PLEDGE OF ALLEGIANCE Councilor Winget called for a moment of silence in memory of local resident and businessman Ronald Oberle. PRAYER BY COUNCILOR WISSEL President Miller called the meeting to order and the following business was conducted: ROLL CALL Present were: Howard "Jack" Elstro, Kelley Cruse- Nicholson, Bruce Wissel, Clayton Miller, Don Winget, Larry Parker, Misty Hollis, Ron Oler and Phil Quinn. Also in attendance were Walt Chidester, City Attorney; Sally Hutton, Mayor; Karen Chasteen, City Clerk; Marshall Ma, Park Department; Fire Department Battalion Chief Jerry Purcell; James French, Richmond Power and Light; Sue Roberson, Human Resources, Tony Foster, Metropolitan Development; .Police Major Mark Connery; Valerie Shafer, Economic Development of Wayne County; Wayne County Councilor Peter Zaleski; Nick Wilson; Barry Cramer; Ron Chapell; Diana Pappin; Jack Alvey, Indiana Municipal Power Agency; Dan Sawyer, Stride Rite Corporation; Mary Walker, Visitors and Tourism Bureau; Sergeant at Arms; and, Media. APPROVAL OF MINUTES Councilor Oler moved to amend the Minutes for the Special Meeting on January 21, 2014 for the election of officers to reflect that Councilor Oler was chosen by consensus to serve as Vice President for 2014, supported by Councilor Quinn. Upon a vote viva voce, the motion carried. Councilor Parker moved to approve the Amended Minutes of the Special Meeting and the Regular Meeting held January 21, 2014 supported by Councilor Winget.. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS RESOLUTION NO. 2-2014 — A RESOLUTION RECOGNIZING THE DESIGNATION OF A PUBLIC WAY AS "TOM RAPER WAY" This Resolution would authorize the designation of the public way currently known as Williamsburg Pike as follows as "TOM RAPER WAY" being also Williamsburg Pike, beginning just south of the intersection of N.W. 5"' and Sheridan Streets and running northwesterly to 1 -70. The Clerk read this Resolution in its entirety: WHEREAS, The Common Council of the City of Richmond, Indiana, (the "Common Council ") wishes to recognize local citizen and business man, Tom Raper, to pay tribute to Mr. Raper as a philanthropist and contributor to the community of the City of Richmond, Indiana; and Common Council Minutes February 3, 2014 Page 2 of 6 WHEREAS, The Common Council also wishes to recognize the Tom Raper RV business to celebrate the 50 year anniversary of the business and to commemorate and appreciate that the Tom Raper RV business has helped place Richmond on the map" and has established a recognizable gateway into the City, and WHEREAS, The City has been approached by interested individuals who wish to assist the City in renaming the roadway currently designated as "Williamsburg Pike" in order that the public way may instead be designated as "Tom Raper Way", and WHEREAS, The United States Postmaster for the Richmond Post Office Branch has informed the Mayor of the City of Richmond that the formal names of public ways can be assigned "alias names" in order that property owners that live on a particular public way do not have to change their formal addresses, and WHEREAS, In accordance with Indiana Code 36 -9 -6-2 and Richmond City Code Chapter 70.35, the City of Richmond Board of Public Works and Safety (the "Board of Works') is authorized to place and maintain traffic- control signs to guide traffic, and WHEREAS, Upon passage of this Resolution and a Resolution by the Board of Works authorizing that the public way currently designated as Williamsburg Pike will instead be designated as "Tom Raper Way" the Mayor of the City of Richmond will notify the Indiana Department of Transportation (71NDOr) of the designation and authorize the exit signs located on Indiana Interstate 70 to notify traffic of the exit to the public way designated as "Tom Raper Way", and WHEREAS, It is in the best interest of the City of Richmond, Indiana, that the Common Council recognize and support that the public way currently designated as Williamsburg Pike will instead be designated as "Tom Raper Way" to pay tribute to Tom Raper as a philanthropist and contributor to the community of the City of Richmond, Indiana and to commemorate the Tom Raper RV business 50 year anniversary. NOW THEREFORE, BE IT RESOLVED by the Common Council of the City of Richmond, Indiana that the Common Council wishes to recognize and support the designation of the public way currently known as Williamsburg Pike as follows: "TOM RAPER WAY Being also Williamsburg Pike. Beginning just south of the intersection of N. W. a and Sheridan Streets and running