CITY OF MEDINA
RESOLUTION NO.2007-39
APPROVING LOT REARRANGEMENT FOR
DARREL A. FARR DEVELOPMENT AND MARK S. BRYANT FOR
PROPERTY LOCATED AT 155 HAMEL ROAD AND 165 HAMEL ROAD
(PIN 12-118-23-41-0035 AND PIN 12-118-23-41-0036)
WHEREAS, Darrel A. Farr Development and Mark S. Bryant (the "Applicants")
are the fee owners of certain property legally described on Exhibit A attached hereto; and
WHEREAS, the Applicants have requested a lot rearrangement which parcels
shall be as described on Exhibit B attached hereto.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY
COUNCIL OF THE CITY OF MEDINA, MINNESOTA, that it should and hereby
does approve the lot rearrangement for the Applicants, subject to the following
conditions:
1. The lot rearrangement results in two lots as shown on plans dated June 26, 2007
and described in Exhibit B;
2. The Applicants understand that the size and shape of the lots as rearranged are at
their request and within their direct control. Any difficulty or inconvenience in
using or developing these lots will have been created by the Applicants. The
Applicants and their successors in interest should not assume the City will grant
any variance to permit the use or development of the lots in the future;
3. The Applicants shall convey drainage and utility easements to the City as shown
on the plans dated June 26, 2007;
4. No construction is applied for or approved at this time. The Applicants
understand that any future construction will be reviewed under the zoning district
standards in place at that time and that each parcel must have a principal use in
place prior to an accessory use being allowed;
5. The Applicants shall abide by all requirements of the city engineer's memo dated
June 14, 2007 and the title opinion from the city attorney dated July 9, 2007; and

6. The Applicants shall pay the City an administrative fee in an amount necessary to
reimburse the City for the cost of reviewing this application and executing other
necessary documents.

The motion for the adoption of the foregoing resolution was duly seconded by member
Cavanaugh upon vote being taken thereon, the following voted in favor thereof:

Whereupon said resolution was declared duly passed and adopted.
