Member Johnson introduced the following resolution and moved its adoption:
CITY OF MEDINA
RESOLUTION NO.2007-23
RESOLUTION GRANTING CONDITIONAL USE PERMIT APPROVAL FOR
THE HAMEL STATION RETAIL DEVELOPMENT LOCATED AT 3575 SIOUX
DRIVE REPRESENTED BY UNITED PROPERTIES
WHEREAS, United Properties (the "Applicant") has requested approval of a
Conditional Use Permit ("CUP") to operate a multi -use retail development with drive-in
uses located at 3575 Sioux Drive, (the "Subject Property"), which is legally described on
Exhibit A attached hereto; and
WHEREAS, application for the CUP for the Subject Property was reviewed by
the Planning Commission at its meeting on February 13, 2007 and, following public
hearing thereon as required by law, the Planning Commission recommended approval
thereof, subject to certain terms and conditions; and
WHEREAS, the City Council on March 6, 2007 and April 17, 2007 reviewed the
application for conformance with city ordinances, considered the recommendations of the
Planning Commission and heard comments from the applicant and other interested
parties; and
WHEREAS, the City Council finds that the drive-in uses are consistent with the
overall topography and location for such uses; and
WHEREAS, the City Council reviewed the number and location of such drive-in
uses and requested appropriate screening and minimization of uses at their March 6, 2007
meeting; and
WHEREAS, the Applicant met the recommendations of the City Council and
provided a plan to reduce the number of drive-in aisles, and presented an updated plan on
April 17, 2007, and
WHEREAS, the City Council finds that the proposed drive-in uses will not
adversely impact the health, safety, morals, and general welfare of the community.
NOW, THEREFORE, BE IT RESOVLED by the City Council and the City of
Medina, Minnesota, that it should and hereby does approve the request by United
Properties for a conditional use permit for the Subject Property subject to the terms and
conditions that shall be met prior to the issuance of a building permit:

1. CUP approval shall be contingent on approval of the site plan and final plat of
the Subject Property.
2. The final storm water management plan (SWPP) and wetland delineation
should be submitted to ECWMC for final approval.
3. The final storm water management plan (SWPP) and wetland delineation
should be submitted to the City's engineer for final approval.
4. The Applicant shall work with ECWMC to develop a landscape buffer plan to
preserve the integrity of Elm Creek.
5. The Applicant agrees to permit service to the Met Council vault and facilities
across its parking and driveway areas, if such usage is acceptable to the
Metropolitan Council and its designees.
6. Overall landscaping shall be improved and additional landscaping provided in
islands around drive-in areas.
7. The Applicant acknowledges the potential adverse impact of the Highway 55
corridor planning efforts as presented in the City Council Special Meeting
held on April 17, 2007.
8. The Applicant must enter into a development agreement in a form satisfactory
to the City to ensure completion of subdivision improvements and
development of the project in compliance with all City requirements.
9. The Applicant shall pay to the City a fee in an amount sufficient to reimburse
the City for the cost of reviewing the preliminary plat and related documents.

The motion for the adoption of the foregoing resolution was duly seconded by member
Smith and upon vote being taken thereon, the following voted in favor thereof:
Crosby, Cavanaugh, Smith, Weir, and Johnson
And the following voted against same:
None
Whereupon said resolution was declared duly passed and adopted.
