HomeMy Public PortalAbout2007-029 Resolution Granting Final Plat Approval for Willow Hill PreserveMember Weir introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 2007-29 RESOLUTION GRANTING FINAL PLAT APPROVAL FOR WILLOW HILL PRESERVE WHEREAS, Bruce Paddock (the "Applicant") has applied to the city of Medina (the "City") to plat certain property located at 2492 and 2520 Willow Drive (the "Subject Property"), which is legally described on Exhibit A attached hereto; and WHEREAS, the plat of the Subject Property, to be known as "Willow Hill Preserve" received preliminary plat approval by the city council on July 18, 2006; and WHEREAS, the Applicant has provided a final plat document consistent with those terms and conditions; and WHEREAS, the city council on June 5, 2007 reviewed the final plat for its conformance with the City's ordinances and the terms and conditions of preliminary approval, considered the recommendations of staff and heard comments from the Applicant. NOW, THEREFORE, BE IT RESOLVED, by the city council of the city of Medina, Minnesota that final approval be granted for the plat of Willow Hill Preserve, subject to the following terms and conditions: 1. A final plat is approved to allow the combination of two lots and subsequent creation of four lots, in accordance with the plans dated May 22, 2007. 2. The Applicant shall comply with building permit requirements which must include grading, drainage and erosion control plans with each building plan submitted. 3. The Applicant must submit a revised final plat for City review and approval if any modifications occur prior to the release of the final plat for filing. 5. The Applicant shall pay to the City a fee in an amount sufficient to reimburse the City for the cost of reviewing the final plat and preparing related documents. 6. Approval is subject to the review of the Minnehaha Creek Watershed District. 7. The Applicant shall pay the applicable park dedication fee for the subdivision. Resolution No. 2007-29 June 5, 2007 8. The final plat must be filed with the Hennepin County Recorder within 60 days of the date of adoption of this resolution or the final plat shall be considered void, unless a written request for time extension is submitted by the Applicant and approved by the city council prior to said time. 9. The Applicant shall enter into a private road agreement that is satisfactory to the City. 10. The Applicant shall enter into a development agreement that is satisfactory to the City. 11. The City intends to establish a storm sewer improvement tax district pursuant to Minn. Stat. § 444.16 et seq. covering the Subject Property and the Applicant consents thereto. 12. The Applicant shall comply with the requirements regarding title to the Subject Property as stated in the city attorney's plat opinion of November 27, 2006, and in supplements thereto.
