CITY OF MEDINA
RESOLUTION NO.2007-45
APPROVING LOT LINE REARRANGEMENT FOR WILLOW HILL
PRESERVE
WHEREAS, the city of Medina (the "City") is a municipal corporation,
organized and existing under the laws of Minnesota; and
WHEREAS, Bruce G. Paddock is the owner of Lot 3, Block 1, Willow Hill
Preserve and Chris Mallett is the owner of Lot 4, Block 1, Willow Hill Preserve,
Hennepin County, Minnesota (the "Property"); and
WHEREAS, Bruce G. Paddock and Chris Mallett (the "Applicants") have
requested approval of a lot line rearrangement to allow the south end of the common lot
line between Lots 3 and 4 of Willow Hill Preserve to be moved approximately 50 feet to
the east in accordance with the survey received July 27, 2007; and
WHEREAS, the new legal descriptions of the lots are included in Exhibit A
attached hereto; and
WHEREAS, the City Council on August 21, 2007 reviewed the lot line
rearrangement application, considered the recommendations of City staff and heard
comments from the Applicants.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MEDINA, MINNESOTA, that it should and hereby does approve
the lot line rearrangement for Willow Hill Preserve, subject to the following terms and
conditions:
1. A lot line rearrangement is approved to allow the south end of the common lot
line between Lots 3 and 4 of Willow Hill Preserve to be moved approximately 50
feet to the east, in accordance with the survey received July 27, 2007.
2. Lot line rearrangement approval is contingent upon approval of the vacation of
the existing 10-foot wide drainage and utility easements along both sides of the
common lot line between Lots 3 and 4.
3. The Applicants shall dedicate new 10-foot wide drainage and utility easements
along both sides of the new common lot line between lots 3 and 4.
4. The Applicants must file the lot line rearrangement and easements with Hennepin
County within 60 days of the date of this resolution or the approval hereby
granted shall be null and void.

5. The Applicants must comply with all requirements of the city attorney's title
opinion letter dated August 30, 2007.
6. The Applicants shall pay to the City a fee in an amount sufficient to reimburse the
City for the cost of reviewing the lot line rearrangement and related documents.

The motion for the adoption of the foregoing resolution was duly seconded by member
Smith and upon vote being taken thereon, the following voted in favor thereof:
Crosby, Smith, Weir, Cavanaugh, Johnson
and the following voted against same:
None
Whereupon said resolution was declared duly passed and adopted.

Legal Descriptions
Lot 3, Block 1, WILLOW HILL PRESERVE, Except that part of said Lot 3 lying
westerly of the following described "Line A. Beginning at the most westerly
corner of said Lot 3; thence on an assumed bearing of South 37 degrees 47
minutes 57 seconds East along the northerly segment of the westerly line of said
Lot 3 a distance of 274.22 feet to an angle point in said westerly line; thence
South 8 degrees 25 minutes 29 seconds East to the south line of said Lot 3, and
said "Line A" there terminating.
Lot 4, Block 1, WILLOW HILL PRESERVE, and that part of Lot 3, said Block 1,
which lies westerly of the following described "Line A. Beginning at the most
westerly corner of said Lot 3; thence on an assumed bearing of South 37 degrees
47 minutes 57 seconds East along the northerly segment of the westerly line of
