HomeMy Public PortalAbout2007-038 Resolution Final Plat for Richard Burke & Ralph Miller for Tomahawk AcresMember Johnson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2007-38 APPROVING FINAL PLAT FOR RICHARD BURKE AND RALPH MILLER FOR TOMAHAWK ACRES LOCATED GENERALLY AT THE INTERSECTION OF HAMEL ROAD AND TOMAHAWK TRAIL WHEREAS, Richard Burke and Ralph Miller (the "Applicants") have requested approval of a final plat for Tomahawk Acres on land legally described on Exhibit A attached hereto (the "Property"); and WHEREAS, the city council on April 17, 2007 granted approval for a preliminary plat of Tomahawk Acres; and WHEREAS, the Applicants have now submitted the final plat of Tomahawk Acres for review and approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MEDINA, MINNESOTA, that it should and hereby does approve the final plat for Tomahawk Acres, subject to the following terms and conditions; 1. A final plat is approved to allow a total of 3 lots, in accordance with the plans received by the City on July 6, 2007, except as amended by the city council; 2. No wetland fill or impact is approved at this time; 3. No floodplain fill or impact is approved at this time; 4. The landowner shall comply with the Wetland Conservation Act approval and all standards; 5. No development is approved at this time; 6. If future development is proposed the plat will be subject to the shoreland overlay district requirements identified in Section 827 of the Medina city code; 7. If development is proposed in the future, the subject property will be required to have a wetland delineation completed; 8. Development within the plat is subject to the floodplain management ordinance requirements identified in Section 826 of the Medina city code; Resolution 2007-38 August 21, 2007 9. If development is proposed in the future, the Applicants will be required to obtain all necessary permits for the proposed driveways; 10. Any application for a building permit must include grading, drainage and erosion control plans with each building plan submitted; 11. The building official must approve the soil percolation tests and septic system designs prior to issuance of building permits. Primary and secondary site locations will also need to be provided and septic sites must be staked prior to beginning any construction on site; 12. The applicant shall be aware that all future subdivision affecting any of the property involved within this lot line rearrangement shall be subject to park dedication, including those lots which are created by this plat; 13. The Applicants shall resolve all of the issues identified in the plat opinion letter from the city attorney dated July 12, 2007, and the supplemental plat opinion letter dated August 15, 2007, prior to the recording of the final plat; 14. The Applicants shall pay to the City a fee in an amount sufficient to reimburse the City for the cost of reviewing the plat and related documents, prior to the recording of the final .plat; 15. The final plat must be filed with the county recorder within 60 days of the date of the city council resolution granting final approval or the final plat shall be considered void, unless a written request for time extension is submitted by the Applicants and approved by the city council.
