HomeMy Public PortalAbout19-9637 Reaffirming the Adoption of the 2018-2019 Fiscal Year Proprietary and Special Revenue Fund Budget Sponsored by: City Manager RESOLUTION NO. 19-9637 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, REAFFIRMING THE ADOPTION OF THE 2018-2019 FISCAL YEAR PROPRIETARY AND SPECIAL REVENUE FUND BUDGET; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE . WHEREAS, the City of Opa-locka ("City") adopted its Proprietary and Special Revenue Fund Budget on September 26, 2018; and WHEREAS, the Governor's designee approved the said budget on November 19, 2018; and WHEREAS, the City Commission passed Resolution 18-9580 accepting the revisions made by the Governor's designee to the said budget on December 12, 2018; and WHEREAS, the Florida Department of Revenue determined that the Truth In Millage (TRIM) advertisement was incorrect and requires the recertification of the same pursuant to Florida Statute 200.065(13) and the reaffirmation of the said budget (EXHIBIT "A"); and WHEREAS, the City Commission City desires to reaffirm the adoption of the 2018-2019 Proprietary and Special Revenue Fund Budget as required by Florida law and the Florida Department of Revenue. NOW THEREFORE, BE IT RESOLVED THAT THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: Section 1. RECITALS ADOPTED. The recitals to the preamble herein are incorporated by reference. Section 2. AUTHORIZATION The City Commission hereby reaffirms the adoption of the 2018-2019 Proprietary and Special Revenue Fund Budget. Section 3. SCRIVENER'S ERRORS. Sections of this Resolution may be renumbered or re-lettered and corrections of typographical errors which do not affect the intent may be authorized by the City Manager, or the City Manager's designee, without need of public hearing, by filing a corrected copy of same with the City Clerk. Section 4. EFFECTIVE DATE. Resolution No. 19-9637 This Resolution shall take effect immediately upon adoption and is subject to the approval of the Governor or his designee. NOW THEREFORE, THE COMMISSION OF THE CITY OF OPA-LOCKA HEREBY ORDAINS: SECTION 1. RECITALS The recitals to the preamble herein are incorporated by reference. Ordinance No. 18-12 SECTION 2.ADOPTION The City Commission of the City of Opa-Locka hereby approves, adopts and ratifies the proposed Proprietary and Special Revenue Budget for the Fiscal Year 2018-2019, and hereby appropriates the budgeted and expenditures and revenues as set forth in the attached Exhibit"A". SECTION 3.AUTHORITY Pursuant to Article IV, Section 4.5 of the City Charter, the City Manager has recommended a proposed Proprietary and Special Revenue Fund Budget to the City Commission for the Fiscal Year commencing October 1, 2018-2019, a copy of which is attached hereto as Exhibit "A" and incorporated by reference herein. SECTION 4.TITLE This Ordinance shall be known and may be cited as the "2018-2019 Proprietary and Special Revenue Fund Budget Ordinance." SECTION 5. The City Manager is authorized to expend or contract for expenditures, pursuant to the City of Opa-Locka Charter and the adopted Code of Ordinances in accordance with the adopted Proprietary and Special Revenue Budget for Fiscal Year 2018-2019. SECTION 6. The City Commission of the City of Opa-locka hereby approves, adopts and ratifies the proposed Proprietary and Special Revenue Fund Budget for the Fiscal Year 2018-2019 and hereby appropriates the budgeted expenditures and revenues as set forth and attached in Exhibit'A". SECTION 7. The department/division expenditure allocations established by the City Manager, as revised and summarized in the budget attached as Exhibit "A", are hereby adopted and ratified. Funds of the City for the Proprietary and Special Revenue Budget shall be expended in accordance with the appropriations provided in the Budget adopted by this Ordinance, which shall constitute an appropriation of amounts specified therein. Expenditure control will be at the fund level. Funds may be expended by, and with the approval of, the City Manager and the City Commission, in accordance with the provisions of the City Charter, adopted Code of Ordinances and applicable laws. Supplemental appropriations and reduction of appropriations, if any, shall be made in accordance with the City Charter. SECTION 8. Any and all outstanding encumbrances as of September 30, 2018, shall not lapse at that time and appropriations have been hereby provided for those outstanding encumbrances that have been incurred prior to September 30, 2018, but are not expected to be paid until after October 1, 2018. Receipts from sources not Ordinance No. 18-12 anticipated in the attached budget may be appropriated and expended by Ordinance duly enacted by the City Commission in accordance with applicable law. Adjustments within the same fund to departmental appropriations made in the attached Budget may be approved, from time to time, by the City Manager, or by Resolution adopted by the City Commission. The City Manager is authorized to approve adjustments to expenditure code allocations, within the limit of departmental appropriations made in the attached Budget. SECTION 9. All ordinances setting fees and charges, and all other fees and charges consistent with appropriations adopted herein, as may be amended during the fiscal year, are hereby ratified, confirmed and approved. More particularly, for property owners seeking a certificate of occupancy from the City prior to January 1st,they must pay a pro rata share of any outstanding solid waste collection and disposal fees for 2018; and for those property owners seeking a certificate of occupancy from the City after January 1st, they must pay their pro rata share of any outstanding solid waste collection and disposal fees for 2019 and the year thereafter. SECTION 10. All Ordinances setting fees and charges, and all other fees and charges consistent with appropriations adopted herein, as may be amended during the fiscal year, are hereby ratified,confirmed and approved. SECTION 11.CODIFICATION. It is hereby the intention of the Commission of the City of Opa-locka and it is hereby provided that the provisions of this Ordinance may become and be made a part of the Code of Opa-locka,Florida. SECTION 12.SCRIVENER'S ERRORS. Sections of this Ordinance may be renumbered or re-lettered and corrections of typographical errors which do not affect the intent may be authorized by the City Manager, or the City Manager's designee, without need of public hearing, by filing a corrected or re-codified copy of same with the City Clerk. SECTION 13. CONFLICT. Any provision of any City of Opa-locka ordinance or regulation which is in conflict with the provisions of this Ordinance is repealed prospectively to the extent of such conflict. SECTION 14.LIBERAL CONSTRUCTION. The terms and provisions of this Ordinance shall be liberally construed to affect the purpose for which it is adopted. Ordinance No. 18-12 SECTION 15.SEVERABILITY. If any portion of this Ordinance is for any reason held or declared to be unconstitutional, invalid or void, such holding shall not affect the remaining portions of this Ordinance. If this Ordinance shall be held to be inapplicable to any person, property or circumstances, such holding shall not affect the applicability of this Ordinance to any other person,property or circumstances. SECTION 16.EFFECTIVE DATE. This Ordinance shall take effect upon the adoption of this Ordinance by the Commission of the City of Opa-locka and upon a filing of a certified copy hereof with the Florida Department of State and is subject to the approval of the Governor or Governor's Designee. NOW THEREFORE, BE IT RESOLVED THAT THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: Section 1.RECITALS ADOPTED. The recitals to the preamble herein are incorporated by reference. Section 2.AUTHORIZATION The City Commission hereby adopts the 2018-2019 Proprietary and Special Revenue Fund Budget with revisions from the State Oversight Board. ECTION 3. SCRIVENER'S ERRORS. Sections of this Resolution may be renumbered or re-lettered and corrections of typographical errors which do not affect the intent may be authorized by the City Manager, or the City Manager's designee, without need of public hearing, by filing a corrected copy of same with the City Clerk. Section 3.EFFECTIVE DATE. This Resolution shall take effect immediately upon adoption and is subject to the approval of the Governor or his designee.
