HomeMy Public PortalAbout19-9641 Lien Release for 2345 Service Road Sponsored by: City Manager RESOLUTION NO. 19-9641 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, AUTHORIZING THE CITY MANAGER TO SETTLE, SATISFY AND EXECUTE LIEN RELEASES IN MITIGATION OF CODE ENFORCEMENT LIENS ON PROPERTY LOCATED AT 2345 SERVICE ROAD, OPA-LOCKA, FLORIDA IN THE AMOUNT OF $5,000.00; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, a request to mitigate, satisfy and settle liens, recorded against property located at 2345 Service Road, Opa-locka, Florida, folio#: 08-2121-002-0060 ("the property") was made by Randy Anglin on behalf of Randy Anglin, the property owner, to the City of Opa-locka("City"); and WHEREAS, the property was found to be in partial compliance as evidenced by the Compliance Affidavits attached hereto; and WHEREAS, the amount of said liens and fees against the property is $37,840.50; and WHEREAS, the City Manager reviewed the file and recommends a settlement in the amount of$5,000.00 for Code Enforcement liens and citations; and WHEREAS, the City Commission believes it is in the best interest of the residents and citizens of the City of Opa-locka to accept $5,000.00 to settle and satisfy said liens and execute lien releases. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: Section 1. RECITALS ADOPTED The recitals to the preamble herein are incorporated by reference. Section 2. AUTHORIZATION The Commission of the City of Opa-locka, Florida hereby accepts $5,000.00, to settle and satisfy Code Enforcement Liens and outstanding fees, payable in full within thirty (30) days, and upon receipt of the funds, to cause releases of liens to be executed and recorded. The Commission of the City of Opa-locka, Florida, hereby authorizes and directs the City Manager, or his designee, to execute lien releases in accordance with the above terms and conditions. Section 3. SCRIVENER'S ERRORS Sections of this Resolution may be renumbered or re-lettered and corrections of typographical errors which do not affect the intent may be authorized by the City Resolution No. 19-9641 Manager, or the City Manager's designee, without need of public hearing, by filing a corrected copy of same with the City Clerk. Section 4. EFFECTIVE DATE This Resolution shall take effect immediately upon adoption and is subject to the approval of the Governor or his designee. this 24th day of April, 2019. As we discussed, I purchased the property in September 2015,with the knowledge of the outstanding violations. Having successfully negotiated with the city on previous liens (5%- 10%), I was under the impression that I could achieve a similar settlement. Once I brought the property into compliance I reached out to Ed Brown,who directed me to Vincent Brown,the City Attorney,to facilitate a lien reduction. I initially spoke with City Attorney Brown and then sent an email to him July 2016,which I bcc copied Ed Brown. After not receiving a response I sent a follow up email to City Attorney Brown,to which I received no response (see attached email correspondence). Being fully transparent,prior to this current letter, I did have a conversation with City Attorney Brown to get additional clarity. He stated that he had in fact received the correspondence at the time,but felt that it was not within his authority to issue lien reduction and he referred me back to the City Manager.As we are aware the City Manager position has been unstable for a while,so the matter ended up being tabled. Conceivably, if my request at the time were address we would not be in this situation today. I do understand that the city has recently had some unique challenges so my intention is not the cast blame on anyone. As you are aware the City Manager seat has been in flux for quite some time. This also added to the confusion around who I should speak to regarding this matter. Now that you are back as the current manager, I'm requesting your support with resolving this matter and putting it behind us. ,'r'Av,r corn , angle Unfortunately the city of Opa Locka,has created a very prohibitive lien negotiation policy that severely impacts the ability for reasonable negotiations. I have come to understand that in the past other investors have abused the city's generosity of lien reduction. Some investors have been granted reductions, profited from these reductions, then subsequently left the city and not made good on their promise. From our conversation you have had an opportunity to become familiar with our commitment to the city. Over the past 6 years my company Right Angle has had ownership interest in several multifamily buildings,and quite a few single family homes in the area. We have left a positive impact on many communities and residents throughout the city. In our multifamily properties we sponsored summer tuition for our tenants' children to go to summer camp (see attached email chain). We have sponsored Fourth of July fireworks celebration. We have restored many dilapidated single family homes that have been abandoned for years,and made them available for families to lease or purchase.And creating revenue for the city through adding revenue to the tax base..Total we have owned over 10 single family residential homes in the City. Despite all of the uncertainty swirling around the city, we did not abandon Opa Locka.We used our own capital, at our own expense and at our own risk, and not once burdened the city with any request until now. The current lien legislation is having unintended circumstances,and is creating a strain for me to continue my efforts in the city. Most recently my group and I completed an assemblage of 11 acres in the barracks.We have been working closely with the Community Development Department,to create what may be the city's largest mixed use project to date. Over the past 6 years Right Angle has acquired and owned over$15MM in real estate in the City of Opa Locka, and still counting. We are a viable,solvent organization that is looking to be of assistance to the city. Respectfully we are requesting a lien reduction. Considering all of these liens are administrative and required no manpower on behalf of the city we request the city to accept our offer of$3,000 to settle this matter.
