CALL TO ORDER: Mayor Dennis called the regular meeting of the City Council to order at 7:30 p.m., Tuesday, January 7, 1986, in the Council Chambers. 2. The invocation was given by Pastor Dennis Schlecht of the First Lutheran Church, 9123 East Broadway. 3. The Pledge of Allegiance to the Flag was led by Mayor Dennis. 4. ROLL CALL: Present: Absent: Also Present: Councilmen- Atkins, Froehle, Gillanders, Swain, Dennis Councilmen -None City Manager Koski, City Attorney Martin, Planning Director Shaw, Parks and Recreation Director Kobett, Public Works Coordinator Peterson and Julie Estrada of the Temple City Times 5. CONSENT CALENDAR: Councilman Atkins moved to approve all items on the Consent Calen- dar as recommended, seconded by Councilman Swain and unanimously carried. A. APPROVAL OF MINUTES - Regular Meeting of December 17 1986 Approved as written. B. RECOMMENDATIONS FROM PARKS & RECREATION COMMISSION MEETING OF DECEMBER 18, 1985 (1) REQUEST FOR USE OF LIVE OAK PARK FACILITIES - TEMPLE CITY SENIOR CITIZENS CLUB Council approved Temple City Senior Citizens Club's use of the auditorium,' kitchen, meeting room and multi- purpose room at Live Oak Park every Tuesday in 1986 from 9:00 a.m. to 3:00 p.m. subject to the usual Certifi- cate of Insurance. (2) REQUEST FOR RESERVED USE OF LIVE OAK PARK - TEMPLE CITY PINTO -PONY -COLT LEAGUE Council approved the League's use of the facilities at Live Oak Park for registration on January 11 from 9:00 a.m. to 3:00 p.m. and January 14 from 7:00 p.m. to 9:00 p.m, subject to the required Certificate of Insurance. C. CALIFORNIA CONTRACT CITIES ASSOCIATION AMBULANCE SUIT ASSESS- MENT - 3rd INCREMENT Council authorized the expenditure from General Funds in the amount of $925 for budget adjustments necessary to cover the City's, assessed share of the California Contract Cities Associations' ambulance suit. 1r iF 6 Council Minutes, January 7, 1986 - Page 2 D. CLAIM FOR SEWER DAMAGES: J. HERMES Council denied claim and referred it to Southern California Joint Powers Insurance Authority. E. RESOLUTION NO. 86 -2407: EMPLOYMENT OF PERSONNEL Council adopted the Resolution to appoint budgeted personnel. F. RESOLUTION NO. 86 -2408: WARRANTS AND DEMANDS Council adopted the resolution to pay bills. 6. UNFINISHED BUSINESS: A. ORDINANCE NO. 85 -580. (2nd reading) AMENDMENT ESTABLISHING REGULATIONS FOR. VESTING TENTATIVE MAPS City Manager Koski stated that at City Council's meeting held December 17, 1985, a public hearing was held, a Nega- tive Declaration of Environmental Impact was certified, and Ordinance No. 85 -580 was introduced for first reading by title only. The proposed Ordinance would establish regu- lations for vesting tentative maps as mandated by SB 1660. Section 9615(b) of the Ordinance provides that "at the time a vesting tentative map is filed, a subdivider shall also supply the information as specified by resolution ". Reso- lution No. 85 -2409 establishes requirements for the pre- paration and information to be included on Tentative Tract Maps and Vesting Tentative Tract Maps. Councilman Gillanders moved to waive further reading and adopt Ordinance No. 85 -580, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ADDING SECTIONS 9610 THROUGH 9620 TO THE TEMPLE CITY ZONING CODE ESTABLISHING REGULATIONS FOR VESTING TENTATIVE MAPS FOR RESIDENTIAL SUBDIVISIONS; adopt Resolution No. 86 -2409 establishing requirements for the preparation and information to be included on Tentative Tract Maps and Vesting Tentative Tract Maps, seconded by Councilman Atkins and unanimously carried. B. FACILITIES STUDY: REVIEW OF EXISTING FACILITIES AND CURRENT AVAILABILITY FOR USE BY YOUTH GROUPS City Manager Koski advised that at their regular meeting of November 5, 1985, City Council requested the Parks and Recre- ationbCommission to study ,current facilities available for use by Temple City'youth groups and to report back to the Council with their findings'. Council.has' received the Com- mission's_ report outlining the results of their investigation. In summary, the survey indicates that presently all Scout Troops have a place to meet; however, some locations may not be convenient, desirable or adequate. A copy of the report was given to Mary Manning, a representa- tive of the Sierra Madres Girl Scout Council, who was in attendance. • Councilman Swain commended the Parks and Recreation Commission for the fine report, but stated that she was somewhat suprised and disappointed that the School District did not take a more active role in providing facilities for youth groups. Councilman Gillanders moved to receive and file the Parks and Recreation Commission's facilities study, seconded by Coun- cilman Atkins and unanimously carried. rr- 