RESOLUTION NO.2007-24
RESOLUTION GRANTING PRELIMINARY PLAT APPROVAL FOR
THE HAMEL STATION RETAIL DEVELOPMENT LOCATED AT 3575 SIOUX
DRIVE REPRESENTED BY UNITED PROPERTIES
WHEREAS, United Properties (the "Applicant") has applied to the City of
Medina (the "City") to plat certain property located at 3575 Sioux Drive (the "Subject
Property"), which is legally described on Exhibit A attached hereto; and
WHEREAS, the preliminary plat of the Subject Property was reviewed by the
Planning Commission at its meeting on February 13, 2007 and, following public hearing
thereon as required by law, the Planning Commission recommended approval thereof,
subject to certain terms and conditions; and
WHEREAS, the City Council on March 6, 2007 and April 17, 2007 reviewed the
preliminary plat for its conformance with the City's ordinances, considered the
recommendations of the Planning Commission and heard comments from the Applicants.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MEDINA, MINNESOTA, that approval be granted to the
Applicant for the preliminary plat of the Subject Property by United Properties, subject to
the following terms and conditions:
1. A preliminary plat is approved to allow a total of three lots, in accordance with
the plans received by the City on March 30, 2007, except as amended by the City
Council.
2. The Applicant shall provide easements for all identified wetlands and utility
easements as demonstrated on the preliminary plat dated March 30, 2007.
3. The Applicant shall comply with the Wetland Conservation Act approval and all
standards.
4. The Applicant shall comply with all City requirements as noted in the comments
from the city engineer, dated April 11, 2007.
5. The Applicant shall obtain approval and appropriate permits from the Elm Creek
Watershed prior to final plat approval.

6. Resolution to the dispute over the adjacent property owner's fence, which
encroaches on the western boundary of the proposed site, shall be resolved in a
manner acceptable to both parties and to the City. The Applicant shall provide a
written statement signed by both parties stating the proposed means of resolution,
which resolution must be acceptable to the City, prior to final plat approval.
7. The Applicant shall be required to provide screening on the western boundary of
the property to screen between the proposed development and the business
operations on the adjacent western property. The Applicant shall provide a
screening plan to the City for review and approval prior to final plat approval.
8. The Applicant shall submit proof of the agreement between the Metropolitan
Council and United Properties for a permanent parking easement on the
Metropolitan Council property.
9. The Applicant shall provide evidence of a formal agreement between United
Properties and the Metropolitan Council for the pervious access drive shown on
the site plan.
10. The Applicant shall be required to comply with the City's park dedication
ordinance and will be required to provide the requested park dedication for 2 lots
prior to final plat approval.
11. The application for final plat must be submitted to the City within 180 days of
preliminary plat approval or the preliminary plat shall be considered void, unless
a written request for time extension is submitted by the Applicant and approved
by the City Council prior to that time.
12. The application for building permits must include grading, drainage and erosion
control plans with each building plan submitted.
13. The Applicant must enter into a development agreement in a form satisfactory to
the City to ensure completion of subdivision improvements and development of
the project in compliance with all City requirements.
14. The Applicant shall pay to the City a fee in an amount sufficient to reimburse the
City for the cost of reviewing the preliminary plat and related documents.

The motion for the adoption of the foregoing resolution was duly seconded by member
Smith and upon vote being taken thereon, the following voted in favor thereof:
Crosby, Cavanaugh, Smith, Weir, and Johnson
And the following voted against same:
None
Whereupon said resolution was declared duly passed and adopted.
