HomeMy Public PortalAboutr 10-171 ~ezoll.ttiott of tlrf '1.$oroJJ9Q of QIctrferd, ~~ JJ~ Nolo-l71 July 22 2010 Date of Adoption-, ~ ," RESOLUTION AUTHORIZING A PROFESSIONAL SERVICES CONTRACT FOR ENGINEERING SERVICES WITH T &M ASSOCIATES - TURNPIKE SEWER CROSSING CONSTRUCTION OBSERVATION & CONTRACT ADMINISTRATION SERVICES WHEREAS, the Borough of Carteret is in need of engineering services in regard to the New Jersey Environmental Infrastructure Trust Project, Turnpike Sewer Crossing Construction Observation & Contract Administration Services; and 'YHEREAS, the Borough's Consulting Engineers, T&M Associates, possess the requisite skill and expertise for said services; and 'VHEREAS, T&M Associates has submitted a proposal to provide said engineering services at a total cost not to, exceed $102,500.00; and WHEREAS, the Mayor and Council have reviewed said proposal; WHEREAS, the Chief Financial Officer has certified that funds are or will be available for said purpose. NO\Y, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Carteret, County of Middlesex, State of New Jersey, as follows: 1. That the proposal from T &M Associates for engineering services in regard to the New Jersey Environmental Infrastructure Project, Turnpike Sewer Crossing Construction Observation and Contract Administration Services at a total cost not to exceed $102,500.00 at the rate set forth in T&M's existing contract with the Borough is hereby approved. 2. That annexed hereto is a copy of said proposal. 3. That this action is approved as an 'award of a professional services contract pursuant to N.J.S.A. 40A:ll~5(1)(a) in accordance with the Borough's Fair and Open Process as authorized by law. 4. That a copy of this resolution be forwarded to the Borough's Purchasing Department and T &M Associates. Contract Administration Services Dear Mayor Reiman: The Borough has awarded a construction contract for the Turnpike Sewer Crossing project to Cruz Contractors, LLC in the amount of$2,273,515.00. As you are aware, the project is funded through the NJ Environmental Infrastructure Trust (EIT) Program. As requested we are prepared to provide contract administration and field inspection services for the project. Our Construction Services Manager and I will coordinate project construction inspection activities. The following is a description of the services we will provide, the anticipated perfonnance period for these services and the budget for the cost of same. The following scope of services is proposed for the project. A. Utility Aureements and Auencv Coordination - Bid Phase 1. PSE&G - Provide sewer easement documents to PSE&G; assist Borough Attorney and appraisai consultant in review of agreement requirements and inclusion of pertinent provisions in bid documents. 2. Conrail- Review of License to Cross with Conrail and Borough representatives and inclusion of "insurance and other agreement requirement in bid documents. 3. NJ Turnpike Authority - Review of License to Cross with NJT A and Borough representatives and inclusion of insurance and other agreement requirement in bid documents. 4. Final modifications to bid documents and discussions in accordance with NJDEP requirements and discussions and various submissions to NJDEP to Dbtain required "authorization to bid." B. Bid Phase Services 1. Advertise the project for bidding on behalf of the Borough. Respond to questions from potential bidders during the bid period. 3. Attend the receipt of bids with appropriate municipal officials. 4. Assist the Borough with the bid review process including an evaluation of the contractor's bid submissions. Prepare a bid tabulation comparing the bids received, review the credentials of the low bidder, and prepare a recommendation of award for Borough action. C. Construction Phase Services I. Contract Administration Submit required docwnents to DEP to secure Authorization to Award. Once a contract has been awarded, we will prepare contracts for review by the Borough Attomey and execution by the Contractor and the Borough. Arrange for and attend a preconstruction meeting with the contractor, Borough representatives, Police Department, PSE&G, NJ Turnpike Authority (NJTA), Conrail, the NJDEP, and affected utility owners including but not limited to: . Adesta Prepare for and attend progress meetings with representatives of the Borough, Contractor, DPE, and agencies/utilities. Tlus scope of services asswnes I progress meeting per month during construction plus an additional meeting during the microtunneling work. Provide contract administration services during constmction of the project. including correspondence, review of payment requests, preparation of payment celiificates, and review of extra requests, and review and preparation of change orders, as required. The contract period is 240 days. 2. Shop and Setting Drawings and Sublnittals Review Review schedule, shop drawings for sewer