PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR CRUSE- NICHOLSON President Miller called the meeting to order and the following business was conducted: ROLL CALL Present were: Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clayton Miller, Don Winget, Larry Parker, Misty Hollis, Ron Oler and Phil Quinn. Also in attendance were Walt Chidester, City Attorney; Sally Hutton, Mayor; Karen Chasteen, City Clerk; Valerie Shafer, Wayne County Economic Development Corporation; James French, Richmond Power & Light; Jack Alvey, Sr. Vice President of Generation & Mike Malguamera, Indiana Municipal Power Agency; Allen Elder; Dan Sawyer, Director of Operations, Wolverine/Stride Rite; Ronda Pope, Retired Senior Volunteer Program; Tammy Glenn, Controller, Sue Roberson, Human Resources; Tony Foster, Metropolitan Development; Lt. APPROVAL OF MINUTES Mr. Parker moved to approve the minutes of the meeting held December 16, 2013, supported by Mr. Winget. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS. (MUST BE IN WRITING) • RESOLUTION NO. 1 -2014 — DECLARATORY RESOLUTION DESIGNATING AN ECONOMIC REVITALIZATION AREA ON APPLICATION OF THE INDIANA MUNICIPAL POWER AGENCY Mr. Wissel moved to amend the second NOW THEREFORE, by adding: . . if subsequent ordinance is approved by Common Council, supported by Mr. Quinn. Upon a vote viva voce, the motion carried. The Indiana Municipal Power Agency will be constructing a Solar Park consisting of 4,032 solar panels which will produce 1 megawatt of electricity which will provide energy for 800 -1000 homes. The cost of the construction is $2.46 million. Mr. Quinn moved to approve Resolution No. 1 -2014 as amended, supported by Mr. Winget. Upon a vote viva voce, the motion carried. COMMUNICATIONS FROM THE MAYOR • Thank you to all City Departments who have responded over and above the call of duty during the severe weather. Common Council Minutes January 21, 2014 Page 2 of 6 • The State has let the bid for the South "E" Street project. It is a Four Million Dollar project and the City's portion is Four Hundred Fifty Nine Thousand Dollars ($459,000). • The North 8"' Street project will be let later in 2014 to begin work in 2015. REPORT OF THE BOARD OF PUBLIC WORKS AND SAFETY MINUTES OF THE DECEMBER 12 & 19, 2013 MEETINGS ARE INCLUDED IN PACKETS Mr. Quinn applauded the City for using so many local vendors for projects and services. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and /or ORGANIZATIONS • HISTORIC PRESERVATION COMMISSION — CONFIRMATION OF MAYORAL APPOINTMENTS — DAVID INTERSTRODT, RON HUGHES AND BETH LUNSFORD Ms. Hollis moved to confirm David Inderstrodt, supported by Mr. Winget. Upon a vote viva voce, the motion carried. Mr. Wissel moved to confirm Ron Hughes, supported by Mr. Parker. Upon a vote viva voce, the motion carried. Mr. Winget moved to confirm Beth Lunsford, supported by Ms. Hollis. Upon a vote viva voce, the motion carried. MISCELLANEOUS BUSINESS - None ORDINANCES ON FIRST READING Mr. Elstro moved to suspend the rules and read Ordinance Nos. 2, 4, 5, 6 & 8 -2014 on first reading by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. ORDINANCE NO. 2 -2014 — AN ORDINANCE AUTHORIZING THE ANNUAL COMPENSATION AND BENEFITS OF RICHMOND FIREFIGHTERS The Clerk read Ordinance No. 2 -2014 on first reading by title only. This Ordinance would authorize the addition of Holiday Pay to be added to the base salary of a firefighter, plus an additional $1000.00 for the elimination of a vacation day. With this change, the base salary for a firefighter would remain competitive with the base salary for a police officer. It would also permit their retirees to receive an increase in retirement benefits which has not occurred in at lease five years because their pension benefit is determined as a percentage of the base wage for a Firefighter. There would be no increase in rank differential pay which still needs to be addressed. Mr. Wissel moved to advance Ordinance No. 2 -2014 to second reading, suspend the rules and read by title only, supported by Ms. Cruse- Nicholson. Upon a vote viva voce, the motion carried. Council President Miller declared Ordinance No. 2 -2014 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. vessel moved for engrossment of Ordinance No. 2- 2014, supported by Ms. Cruse- Nicholson. Upon a vote viva voce, the motion passed. Due to a lack of motion to advance, Ordinance