HomeMy Public PortalAbout2007-028 Resolution Granting Final Plat Approval for Fox Run FarmMember Weir introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 2007-28 RESOLUTION GRANTING FINAL PLAT APPROVAL FOR FOX RUN FARM WHEREAS, James Lane III (the "Applicant") has applied to the City of Medina (the "City") to plat certain property located at 2605 Hamel Road (the "Subject Property"), which is legally described on Exhibit A attached hereto; and WHEREAS, the preliminary plat was approved by the city council on April 17, 2007 subject to certain terms and conditions; and WHEREAS, the Applicant has provided a final plat consistent with those terms and conditions; and WHEREAS, the city council on May 15, 2007 reviewed the final plat for its conformance with the City's ordinances and the terms and conditions of preliminary approval, considered the recommendations of staff and heard comments from the Applicant and other interested parties. NOW, THEREFORE, BE IT RESOLVED, by the city council of the city of Medina, Minnesota that final approval be granted for the plat of Fox Run Farm, subject to the following terms and conditions: 1. A final plat is approved to allow the creation of one additional lot, in accordance with the plans received by the City on April 17, 2007, except as amended by the City Council. 2. No wetland fill or impact is approved at this time. 3. No floodplain fill or impact is approved at this time. 4. The landowner shall comply with the Wetland Conservation Act approval and all standards. 5. Development within the plat is subject to the Floodplain Management Ordinance requirements identified in Section 826 of the Medina City Code. 6. The plat shall dedicate a public right-of-way for Hamel Road and Willow Drive as shown on the plans. Resolution No. 2007-28 June 5, 2007 7. The Applicant shall pay the park dedication fee for 1 new lot prior to final plat approval. 8. The Applicant shall comply with all City requirements as noted in the comments from the City Engineer, dated April 25, 2007. 9. The application for building permits must include grading, drainage and erosion control plans with each building plan submitted. 10. The Building Inspector must approve the soil percolation tests and septic system designs prior issuance of building permits. Septic sites must be staked prior to beginning any construction on site. 11. The Applicant shall comply with the requirements regarding title to the Subject Property as stated in the city attorney's plat opinion of April 27, 2007. 12. The Applicant shall pay to the City a fee in an amount sufficient to reimburse the City for the cost of reviewing the preliminary plat and related documents. Dated: June 5, 2007 T.M.
