PROCEEDINGS OF THE COMMON COUNCIL OF
THE CITY OF RICHMOND, INDIANA,
OCTOBER 20, 2014
The Common Council of the City of Richmond, Indiana met in regular session October 20, 2014 in the
Council Chambers in said City.
PLEDGE OF ALLEGIANCE
PRAYER BY COUNCILOR QUINN
President Miller called the meeting to order and the following business was conducted:
ROLL CALL
Councilors present were Doug Goss, Kelley Cruse - Nicholson, Bruce Wissel, Clayton Miller, Don Winget,
Larry Parker, Misty Hollis, Ron Oler and Phil Quinn.
Also in attendance were Walt Chidester, City Attorney; Sally Hutton, Mayor; Karen Chasteen, City Cleric;
Dave Young, JohnsManville Plant Manager, Valerie Shafer, Wayne County Economic Development

APPROVAL OF MINUTES
Councilor Winget moved to approve the minutes of the meeting held October 6, 2014, supported by
Councilor Parker. Upon a vote viva voce, the motion passed.
PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS,
MOTIONS, RESOLUTIONS
None
COMMUNICATION FROM THE MAYOR
• The City offices are open on Election Day
• City offices are closed on November 11 in honor of Veterans
• The Veteran's Day parade will be November 8
• The Christmas Parade will be December 5
• Leaf pick up is on a 13 day rotation
REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY
Minutes of the September 25 & October 9, 2014 meetings were accepted as presented.

• BOARD OF ZONING APPEALS — Mr. Dickman does not want to be reappointed. Council will be
seeking additional nominations.

• STREET TREE COMMISSION — Councilor Wissel moved to reappoint Neil Sabine, supported by
Councilor Winget. Upon a vote viva voce, the motion carried.
MISCELLANEOUS BUSINESS
Councilor Wissel moved to strike Ordinance No. 21 -2014, supported by Councilor Winget. Upon a vote
viva voce, the motion carried.
ORDINANCES ON FIRST READING
Councilor Parker moved to suspend the rules and read Ordinance Nos. 47, 48, 49, 50, 512, 52, 53, 54-
2014 on first reading by title only, supported by Councilor Cruse - Nicholson. Upon a vote viva voce, the
motion passed.
ORDINANCE NO. 47 -2014 - AN APPROPRIATION ORDINANCE AUTHORIZING ADDITIONAL
APPROPRIATIONS FROM CERTAIN FUNDS (First Response)
The Clerk read Ordinance No. 47 -2014 on first reading by title only.
This Ordinance would authorize the appropriation of funds as follows:
From First Response Fund (205.11.107.000.777.5139) $205,997.98
To 205.11.107.150.000.1302 $192,265.96
To 205.11.107.150.000.4490 $ 13,732.02
Councilor Wissel moved to advance Ordinance No. 47 -2014 to second reading and public hearing and
read by title only, supported by Councilor Winget. The motion was defeated with an 8 -1 vote viva voce.
Dissenting was Councilor Hollis.
Ordinance No. 47 -2014 will be heard on second reading November 3, 2014.
ORDINANCE NO. 48 -2014 — AN APPROPRIATION ORDINANCE AMENDING THE 2014 BUDGET
(Clerk)
The Clerk read Ordinance No. 48 -2014 on first reading by tide only.
This Ordinance would replace Ordinance No. 21 -2014 which was an appropriation ordinance amending
the 2014 budget which authorized the transfer of funds to Regular Salaries for stipends in the Clerk's
budget The account numbers were incorrect. To date, the funds have not been transferred; therefore,
Ordinance No. 21 -2014 was stricken. The correct fund numbers are as follows:
Delete $600.00 from 101.03.030.110.000.3121 (Litigation)
$250.00 from 101.03.030.110.000.3240 (Travel)
$50.00 from 101.03.030.110.000.3150 (Recording Fees)
$50.00 from 101.03.030.110.000.3220 (Postage)
$50.00 from 101.03.030.110.000.3320 (Contractual Printing)
$500.00 from 101.03.030.110.000.3911 (Training)
Add $1500.00 to 101.03.030.110.000.1196 (Regular Salaries)
Councilor Wissel moved to advance Ordinance No. 48 -2014 to second reading, suspend the rules and
read by title only, supported by Councilor Winget. Upon a vote viva voce, the motion passed.