pipe, manholes, slide gates, microtunneling work, pipe lining, and other specific items of work. For the purpose of this scope of services, it is assumed the initial SUblnittal is for items generally as specified in the contract docwnents; the Contractor's submittals are complete; and an initial review for completeness has been Le: Mayor Daniel J. The review estimate includes one resubmittal to respond to comments in the initial submittal. In order to maintain the proposed budget, partial or incomplete submittals will be returned without review. Review of major substitutions or revised designs is considered beyond this scope of services. Should these services be required it is assumed the contractor would be responsible to cover the related engineering costs. 3. Utility/Agency Coordination Coordination and meetings with PSE&G, NJ Turnpike Authority, and Conrail before and during the construction of the project. The task includes efforts related to monitoring compliance with the agreements and licenses and regnlations of the above agencies. A maximum of2 meetings with each agency is included in this scope of services. Coordination and meetings with the utilities that will be crossed by the sewer construction and microtunneling. This task includes efforts related to monitoring compliance with requirements of utilities with respect to crossings and includes a maximum of 2 utility coordination meetings. Any new requirements from agencies/utility companies not noted herein are considered extra work outside of the scope of services and fee estimate. 4. Field Inspection Services Provide construction observation services to monitor the progress and quality of the executed work of the contractor and to determine, in general, if such work is proceeding in accordance with the Contract Documents. The Engineer shall not be responsible for the means, methods, techniques, sequences, or procedures of construction selected by contractors or the safety precautions and programs in incident to the work of contractors. Field inspection efforts will be directed toward providing confidence for the Owner that completed work of contractor conforms to the contract docwnents, but the Engineer shall not be responsible for the failure of the contractors to perform the work in accordance with the Contract Documents. On the basis of on-site observations, the Enginecr will kccp the Owner informed on the progress of the work, and shall endeavor to guard the Owner against defects and deficiencies in such work, and may disapprove or reject work failing to conform to the Conlract Documents. Full time construction observation services are proposed during open cut pipe and manhole installation, and part time construction observation services are proposed as follows during microtunneling pit constlUction, microtunneling of 48" casing pipe, insertion of carrier pipe, and the lining work and other related work to complete project. . Microtunneling pits - 6 weeks at 20 hrs/week . Microtunneling - 19 days @ 8 hrsIday . Carrier pipe installation- 3 days @ 8 hrs/day . Testing/Restoration - 4 weeks @ 20 hrsIweek . Lining - 5 days @ 4 hrsIday Le: Mayor Daniel J. Reiman -aM ASSOCIATES CART 01820 July 12,2010 Page 4 Re: Turnpike Sewer Crossing Construction Observat.lon and Contract Administration Services It is anticipated the microtunneling of the casing once started will continue 24/7 (24 hours per day / 7 days per week) and will take approximately 18-20 days. This scope of services assumes an overall 5 month period of active construction. 5. Project Closeout and One Year Certification Once construction has been completed, review videotape of completed sewer installation, existing interceptor, and new lining work; prepare final punch list and closeout the project. Conduct a final inspection of the project with the Owner. Prepare fmal payment celtificate and change order and transmit closeout documents to the Borough. Prepare record drawings of the completed construction. The contractor is required by contract to provide record information to assist the Engineer in the preparation of record drawings. The as-built drawings for the NJT A will be prepared using microstation software as required. Conduct an inspection of the project with the NJDEP and the Owner one year after project completion and prepare the One Year Certification as required by the NJDEP. Fee Pronosal We propose to provide the services outlined in the Scope of Services for a fee not to exceed $120,500 invoiced monthly in accordance with our 2010 Municipal Engineering contract in accordance with the following task breakdown: A. Utility/Agreements and Agency Coordination - Bid Phase B. Bid Phase Services C. Construction Phase Services 1. Contract Administration including NJDEP and NJEIT Program Requirements 2. Shop & Selling Drawings and Submittals Review 4. Utility/Agency Coordination 3. Field Inspection Services 5.