No. 2 -2014 will be heard on third and final reading February 3, 2014. common council Minutes January 21, 2014 Page 3 of 6 ORDINANCE NO. 4 -2014 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE AND APPROPRIATION OF A GRANT FROM THE INDIANA DEPARTMENT OF HOMELAND SECURITY (Fire Department) The Clerk read Ordinance No. 4 -2014 on first reading by title only. This Ordinance would authorize the acceptance of a donation in an amount up to Six Thousand Three Hundred Twenty -eight Dollars and Sixty Cents ($6,328.60) to procure hazardous materials response equipment for the Richmond Fire Department. Mr. Wissel moved to advance Ordinance No. 4 -2014 to second reading, suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 4 -2014 as amended on second reading by title only. Council President Miller declared Ordinance No. 4 -2014 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Parker moved for engrossment of Ordinance No. 4- 2014, supported by Ms. Hollis. Upon a vote viva voce, the motion passed. Ms. Hollis moved to advance Ordinance No. 4 -2014 to third and final reading and suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 4 -2014 on third reading by title only. Ordinance No. 4 -2014 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 5 -2014 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE AND APPROPRIATION OF A GRANT FROM THE UNITED STATES CORPORATION FOR NATIONAL AND COMMUNITY SERVICE (Parks — RSVP) The Clerk read Ordinance No. 5 -2014 on first reading by title only. This Ordinance would authorize the City of Richmond to accept grant funding in an amount up to Thirty- one Thousand Six Hundred Twenty-eight Dollars and Zero Cents ($31,628.00), contingent upon a total local match of Thirteen Thousand Five Hundred Fifty -four Dollars and Zero Cents ($13,554.00), of which Six Thousand Dollars and Zero Cents ($6,000.00) shall be from the 2014 Budget of the Richmond Parks and Recreation Department and the remainder of said local match is made by donations and space allowances. These funds would be appropriated to fund programs and services provided by the Retired and Senior Volunteer Program. Mr. Wissel moved to advance Ordinance No. 5 -2014 to second reading, suspend the rules and read by title only, supported by Ms. Hollis. Upon a vote viva voce, the motion carried. The Clerk read Ordinance No. 5 -2014 on second reading by title only. Council President Miller declared Ordinance No. 5 -2014 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Parker moved for engrossment of Ordinance No. 5- 2014, supported by Ms. Hollis. Upon a vote viva voce, the motion passed. Common Council Minutes January 21, 2014 Page 4 of 6 ORDINANCE NO. 6 -2014 — A SPECIAL ORDINANCE ALLOWING PERSONAL PROPERTY TAX ABATEMENTS FOR CERTAIN OFFICES FOR DEDUCTIONS FROM ASSESSED VALUE WITHIN AN ECONOMIC REVITALIZATION AREA The Clerk read Ordinance No. 6 -2014 on first reading by title only. This Ordinance would authorize Common Council to consider personal property tax deductions for certain offices if they meet the definition of an office and comply with all other provisions of Indiana Law and ordinances established by the Common Council for deductions from assessed value and if the following criteria are met: • The applicant commits to a minimum investment in new information technology equipment (as defined in IC 6 -1.1- 12.1 -1) that is valued at $150,000.00; and • The applicant commits to create ten (10) new, full -time jobs within one (1) year; and • The applicant commits to pay an average hourly wage of one and one -half times the state minimum wage; and • The applicant commits to provide health insurance for its employees. If the above criteria are met, the Common Council may approve an application to allow the personal property deduction to follow the two (2) year schedule [Year 1: 100 %; Year 2: 50 %], as adopted in Richmond City Ordinance Number 65 -2013 for Personal Property, and there shall be no deductions on said equipment following the second year. Ordinance No. 6 -2014 was referred to the Tax Abatement Committee for due diligence. ORDINANCE NO. 8 -2014 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (IMPA —equipment) The Clerk read Ordinance No. 8 -2014 on first reading by title only. This Ordinance is a request of the Indiana Municipal Power Agency for a ten year tax abatement on equipment valued at Two Million Tour Hundred Sixty