HomeMy Public PortalAbout19-9642 Lien release for 1300 Sesame Street Sponsored by: City Manager RESOLUTION NO. 19-9642 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, AUTHORIZING THE CITY MANAGER TO SETTLE, SATISFY AND EXECUTE LIEN RELEASES IN MITIGATION OF CODE ENFORCEMENT LIENS ON PROPERTY LOCATED AT 1300 SESAME STREET, OPA-LOCKA, FLORIDA IN THE AMOUNT OF $10,000.00; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, a request to mitigate, satisfy and settle liens, recorded against property located at 1300 Sesame Street, Opa-locka, Florida, folio#: 08-2121-002-1110 ("the property") was made by Nestor Marin on behalf of DGAF Partners, LLC, the property owner, to the City of Opa-locka("City"); and WHEREAS, the property was found to be in partial compliance as evidenced by the Compliance Affidavits attached hereto; and WHEREAS, the amount of said liens and fees against the property is $183,98.5.51; and WHEREAS, the City Manager reviewed the file and recommends a settlement in the amount of$10,000.00 for Code Enforcement liens and citations; and WHEREAS, the City Commission believes it is in the best interest of the residents and citizens of the City of Opa-locka to accept $10,000.00 to settle and satisfy said liens and execute lien releases. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA: Section 1. RECITALS ADOPTED The recitals to the preamble herein are incorporated by reference. Section 2. AUTHORIZATION The Commission of the City of Opa-locka, Florida hereby accepts $10,000.00, to settle and satisfy Code Enforcement Liens and outstanding fees,payable in full within thirty (30) days, and upon receipt of the funds, to cause releases of liens to be executed and recorded. The Commission of the City of Opa-locka, Florida, hereby authorizes and directs the City Manager, or his designee, to execute lien releases in accordance with the above terms and conditions. Section 3. SCRIVENER'S ERRORS Resolution No. 19-9642 Sections of this Resolution may be renumbered or re-lettered and corrections of typographical errors which do not affect the intent may be authorized by the City Manager, or the City Manager's designee, without need of public hearing, by filing a corrected copy of same with the City Clerk. Section 4. EFFECTIVE DATE. This Resolution shall take effect immediately upon adoption and is subject to the approval of the Governor or his designee. this 24th day of April, 2019. Staff Summary: The property owner is requesting to pay$7,000,however the City Manager does not feel that is a reasonable amount. On February 13,2015 a former City Manager approved a settlement in the amount of$7,000,however the property owner failed to make the payment.The property currently has liens and citations in the amount of$183,985.51 and I am recommending a settlement in the amount of$10,000 primarily because this property have been an eyesore for many years due to the continuous dumping and lack of maintenance from the owner. It would be beneficial for the City to reduce the current amount owed so the property owner can begin development. This property is under contract to be sold and a reduced payoff would help this transaction happen; the buyer has already met with the office of development in the city and they approved our project for a multi-family on the property.
