RECOMM ENDATION :
The City Council is requested to :
1. Conduct a Public Hearing ; and
2. Adopt Resolution No . 17-5262 (Attachment "A ") approving the Master Fee and
Fine Schedule f or Fiscal Year (FY) 2017-18 , amending and establishing new fees
for several parks and recreation programs .
BACKGROUND :
On J une 21 , 20 16 , t he City Council adopted Resolution No . 16-5171 adopting a Master
Fee Schedule and amending fees for parks and recreation programs .
ANALYSIS :
The proposed fee increases would help defray the increase in cost of operating various
recreation programs in particular facility use fees .

In addition to the parks and recreation program fees listed above , staff is also
recommending a fee for tree appeals . The Temple C ity Municipal Code (Code),
Section 3-40-11 addresses tree removal appeals . The Code allows any person to
appeal staff's decision to remove , or not remove when requested , a pub lic tree to the
Parks and Recreation Commission (Commission). Comm ission decisions can be
appealed to the City Council. According to the Code, fees for an appeal shall be
determined by resolution of the City Council. Although this section of the Code was
adopted by the City Counci l in 2013 , a fee for appeals was never set.
Between January 15, 2014 and December 21 , 2016 , the Comm ission considered seven
(7) appeals of staff's decision to remove , or not remove , trees in the public right-of-way ,
all of which were ultimately appealed to the City Council. Each tree appeal , whether to
the Commiss ion or the City Council , takes a significant amount of staff time to research
the issue , prepare agendas and staff report(s ), develop and mail required notices , and
attend the meetings at which the appeal is scheduled . In developing the fee
recommendation to the Commission , staff worked with the Community Development
Department (COD) to ensure the methodology was cons istent for appeals to the
Planning Commission and/or City Council. Currently , the fee for appeal of a staff
decision to the Planning Commission is at 75 % of the staff cost plus 21 % overhead
(which was previously determined in the 2011 Cost Services Study). Three opt ions for
fee recovery for tree appeals were provided to the Commiss ion at their March 15 , 2017
meeting -50 %, 75 %, or 85 % cost recovery . Th e Commission ultimately recommended
a fee of $260 which is 50 % cost recovery . The same fee would apply to both
Commission and Council appeals .
The proposed fees would help to defray the c osts of operating the corresponding
programs . No increases are proposed to any other existing fees .
CITY STRATEGIC GOALS:
Approval of the Master Fee and Fine Schedule furthers the C ity Strategic Goals of
Good Governance and Sustainable Infrastructure by allowing the City to continue
defraying costs for providing various programs and services , and use of City facilities.
FISCAL IMPACT:
Approving the Master Fee and Fine Schedule would facilitate achiev ing the revenue
projections in the FY 2017-18 City Budget, which are based off of the fees and fine s
specified in the schedule . Consistent with previous City Council direction , the fees
generally aim to achieve cost recovery for the corresponding programs and serv ice s, with
the exception of the planning fees , which ach ieve 75 percent cost recovery , and the parks
and recreation fees , wh ich are determined based on a combination of co st recovery ,

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TEMPLE CITY APPROVING THE MASTER FEE AND FINE
SCHEDULE FOR FISCAL YEAR 2017-18 AND
ESTABLISHING NEW FEES FOR PARKS AND
RECREATION PROGRAMS
WHEREAS , the City Council of the City of Temple City desires to defray the
costs of providing various programs , services, and facilities; and
WHEREAS , the City Council has received and considered information about the
actual cost of providing such programs , services, and facilities ; and
WHEREAS , the City Council held a duly noticed public hearing on June 20 ,
2017 , to consider approving the updated Master Fee and Fine Schedu le for Fiscal Year
2017-18, which includes previously established fees and fines and establishes several
new fees for parks and recreation services .
NOW, THEREFORE, the City Council of the City of Temple City does hereby
resolve , find , determine, and order as follows :
SECTION 1. The fees set forth in the Master Fee and Fine Schedule , attached
hereto as Attachment "A " and incorporated herein by reference , are reasonably
necessary to recover the costs of providing the programs , services , and facilities for which
such fees are levied or authorized to be levied .
SECTION 2. City Council Resolution No . 16-5171 and the attachments thereto are
hereby superseded in their entirety by this resolution and the updated Master Fee and
Fi ne Schedule , attached hereto as Attachment "A" and incorporated herein by reference :
SECTION 3. The City Clerk shall certify to the passage and adoption of this
Resolution and it shall there upon take effect.