Thousand Two Hundred Sixty Dollars and zero cents ($2,460,260.00). Ordinance No. 8 -2014 was referred to the Tax Abatement Committee for due diligence. ORDINANCES ON SECOND READING ORDINANCE NO. 72-2013 - A GENERAL ORDINANCE DEFINING AND ENFORCING FAIR HOUSING PRACTICES FOR THE CITY OF RICHMOND AND AMENDING RICHMOND CITY CODE CHAPTER 32.51 The Clerk read Ordinance No. 72 -2013 on second reading by title only. This Ordinance would authorize the City of Richmond to amend Section 51 of Chapter 32 of the Richmond City Code by adding the provisions necessary and appropriate to prevent discrimination in the area of housing. Ordinance No. 72 -2013 was held for further review. ORDINANCE NO. 76 -2013 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Vandor) Common Council Minutes January 21, 2014 Page 5 of 6 The Clerk read Ordinance No. 76 -2013 on second reading by title only. This Ordinance is a petition of Vandor Corporation for a ten year tax abatement for manufacturing equipment valued at Five Million Five Hundred Forty Eight Thousand Dollars and zero cents ($5,548,000.00); and, Information Technology equipment valued at Fifty Thousand Dollars and zero cents ($50,000.00). Council President Miller declared Ordinance No. 76 -2013 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Oler moved for engrossment of Ordinance No. 76- 2013, supported by Mr. Winget. Upon a vote viva voce, the motion passed. Mr. Wissel moved to advance Ordinance No. 76 -2013 to third and final reading and suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. AMENDED ORDINANCE NO. 77-2013 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 ( Vandor) The Clerk read Ordinance No. 77 -2013 on second reading by title only. This Ordinance is a petition of Vandor Corporation for a ten year tax abatement for manufacturing equipment valued at Two Hundred Eighty Eight Thousand Dollars and zero cents ($288,000.00). Mr. Oler moved to amend the Jobs Retained to 56 and Jobs Created to 10, supported by Mr. Parker. Upon a vote viva voce, the motion carried. Council President Miller declared Amended Ordinance No. 77 -2013 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Oler moved for engrossment of Amended Ordinance No. 77 -2013, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. Mr. Wissel moved to advance Amended Ordinance No. 77 -2013 to third and final reading and suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. ORDINANCE NO. 78 -2013 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Stride Rite - equipment) The Clerk read Ordinance No. 78 -2013 on second reading by title only. Ordinance No. 78-2013 was held pending approval of Ordinance No. 6 -2014. AMENDED ORDINANCE NO. 79-2013 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Stride Rite -real estate) The Clerk read Ordinance No. 79 -2013 on second reading by title only. Common Counofi Minutes January 21, 2014 Page 6 of 6 This Ordinance is a request of The Stride Rite Corporation for a ten year tax abatement for real estate valued at Three Million Two Hundred Fifty Thousand Dollars and zero cents ($3,250,000.00). Mr. Wissel moved to amend to reflect the Estimated New Value to One Million Four Hundred Thousand Dollars and zero cents ($1,400,000.00), supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion carried. Council President Miller declared Amended Ordinance No. 79 -2013 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Elstro moved for engrossment of Amended Ordinance No. 79 -2013, supported by Mr. Oler. Upon a vote viva voce, the motion passed. Amended Ordinance No. 79 -2013 was adopted with a 9 -0 roll call vote ORDINANCE NO. 80-2013 - AN ORDINANCE AUTHORIZING THE ANNUAL COMPENSATION AND BENEFITS OF RICHMOND POLICE OFFICERS The Clerk read Ordinance No. 80 -2013 on second reading by title only This Ordinance would establish the annual salaries for all police officers will be set forth in a fully executed contract between the Board of Public Works and Safety on behalf of the City of Richmond and John Hennigar Lodge No. 63 of the Fraternal Order of Police to be effective for the 2014 calendar year. Council President Miller declared Ordinance No. 80 -2013 on second reading and public hearing. There being no comments for or against the Ordinance, Ms. Cruse - Nicholson moved for engrossment of Ordinance No. 80 -2013, supported by Ms. Hollis. Upon a vote viva voce, the motion passed.