northwesterly to 1 -70. **(1600 to 2700)° NOW THEREFORE, BE IT ALSO RESOLVED by the Common Council of the City of Richmond, Indiana, that the Common Council wishes to recognize and support that after approval by the City of Richmond Board of Public Works and Safety, the Mayor will notify the Indiana Department of Transportation (INDOT) of the designation and authorize the exit signs located on Indiana Interstate 70 to notify traffic of the exit to the public way designated as "Tom Raper Way. There is not cost to the City for this change and the Post Office will deliver mail if addressed to Williamsburg Pike and /or Tom Raper Way. Councilor Winget moved to approve, supported by Councilor Quinn. Resolution No. 2 -2014 was adopted with an 8 -1 roll call vote. Dissenting was Councilor Elstro. RESOLUTION NO. 3 -2014 - CONFIRMATORY RESOLUTION FOR THE ADOPTION OF A DECLARATORY RESOLUTION DESIGNATING AN ECONOMIC REVITALIZATION AREA OF APPLICATION OF THE INDIANA MUNICIPAL POWER AGENCY Common Council Minutes February 3, 2014 Page 3 of 6 By adoption of this Resolution, the Common Council would confirm its Declaratory Resolution 1 -2014 approved and adopted on January 21, 2014, which designated the Real Estate as an "Economic Development Revitalization Area ". President Miller declared public hearing on Resolution No. 3 -2014. Speaking to the Resolution was Nick Wilson of Richmond. Councilor Winget moved to approve, supported by Councilor Quinn. Upon a vote viva voce, the motion carried. COMMUNICATION FROM THE MAYOR • The 2014 Meltdown Ice Sculpture event was a huge success. • The first Manufacturing Matters class graduated from Ivy Tech. • Veach's Toy Store was featured on the Today Show over the first weekend in February. • There will be Public Hearings on February 5 to discuss the hours of operation of Roseview Transit. The meeting will be at 10 am and 3 pm in the Community Room of the Municipal Building. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the January 9 & 16, 2014, meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and /or ORGANIZATIONS None MISCELLANEOUS BUSINESS Councilor Wissel moved to hear Ordinance No. 6 -2014 before Ordinance No. 78 -2013, supported by Councilor Winget. Upon a vote viva voce, the motion carried. ORDINANCES ON FIRST READING Councilor Elstro moved to suspend the rules and read Ordinance Nos. 1 & 7, 2014 on first reading by title only, supported by Councilor Cruse- Nicholson. Upon a vote viva voce, the motion passed. ORDINANCE NO. 1 -2014 - A SPECIAL ORDINANCE VACATING A PUBLIC WAY (0 South "M" and 0 South 16th Street) The Clerk read Ordinance No. 1 -2014 on first reading by title only. This Ordinance would authorize the City of Richmond to vacate the street located at 0 South "M" Street and 0 South 16"' Street. The City has no desire to construct a public way on this parcel. The lot would revert to the current owner of adjacent property. Ordinance No. 1 -2014 was referred to the Plan Commission for Public Hearing on February 27, 2014. ORDINANCE NO. 7 -2014 — AN APPROPRIATION ORDINANCE AUTHORIZING THE CITY OF RICHMOND TO RECEIVE DONATIONS (Parts) The Clerk read Ordinance No. 7 -2014 on first reading by title only. This Ordinance would authorize the Department of Parks and Recreation to accept donations to be used for Department programs and uses to be held in 2014. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 7 -2014 on second reading by title only. Council President Miller declared Ordinance No. 7 -2014 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Parker moved for engrossment of Ordinance No. 7 -2014, supported by Councilor Winget. Upon a vote viva voce, the motion passed. Councilor Wissel moved to advance Ordinance No. 7 -2014 to third and final reading and suspend the rules and read by title only, supported by Councilor Winget. ORDINANCES ON SECOND READING ORDINANCE NO. 72 -2013 — A GENERAL ORDINANCE DEFINING AND ENFORCING FAIR HOUSING PRACTICES FOR THE CITY OF RICHMOND AND AMENDING RICHMOND CITY CODE CHAPTER 32.51 The Clerk read Ordinance No. 72 -2013 on second reading by title only. This Ordinance would authorize the City of Richmond to amend Section 51 of Chapter 32 of the Richmond City Code by adding the provisions necessary and appropriate to prevent discrimination in the area of housing. Councilor Cruse - Nicholson moved to approve the amendments ad proposed by the Legal Department, supported by Councilor Parker. Upon a vote viva voce, the motion carried. Council President Miller declared Amended Ordinance No. 72 -2013 on second reading