PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR OLER President Miller called the meeting to order and the following business was conducted: ROLL CALL Present were: Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clayton Miller, Don Winget, Larry Parker, Misty Hollis, Ron Oler and Phil Quinn. Also in attendance were Walt Chidester, City Attorney; Sally Hutton, Mayor; Karen Chasteen, City Cleric; Fire Chief Jerry Purcell; Police Major Mario Connery; Human Resource Director Sue Roberson; Alisha Estabrook and Bill Thistlethwaite, Parks and Recreation; Dave Snow; Joe Schroeder; Nick Wilson; Controller Paula Hill; Police Kris and Linda Wolski; Liz Ferris, Career Services and Intemships/Indiana University East; Sergeant at Arms; and, Media. APPROVAL OF MINUTES Councilor Winget moved to approve the minutes of the meeting held March 17, 2014, supported by Councilor Hollis. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS • CAREER FAIR — Ms. Ferris reported on the success of the recent Career Fair held at Reid Hospital. There were 172 participants. COMMUNICATION FROM THE MAYOR • The "E" Street Project has begun • The Gorge Clean Up was April 5 — large number of volunteers • Neighborhoods Clean up begins April 12 - REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the March 6, 13 & 20, 2014, meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and/or ORGANIZATIONS • POLICE MERIT COMMISSION — Chief Wolski has requested the reappointment of Ann England. President Miller held this until April 21 to allow time for additional nominations. Common Council Minutes April 7, 2014 Page 2 of 5 • AVIATION BOARD — Don Winget updated Council on construction projects and the potential of renaming to Richmond Regional Airport. MISCELLANEOUS BUSINESS • Councilor Cruse- Nicholson reminded Council and the public of a gathering scheduled for April 8, 7:30 pm on the Wayne County Courthouse lawn to bring attention to Child Abuse Month. • President Miller requested Chapter 78 of the Richmond City Code be revised to reflect changes in the Indiana State Law re Scooter Registration. • Councilor Quinn announced there will be a meeting of Contractors and subcontractors on April 17, 2014, 6-8 pm. Revisions of fees and fines will be discussed. ORDINANCE NO. 1 -2014 —A SPECIAL ORDINANCE VACATING A PUBLIC WAY Councilor Wissel moved to reconsider Ordinance No. 1 -2014, supported by Councilor Winget. Upon a vote viva voce, the motion carried. Councilor Cruse - Nicholson moved to un- engross, supported by Councilor Winget. Upon a vote viva voce, the motion carried. Councilor Wissel moved to Amend to include the following: WHEREAS, There will be a 20' easement on the west side of the vacated right -of -way to access sewer lines behind properties on South "L" Street, and WHEREAS, The vacation would not hinder the growth and orderly development of the community in which it is located in or contiguous to since the land is unlikely to be developed for residential purposes, and WHEREAS, The vacation would not make access to lands owned by others by means of a public right -of -way difficult or inconvenient because the property owner still has access from a right -of -way at South "M° and South 15'* Street; and WHEREAS, The vacation would not hinder the public's access to a church, school or other public building or place because those structures are not adjacent to this property; and WHEREAS, The vacation would not hinder the use of a public way by the neighborhood in which it is located or to which it is contiguous because residences block the potential of extending South 1 e Street to South "L" Street and there are no plans to ever do so; and This motion was supported by Councilor Oler. Upon a vote viva voce, the motion carried. Councilor Wissel moved to engross Amended Ordinance No. 1 -2014, supported by Councilor Winget. Upon a vote viva voce, the motion carried. Councilor Winget moved to suspend the rules and advance Amended Ordinance No. 1 -2014 to third and final reading, supported by Councilor Cruse - Nicholson. Upon a vote viva voce, the motion carried. The Clerk read Amended Ordinance No. 1 -2014 on third reading by title only. Amended Ordinance No. 1 -2014 was adopted with a 9 -0 roll call vote. Common Council Minutes April 7, 2014 Page 3 of 5 ORDINANCES ON FIRST READING Councilor Elstro moved to suspend the rules and read Ordinance Nos. 3, 16 & 13 -2014 on first reading by title only, supported by Councilor Winget. Upon a vote viva voce, the motion passed. ORDINANCE NO. 3 -2014 — A SPECIAL ORDINANCE AUTHORIZING THE CITY OF RICHMOND TO RECEIVE DONATIONS FOR RICHMOND FIRE DEPARTMENT PROGRAMS The Clerk read Ordinance No. 3 -2014 on first reading by title only. This Ordinance would authorize the City of Richmond to accept donations during the calendar year 2014 for various Richmond Fire Department programs Councilor Wissel moved to advance Ordinance No. 3 -2014 to second reading, suspend the rules and read by title only, supported by Councilor Hollis. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 3 -2014 on second reading by title only. Council President Miller declared Ordinance No. 3 -2014 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Parker moved for engrossment of Ordinance No. 3 -2014, supported by Councilor Winget. Upon a vote viva voce, the motion passed. Councilor Parker moved to advance Ordinance No. 3 -2014 to third and final reading and suspend the rules and read by title only, supported by Councilor Winget. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 3 -2014 on third reading by title only. Ordinance No. 3 -2014 was adopted with a 9-0 roll call vote. ORDINANCE NO. 16 -2014 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL,ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM THE FEDERAL EMERGENCY MANAGEMENT AGENCY ASSISTANCE TO FIREFIGHTER GRANT PROGRAM The Clerk read Ordinance No. 16 -2014 on first reading by title only. This Ordinance would authorize the City of Richmond through the Fire Department to submit and accept a grant in an amount up to Two Hundred Thirty-three Thousand Two Hundred Twenty Dollars and Forty - eight Cents ($233,220.48) from the FEMA Assistance to Firefighter Grant Program.The local match of Eleven Thousand Six Hundred Sixty -one Dollars and Two Cents ($11,661.02) will be supplied by the 2014 Richmond Fire Department budget. Said grant funding shall be used for compensation of members attending classes for Inspection 1 /11, books and materials for the classes, two- hundred sixty (260) hours of class time instruction (with a total of four (4) classes), nine (9) i- Phones, twenty-four (24) i -Pads, and technical support costs. Councilor Wissel moved to advance Ordinance No. 16 -2014 to second reading, suspend the rules and read by title only, supported by Councilor Winget. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 16 -2014 on second reading by title only. Council President Miller declared Ordinance No. 16 -2014 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Cruse - Nicholson moved for engrossment of Ordinance No. 16 -2014, supported by Councilor Quinn. Upon a vote viva voce, the motion passed. Councilor Parker moved to advance Ordinance No. 16 -2014 to third and final reading and suspend the rules and read by title only, supported by Councilor Winget. Ordinance No. 16 -2014 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 17 -2014 — AN APOPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE AND APPROPRIATION OF A GRANT FROM EMPLOYMENT AID READINESS NETWORK INDIANA (Park) The Clerk read Ordinance No. 17 -2014 on first reading by title only. This Ordinance would authorize the City of Richmond through the Department of Parks and Recreation to submit and accept a grant from the Employment Aid Readiness Network in an amount up to Sixteen Thousand Dollars and Zero Cents ($16,000.00). If awarded this grant shall be appropriated to fund or reimburse the hiring of up to five (5) temporary interns to assist with office work and help with summer camps for the Parks Department. Councilor Wissel moved to advance Ordinance No.17 -2014 to second reading, suspend the rules and read by title only, supported by Councilor Elstro. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 17-2014 on second reading by title only. Council President Miller declared Ordinance No.17 -2014 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Cruse - Nicholson moved for engrossment of Ordinance No. 17-2014, supported by Councilor Elstro. Upon a vote viva voce, the motion passed. Councilor Parker moved to advance Ordinance No.17 -2014 to third and final reading and suspend the rules and read by title only, supported by Councilor Hollis. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 17-2014 on third reading by title only. Ordinance No. 17-2014 was adopted with a 9 -0 roll call vote. ORDINANCES ON SECOND READING ORDINANCE NO. 11 -2014 - AN APPROPRIATION ORDINANCE AUTHORIZING ADDITIONAL APPROPRIATIONS FROM CERTAIN FUNDS (Fire and Police Departments) The Clerk read Ordinance No. 11 -2014 on second reading by title only. This Ordinance would authorize appropriations to the Police and Fire Department budgets. Council President Miller declared Ordinance No. 11-2014 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Wissel moved for engrossment of Ordinance No.11 -2014, supported by Councilor Quinn. Upon a vote viva voce, the motion passed. Councilor Wissel moved to advance Ordinance No. 11-2014 to third and final reading and suspend the rules and read by title only, supported by Councilor Elstro. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 11-2014 on third reading by title only. Ordinance No. 11-2014 was adopted with an 8 -1 roll call vote. Dissenting was Councilor Miller.