1 Council Minutes, January 7, 1986 - Page 3 7 NEW BUSINESS: A. TRAFFIC SIGNAL MAINTENANCE AGREEMENT - REVISION IN AGREEMENT RE: INSURANCE REQUIREMENTS City Manager Koski provided background information stating that on June 21, 1985 City Council approved an agreement bet- ween the City and Signal Maintenance, Inc. to provide mainten- ance of signalized intersections for a three -year period com- mencing July 1, 1983. The approval was subject to the com- pany providing the City with a Certificate of Insurance list- ing the City as additionally insured. Due to the impact of the insurance crisis on the company a change in the insured requirements, as outlined in a staff memo dated December 31, has been proposed by the company. Councilman Gillanders moved to amend Section 8 of the Agree- ment between the City and Signal. Maintenance, Inc. per staff memo dated December 31, 1985, seconded by Councilman Atkins and unanimously carried. B. AMENDMENT TO TEMPLE CITY MUNICIPAL CODE - ENFORCEMENT OF CODE SECTION 1200A - INFRACTIONS City Attorney Martin stated that a few years ago the City experimented and tried to make some of the provisions of the Municipal Code infractions rather than misdemeanors which would mean that, upon violation, there would be a maximum $100 fine and there would be no right to trial by jury or other penalty enforceable by the court. The City now feels a change is in order, making some of the offences misdemeanors once again, giving the court more latitude in sentencing and enforcement of the sentencing. City Attorney Martin introduced Ordinance No. 86 -581, amending Section 1200A of the Temple City Municitpa1 Code as it pertains to infractions, for first reading by title only. Councilman Gillanders moved to waive further reading, secon- ded by Councilman Atkins and unanimously carried. 8. COMMUNICATIONS: None 9. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: None wished to address Council. RECESS TO CRA: At this time Council recessed to meet as the Temple City Community Redevelopment Agency; approved the Minutes of the regular meet- ing of December 17, 1985; continued the public hearing regarding development and design controls for Block "A" within the Rosemead Boulevard Redevelopment Project and schematic site plan to Febru- ary 18, 1986; and adopted Resolution No. 259: Warrants and Demands. 10. ACTION ON REQUEST BY CRA: None 11. MATTERS FROM CITY OFFICIALS: A. REDUCTION OF RTD BUS SERVICE City Manager Koski advised that the United States Congress recently passed the Gramm- Rudman - Hollings Amendment mandating a balanced Federal budget for fiscal year 1991. The reduction of the federal deficit could result in a major loss of federal transit operating subsidies for fiscal '86. The loss of these 1 5 1 5,4 Council Minutes, January 7, 1986 - Page 4 funds may necessitate the reduction or cancellation of some bus lines. In Temple City, it is proposed to cancel the Sunday run of Line 267 on Temple City Boulevard and the Satur- day and Sunday run of Line 487/491 on Santa Anita Avenue. Mayor Dennis inquired as to how these cancellations will affect Temple City residents and how many residents would be affecte by the cancellations in service since it was recommended by the Transportation Commission that affected cities might use their Proposition "A" funds to help subsidize SCRTD. City Manager Koski responded that there is no up -to -date survey providing this information. Councilman Gillanders moved to receive and file the staff memorandum regarding the reduction of RTD bus service, secon- ded by Councilman Atkins and unanimously carried. B. COVERED BUS STOPS Councilman Gillanders inquired as to the status of the covered bus stops, noting that the rainy season will soon be here. City. Manager Koski advised that staff will report to Council as soon as possible. C. 42nd ANNUAL CAMELLIA FESTIVAL - CARNIVAL INSURANCE It was brought to the Council's attention that LaMar Kemsley, owner and operator of Kemsle.y'sCarnival, is having difficulty getting more than $1,000,000 required insurance coverage for the upcoming Camellia Festival. Council concurred that the $2,000,000 be required of Mr. Kem- sley and that he exert every effort to get this coverage. D. SOUTHERN CALIFORNIA JOINT POWERS INSURANCE AUTHORITY Councilman Gillanders advised that he voted in favor of having La Canada Flintridge.being accepted into membership with the JPIA. He also reported that a moratorium on membership was now in effect and expected to last until the latter half of 1986. 12. ADJOURNMENT: On motion by Councilman Froehle, seconded by Councilmen Swain, the meeting adjourned at 8:55 p.m. Next meeting of the City Council will be held on Tuesday, January 21, 1986.