and public hearing. Speaking in favor was David Bums. There being no comments against the Ordinance, Councilor Wissel moved for engrossment of Amended Ordinance No. 72 -2013, supported by Councilor Cruse - Nicholson. Upon a vote viva voce, the motion passed. Councilor Wissel moved to advance Amended Ordinance No. 72 -2013 to third and final reading and suspend the rules and read by title only, supported by Councilor Cruse- Nicholson. Upon a vote viva voce, the motion passed. The Clerk read Amended Ordinance No. 72 -2013 on third reading by title only. Amended Ordinance No. 72 -2013 was adopted with a 7 -2 roll call vote. Dissenting were Councilors Hollis and Miller. ORDINANCE NO. 6 -2014 — A SPECIAL ORDINANCE ALLOWING PERSONAL PROPERTY TAX ABATEMENTS FOR CERTAIN OFFICES FOR DEDUCTIONS FROM ASSESSED VALUE WITHIN AN ECONOMIC REVITALIZATION AREA The Clerk read Ordinance No. 6 -2014 on second reading by title only. This Ordinance would authorize Common Council to consider personal property tax deductions for certain offices if they meet the definition of an office and comply with all other provisions of Indiana Law and ordinances established by the Common Council for deductions from assessed value if certain criteria were met. Upon a vote viva voce, the motion carried. Councilor Oler moved to amend paragraph 2. d. by adding hired after Common Council approves the application for abatement supported by Councilor Winget. Upon a vote viva voce of 8 -1, the motion carved. Dissenting was Councilor Miller. Council President Miller declared Amended Ordinance No. 6 -2014 on second reading and public hearing. Speaking in favor were Valerie Shafer and Mary Walker. There being no comments against the Ordinance, Councilor Winget moved for engrossment of Amended Ordinance No. 6 -2014, supported by Councilor Wissel. Upon a vote viva voce, the motion passed. Councilor Parker moved to advance Amended Ordinance No. 6 -2014 to third and final reading and suspend the rules and read by title only, supported by Councilor Cruse - Nicholson. Upon a vote viva voce, the motion passed. The Clerk read Amended Ordinance No. 6 -2014 on third reading by title only. Amended Ordinance No. 6 -2014 was adopted with an 8 -1 roll call vote. Dissenting was Councilor Miller. ORDINANCE NO. 78 -2013 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Wolverine/Stride Rite) The Clerk read Ordinance No. 78 -2013 on second reading by title only. This Ordinance is a request of The Stride Rite Corporation for a ten year tax abatement for equipment valued at Two Million Seven Hundred Fifty Thousand Dollars and zero cents ($2,750,000.00). Councilor Wissel moved to amend to reflect a term of two years, supported by Councilor Winget. Upon a vote viva voce, the motion carried. Council President Miller declared Amended Ordinance No. 78 -2013 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Cruse - Nicholson moved for engrossment of Amended Ordinance No. 78 -2013, supported by Councilor Parker. Upon a vote viva voce, the motion passed. Councilor Wissel moved to advance Amended Ordinance No. 78 -2013 to third and final reading and suspend the rules and read by title only, supported by Councilor Winget. ORDINANCE NO. 8 -2014 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (IMPA) The Clerk read Ordinance No. 8 -2014 on second reading by title only. This Ordinance is a request of the Indiana Municipal Power Agency for a ten year tax abatement on equipment valued at Two Million Tour Hundred Sixty Thousand Two Hundred Sixty Dollars and zero cents ($2,460,260.00). Council President Miller declared Ordinance No. 8 -2014 on second reading and public hearing. Speaking to the Ordinance was Nick Wilson. ORDINANCES ON THIRD READING ORDINANCE NO. 2 -2014 — AN ORDINANCE AUTHORIZING THE ANNUAL COMPENSATION AND BENEFITS OF RICHMOND FIREFIGHTERS The Clerk read Ordinance No. 2 -2014 on third reading by title only. This Ordinance would authorize the addition of Holiday Pay to be added to the base salary of a firefighter, plus an additional $1000.00 for the elimination of a vacation day. With this change, the base salary for a firefighter would remain competitive with the base salary for a police officer. It would also permit their retirees to receive an increase in retirement benefits which has not occurred in at lease five years because their pension benefit is determined as a percentage of the base wage for a Firefighter. There would be no increase in rank differential pay which still needs to be addressed. Ordinance No. 2 -2014 was held on third reading.
