RESOLUTION NO.2007-27
RESOLUTION GRANTING FINAL PLAT APPROVAL FOR
PARKVIEW KNOLL
WHEREAS, Parkview Equestrian LLC dba "Alpine Farms" (the "Applicant") has
applied to the city of Medina (the "City") to plat certain property located at 2182 Homestead
Trail (the "Subject Property"), which the property is legally described on Exhibit A attached
hereto; and
WHEREAS, the preliminary plat was approved by the city council on December 19,
2006 subject to certain terms and conditions; and
WHEREAS, the Applicant has provided a final plat consistent with those terms and
conditions; and
WHEREAS, the city council on May 1, 2007 reviewed the final plat for its conformance
with the City's ordinances, considered the recommendations of staff and heard comments from
the Applicant and other interested parties.
NOW, THEREFORE, BE IT RESOLVED, by the city council of the city of Medina,
Minnesota that final approval be granted for the plat of Parkview Knoll, subject to the following
terms and conditions:
1. A final plat is approved to allow the combination of the creation of one additional
lot, in accordance with the plans dated January 5, 2007.
2. The final plat shall be subject to approval of the wetland mitigation plan by the
City's engineer.
3. Lot 1 shall be subject to all development standards in the RR-2 zoning district.
4. Lot 2 shall be subject to all development standards in the RR (Rural Residential)
zoning district.
5. No floodplain fill or impact is approved at this time.
6. The Applicant and its successors and assigns shall comply with the Wetland
Conservation Act approval and all standards.
7. Best Management Practices (BMPs) for erosion control shall be employed.

8. Approval is subject to the review and approval of the Minnehaha Creek
Watershed District.
9. The Applicant must submit a driveway plan acceptable to the City's engineer
regarding the driveway to Lot 2 if construction of such driveway is not proposed
at this time.
10. Development within the plat is subject to the shoreland Overlay District
requirements identified in Section 827 of the Medina City Code.
11. Development within the plat is subject to the floodplain management Ordinance
requirements identified in Section 826 of the Medina City Code.
12. The Applicant shall comply with all City requirements noted in the comments
from the City's engineer, dated November 2, 2006.
13. The Applicant is subject to the standards in the tree preservation ordinance
(Section 828.41 of the Medina City Code).
14. The park dedication shall be cash in lieu of land for the one new lot ($8,000). The
Applicant shall pay the required park dedication fees prior to release of the final
plat for recording.
15. The application for building permits must include grading, drainage and erosion
control plans with each building plan submitted.
16. The City's building official must approve the soil percolation tests and septic
system designs prior to issuance of building permits. Septic sites must be staked
prior to beginning any construction on site.
17. The Applicant shall pay to the City a fee in an amount sufficient to reimburse the
City for the cost of reviewing the plat and drafting and negotiating any necessary
documents.
18. The Applicant must provide to the City a policy of title insurance regarding the
dedications to the public included in the plat.
19. The Applicant must record a declaration of restrictive covenants in a form
acceptable to the City regarding the driveway to Lot 2.
20. The Applicant must submit a revised final plat for City Council review and
approval if any modifications occur prior to the release of the final plat for filing.
21. The final plat must be filed with the County Recorder within 60 days of the date
of the City Council resolution granting final approval or the final plat shall be
considered void, unless a written request for time extension is submitted by the

Applicant and approved prior to the expiration of said 60 days by the City
Council.

Cavanaugh upon vote being taken thereon, the following voted in favor thereof:

That part of the North half of the Northeast Quarter of Section 20, Township 118, Range
23, Hennepin County, Minnesota, described as follows:
Beginning at the Southwest corner of said North half of the Northeast Quarter of
Section 20; thence South 89 degrees 51 minutes 46 seconds East (assumed basis
for bearings), along the South line of said North half of the Northeast Quarter a
distance of 726.40 feet; thence North 2 degrees 19 minutes East, 131.8 feet;
thence North 69 degrees 50 minutes West, 253.48 feet; thence South 74 degrees
59 minutes West 510.80 feet to a point in the West line of said North half of the
Northeast Quarter; thence South 0 degrees 17 minutes 14 seconds West, along
said West line 85.00 feet to the point of beginning.
Subject to rights of the public for roadway purposes over the westerly 33 feet thereof.

Commencing at the Southeast corner of said South half of the Northeast Quarter; thence
North 89 degrees 43 minutes 30 seconds West, assumed basis for bearings, along the
South line of said Northeast Quarter, 1462.95 feet, to the point of beginning of the tract
herein described; thence North 36 degrees 20 minutes 30 seconds West, 214.00 feet;
thence North 89 degrees 43 minutes 30 seconds West, 506.47 feet, more or less to the
centerline of Homestead Trail; thence Southeasterly along said centerline to the South
line of said Northeast Quarter; thence South 89 degrees 43 minutes 30 seconds East,
along said South line, 511.00 feet, more or less to the point of beginning.
