PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR WISSEL President Miller called the meeting to order and the following business was conducted: ROLL CALL Present were: Kelley Cruse - Nicholson, Bruce Wissel, Clayton Miller, Don Winget, Larry Parker, Misty Hollis, Ron Oler and Phil Quinn. Also in attendance were Walt Chidester, City Attorney; Sally Hutton, Mayor; Karen Chasteen, City Clerk; Eric Marsh, Whitewater Community Television; Representatives of the American Federation of State, County and Municipal Employees; Nick Wilson, John McBride, President of West End Bank; Paula Hill, City Controller; Police Chief Kris and Linda Wolski; Mike Nottingham; Save Snow; Dakota Collins; Jay Cassell; Kim Vessels, Assistant City Attorney; Mike Reece, President of the American Federation of State, County and Municipal Employees Local 1791 and Scott Lottick, Executive Board of Local 1791; Sergeant at Arms; and, Media. APPROVAL OF MINUTES Councilor Parker moved to approve the minutes of the meeting held July 14, 2014, supported by Councilor Winget. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS None COMMUNICATION FROM THE MAYOR • The Blight Elimination Grant request has been submitted. • The Japanese Sister City will have representatives visiting. • The Regional Neighborhood Conference will be held the second week of September. So far 300 reservations have been received. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the July 3 & 10, 2014, meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and/or ORGANIZATIONS • Mr. Marsh of Whitewater Community Television reviewed the activities of this station. S:commoncouncit/minutes /2014 /ju12 Ldoc Common Council Minutes July 21, 2014 Page 2 of 5 MISCELLANEOUS BUSINESS ORDINANCE NO. 28 -2014 - AN APPROPRIATION ORDINANCE ALLOWING STIPENDS IN LIEU OF PERMANENT SALARY AND WAGE INCREASES TO BE PAID TO CERTAIN EMPLOYEES OF THE CITY OF RICHMOND Ordinance No. 28 -2014 is scheduled to be on second reading and public hearing; however, Ordinance Nos, 21 & 27 -2014 cannot be read until a vote has been taken on Ordinance No. 28 -2014. The Clerk read Ordinance No. 28 -2014 on second reading by title only. This Ordinance would allow stipends in the amount of Five Hundred Dollars and zero cents ($500.00) be paid to all full -time employees except police and firefighter bargaining unit members and all permanent part-time employees to receive a stipend proportional to full -time hours worked on July 25, 2014. Councilor Parker moved to amend by changing the payment date to August 8, 2014 as recommended by the Administration, supported by Councilor Winget. Upon a vote viva voce, the motion carried with a 7 -1 vote. Dissenting was Councilor Cruse- Nicholson. Council President Miller declared Amended Ordinance No. 28 -2014 on second reading and public hearing. Speaking for the Ordinance were Messrs. Reece and Lottick. There being no comments against the Ordinance, Councilor Parker moved for engrossment of Amended Ordinance No. 28 -2014, supported by Councilor Wissel. Upon a vote viva voce, the motion passed. Councilor Wissel moved to advance Amended Ordinance No. 28 -2014 to third and final reading and suspend the rules and read by title only, supported by Councilor Winget. Upon a vote viva voce, the motion passed. The Clerk read Amended Ordinance No. 28 -2014 on third reading by title only. Amended Ordinance No. 28 -2014 was adopted with an 8-0 roll call vote. ORDINANCES ON FIRST READING Councilor Parker moved to suspend the rules and read Ordinance Nos. 21, 27, 29, 30 and 31 -2014 on first reading by title only, supported by Councilor Winget. Upon a vote viva voce, the motion passed. ORDINANCE NO. 21 -2014 — AN APPROPRIATION ORDINANCE AMENDING THE 2014 BUDGET (Clerk) The Clerk read Ordinance No. 21 -2014 on first reading by title only. This Ordinance would authorize the transfer of One Thousand Five Hundred Dollars and zero cents ($1,500.00) from various accounts into Regular Salaries to allow stipends to be paid to employees of the Clerk's Office. Councilor Wissel moved to advance Ordinance No. 21 -2014 to second reading, suspend the rules and read by title only, supported by Councilor Oler. Upon a vote viva voce, the motion passed. ORDINANCE NO. 27 -2014 — AN APPROPRIATION ORDINANCE AMENDING THE 2014 BUDGET (IT, HR and Law) The Clerk read Ordinance No. 27 -2014 on first reading by title only. This Ordinance would authorize the transfer of Four Thousand Dollars and zero cents ($4,000.00) from various accounts into Regular Salaries to allow stipends to be paid to employees of the Information and Technology, Human Resources and the Law Department. Councilor Parker moved to advance Ordinance No. 27 -2014 to second reading, suspend the rules and read by title only, supported by Councilor Oler. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 27 -2014 on second reading by title only. Council President Miller declared Ordinance No. 27 -2014 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Wissel moved for engrossment of Ordinance No. 27 -2014, supported by Councilor Hollis. Upon a vote viva voce, the motion passed. Councilor Parker moved to advance Ordinance No. 27 -2014 to third and final reading and suspend the rules and read by title only, supported by Councilor Winget. ORDINANCE NO. 29 -2014 - AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE AND APPROPRIATION OF A GRANT FROM THE UNITED STATES CORPORATION FOR NATIONAL AND COMMUNITY SERVICE (RSVP) Councilor Cruse - Nicholson moved to strike Ordinance No. 29 -2014, supported by Councilor Hollis. Upon a vote viva voce, the motion carried. ORDINANCE NO. 30 -2014 - AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM THE STAMM KOECHLEIN FAMILY FOUNDATION The Clerk read Ordinance No. 30 -2014 on first reading by title only. This Ordinance would authorize the City of Richmond to submit a grant application to the Stamm Koechlein Family Foundation; and, accept said grant funding in an amount up to Eight Thousand Dollars and Zero Cents ($8,000.00). If awarded, the funds shall be appropriated to fund the JUKO program. Councilor Wissel moved to advance Ordinance No. 30 -2014 to second reading, suspend the rules and read by title only, supported by Councilor Winget. Upon a vote viva voce, the motion passed. Councilor Wissel moved to advance Ordinance No. 30 -2014 to third and final reading and suspend the rules and read by title only, supported by Councilor Winget. ORDINANCE NO. 31 -2014 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE AND APPROPRIATION OF A GRANT FROM THE INDIANA DEPARTMENT OF TRANSPORTATION (Roseview) This Ordinance will be held and read on first reading August 4, 2014. ORDINANCES ON SECOND READING AMENDED ORDINANCE NO. 15-2014 - A GENERAL ORDINANCE AMENDING CHAPTER 98 UNSAFE BUILDINGS AND CHAPTER 158 HISTORIC DISTRICTS The Clerk read Ordinance No. 15 -2014 on second reading by title only. This Ordinance would amend Chapter 98 and 158 in order to resolve future conflicts that may arise in connection with properties that will be issued pre - hearing orders by the City's Enforcement Authority in order that owners of a given property or other interested persons may not circumvent the Unsafe Building Law by seeking Interim Protection of a particular property. Councilor Oler moved to amend by adding the following as recommended by Mr. Foster: Unsafe Building Commission Chapter 98.14 (b) The Commission shall consist of three (3) members appointed by the Mayor and one non - voting advisory member appointed by the Historic Preservation Commission annually. Historic Preservation Commission Chapter 152.02 (b) Composition: The Commission shall consist of seven (7) voting members and one non - voting advisory member appointed by the Unsafe Building Commission annually. The voting members shall be appointed by the Mayor of the City of Richmond, IN subject to the approval of the Common Council... This motion was supported by Councilor Hollis. Upon a vote viva voce, the motion carried. Councilor Wissel moved to amend by adding the following Plan Commission recommendation: Prior to entering an "Order of Enforcement" the Department of Metropolitan Development (DMD) shall notify a property owner of its intent to issue such Order. The notice shall include a statement that the Historic Preservation Commission (HPC) will be notified if the DMD does not receive a plan of action for the property within 30 days of receipt of the notice. This motion was supported by Councilor Cruse - Nicholson. Upon a vote viva voce, the motion carried with a 6 -2 vote. Dissenting were Councilors Hollis and Oler. After additional discussion, Councilor Cruse- Nicholson moved to rescind the amendment to include the Plan Commission recommendation, supported by Councilor Hollis. Upon a vote viva voce, the motion carried with a 5 -3 vote. Dissenting were Councilors Wissel, Winget and Miller. Council President Miller declared Amended Ordinance No. 15 -2014 on second reading and public hearing. Speaking for the Ordinance was Messrs. McBride and Wilson. There being no comments against the Ordinance, Councilor Parker moved for engrossment of Amended Ordinance No. 15 -2014, supported by Councilor Wissel. Upon a vote viva voce, the motion passed. Councilor Wissel moved to advance Amended Ordinance No. 15 -2014 to third and final reading and suspend the rules and read by title only, supported by Councilor Winget. Upon a vote viva voce, the motion passed. The Clerk read Amended Ordinance No. 15 -2014 on third reading by title only. Amended Ordinance No. 15 -2014 was adopted with an 8-0 roll call vote.
