recommendations of the Planning Commission and heard comments from the applicant and other interested parties; and WHEREAS, the City Council finds that exceptional and extraordinary circumstances do apply to this site due to the topography and proximity to Elm Creek; and WHEREAS, the City Council finds that the Applicant has met the intentions of the Uptown Hamel zoning district; and WHEREAS, the City Council finds that the variances would not be materially detrimental to the purposes of the ordinance under which the Subject Property is zoned, and the Applicant has provided the minimum necessary improvements to alleviate the hardship, and that the Applicant is furthermore reducing the impervious surfaces and improving the site with the approved site plan; and WHEREAS, the Applicant has demonstrated undue hardship because of circumstances which make the Subject Property unique as compared to other properties within the district. Resolution 2007-22 May 1, 2007 NOW, THEREFORE, BE IT RESOLVED by the City Council and the City of Medina, Minnesota, that it should and herby does approve the request by United Properties for a site plan with the following variances for the Subject Property: • A variance to exceed the 25% maximum impervious surface shoreland requirement. The proposed development will increase the total impervious surface to 50% of the site. • A variance to allow the retaining wall to encroach 10 feet within the 50 setback on the vegetative buffer on Elm Creek. • A variance to allow the driveway to the drive-in service businesses (the coffee shop and the credit union building) to encroach 80 feet within the 100-foot setback from an improved intersecting street. • A variance to allow the driveway to the drive-in service business associated with the coffee shop to encroach 120 feet within the 300-foot setback from State Highway 55. • A variance to allow the driveway to the drive-in service business associated with the credit union to encroach 20 feet within the 300-foot setback from State Highway 55. NOW, THEREFORE, BE IT FURTHER RESOLVED that the site plan and variance approvals are subject to the terms and conditions that shall be met prior to final plat approval: 1. The site plan and variance approvals shall be contingent on approval of the conditional use permit and final plat of the Subject Property. 2. The final storm water management plan (SWPP) and wetland delineation should be submitted to ECWMC for final approval. 3. The final storm water management plan (SWPP) and wetland delineation should be submitted to the City's engineer for final approval. 4. All conditions stated in the City's Engineer report dated April 11, 2007 shall be addressed by the Applicant and resubmitted for final review. 5. The Applicant shall work with ECWMC to develop a landscape buffer plan to preserve the integrity of Elm Creek. 6. All signs shall be in compliance with the City's sign ordinance. 7. All proposed signage, if lit, shall meet the outdoor lighting standards as defined in the zoning ordinance. 8. If the coffee shop is to have a menu board, the Applicant must submit the proposed sign prototype for review by the city. 9. A detailed lighting and refuse disposal plan should be submitted to show compliance with these requirements. The drive-in services must also not be used between the hours of 10:00 p.m. and 6:00 a.m. 10. A minimum of 20% of the plaza space should consist of pervious surfaces. The plans appear to meet this requirement but verification should be provided on the plans. Resolution 2007-22 2 May 1, 2007 11. Overall landscaping shall be improved and additional landscaping provided in islands around drive-in areas. 12. A colored lighting detail must be provided for all fixtures within the development for review by City staff. 13. All conditions in the city engineer's memo dated April 11, 2007 shall be addressed and resubmitted for review by the City. 14. Applicant shall agree to stabilize and seed the site if development is phased. 15. The lighting plan shall be updated to show parking lot lighting fixtures that are more consistent with the rail depot theme. 16. The Applicant acknowledges the potential adverse impact of the Highway 55 corridor planning efforts as presented in the City Council Special Meeting held on April 17, 2007. 17. The Applicant must enter into a development agreement in a form satisfactory to the City to ensure completion of subdivision improvements and development of the project in compliance with all City requirements. 18. The Applicant shall pay to the City a fee in an amount sufficient to reimburse the City for the cost of reviewing the preliminary plat and related documents. Dated: May 1, 2007 T.M.
