Services Infiltration/Inflow 2008 Surcharge6 Member Weir introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2007-44 RESOLUTION CONTESTING METROPOLITAN COUNCIL ENVIRONMENTAL SERVICES (MCES) INFILTRATION/INFLOW 2008 SURCHARGE WHEREAS, The Metropolitan Council Environmental Services (MCES) has adopted an Infiltration/Inflow Surcharge Program, and, WHEREAS, the MCES has determined that the City of Medina has experienced at least one peak flow event between June 2004 and June 2006, on June 9, 2004, that exceeds the MCES peak flow goal for the City and therefore the City of Medina is included in the I/I Surcharge Program, and WHEREAS, the MCES has proposed that the City of Medina pay an annual surcharge of $30,310 for a period of five years ($151,550 total) starting in 2007, or appeal the proposed surcharge in accordance with the provisions of the Surcharge Procedure Manual, and WHEREAS, the Surcharge Procedure Manual provides five (5) options for communities to contest the proposed annual surcharge amount, including credit for "peak flow mitigation expenses underway" since the peak flow event, and WHEREAS, the credit for "peak flow mitigation expenses" must be applied for each year before September 15, and expenses must be documented in detail by March 15 of the following year while in the UI program, and WHEREAS, the Cities of Medina, Independence and Greenfield are all tributary to the MCES flow meter that recorded the peak flow event, and WHEREAS, the Cities of Independence and Greenfield are considered by the MCES to be "customers" of the City of Medina, and part of the metered service area, and WHEREAS, the City Engineering firm Bonestroo prepared a letter report dated August 28, 2006 that documented expenses for I/I rehabilitation in excess of the proposed five year surcharge amount and the City of Medina has invested additional effort in 2007 toward UI identification and reduction, and WHEREAS, the MCES is continuing to monitor the flows and the City of Medina will remain in the I/I program with potential future surcharges if the peak flows recur, and NOW THEREFORE BE IT RESOLVED, THAT: Resolution No. 2007-44 September 4, 2007 1. The City Engineer is directed to prepare the annual MCES submittal requesting credit and summarizing efforts and expenditures since June 9, 2004 and submit the document to the MCES on the City's behalf before the September 15, 2008 deadline. 2. The City Engineer is directed to work with the City Administrator to compile the necessary invoices and records and prepare a submittal to document the I/I expenses from the Cities of Medina, Independence, and Greenfield as required by the MCES prior to March 15, 2008. 3. The City of Medina will continue to evaluate the I/I situation as more information is developed in the next few years. 4. The City of Medina is committed to reducing I/I as much as possible to minimize possible surcharges as well as annual volume charges. Dated: September 4, 2007 T.M. Crosby, Jr., May Attest: Chad M.