Council President Miller declared Ordinance No. 48 -2014 on second reading and public hearing. There
being no comments for or against the Ordinance, Councilor Parker moved for engrossment of Ordinance
No. 48 -2014, supported by Councilor Oler. Upon a vote viva voce, the motion passed.
Councilor Wissel moved to advance Ordinance No. 48 -2014 to third and final reading and suspend the
rules and read by title only, supported by Councilor Winget. Upon a vote viva voce, the motion passed.
The Clerk read Ordinance No. 48 -2014 on third reading by title only.
Ordinance No. 48 -2014 was adopted with a 9 -0 roll call vote.
ORDINANCE NO. 49 -2014 — AN APPROPRIATION ORDINANCE AMENDING THE 2014 BUDGET
(Human Resources)
The Clerk read Ordinance No. 49 -2014 on first reading by title only.
This Ordinance would authorize the transfer of funds in the 2014 Human Resources Budget as follows:
Delete $1,500.00 from Unemployment Compensation (101.01.003.110.000.1221)
Add $1,000.00 to Travel (101.01.003.110.000.3240)
$ 400.00 to Training and Education (101.01.003.110.000.3911)
$ 100.00 to Office Supplies (101.01.003.110.000.2130)
Councilor Parker moved to advance Ordinance No. 49 -2014 to second reading and public hearing and
read by title only, supported by Councilor Winget. The motion was defeated with an 8 -1 vote viva voce.
Dissenting was Councilor Hollis.
Ordinance No. 49 -2014 will be heard on second reading November 3, 2014.
ORDINANCE NO. 50 -2014 - AN APPROPRIATION ORDINANCE AMENDING THE 2014 BUDGET
(Street)
The Clerk read Ordinance No. 50 -2014 on first reading by title only.
This Ordinance would authorize the transfer of funds in the 2014 Local Road and Street Fund as follows:
Delete $25,000.00 from Other Contractual Services (218.18.180.180.000.3990)
Add $25,000.00 to Fleet Gasoline & Maintenance (218.18.180.180.000.2211)
Delete $120,000 from Hot/Cold Mix (210.18.180.180.000.2363)
Add $120,000 to Other Equipment (210.18.180.180.000.4490)
Councilor Parker moved to advance Ordinance No. 50 -2014 to second reading and public hearing and
read by title only, supported by Councilor Winget. The motion was defeated with an 8 -1 vote viva voce.
Dissenting was Councilor Hollis.
Ordinance No. 50 -2014 will be heard on second reading November 3, 2014.
ORDINANCE NO. 51 -2014 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL,
ACCEPTANCE AND APPROPRIATION OF A GRANT FROM ARTPLACE AMERICA
The Clerk read Ordinance No. 51 -2014 on first reading by title only.
This Ordinance would authorize the City of Richmond to submit a grant application to ArtPlace America
and to accept said grant funding in an amount up to Five Hundred Thousand Dollars and Zero Cents

($500,000.00). Said funds, if awarded, shall be appropriated to fund a capital art project to be determined
through a community committee.
Councilor Wissel moved to advance Ordinance No. 51 -2014 to second reading, suspend the rules and
read by title only, supported by Councilor Winget. Upon a vote viva voce, the motion passed.

Council President Miller declared Ordinance No. 51 -2014 on second reading and public hearing. There
being no comments for or against this Ordinance, Councilor Parker moved for engrossment of Ordinance

This Ordinance would authorize the appropriation of funds as follows:

Delete $10,000.00 from Training (205.11.107.150.000.3911)
Add $10,000.00 to EMS Supplies (205.101.107.150.000.2411)
Councilor Wissel moved to advance Ordinance No. 53 -2014 to second reading and public hearing and
read by title only, supported by Councilor Winget. The motion was defeated with an 8 -1 vote viva voce.
Dissenting was Councilor Hollis.

ORDINANCE NO. 54 -2014 — ORDINANCE AUTHORIZING THE CITY OF RICHMOND, INDIANA TO
ISSUE ITS "ECONOMIC DEVELOPMENT REVENUE BONDS, SERIES 2014 (JOHNS MANVILLE
PROJECT)" AND APPROVING OTHER ACTIONS IN RESPECT THERETO
The Clerk read Ordinance No. 54 -2014 on first reading by title only.
Ordinance No. 54 -2014 was held for due diligence.
ORDINANCES ON SECOND READING
ORDINANCE NO. 40 -2014 — AN APPROPRIATION ORDINANCE TO BE KNOWN AS THE 2015
SALARY ORDINANCE
The Clerk read Ordinance No. 40 -2014 on second reading by title only.
Mr. Oler moved to amend to read as follows:
Police Department
Major (2) Bi Weekly $2,302.76 Annual $59,871.44
This motion was supported by Councilor Wissel. Upon a vote viva voce, the motion carried.
Council President Miller declared Amended Ordinance No. 40 -2014 on second reading and public
hearing. There being no comments for or against this Ordinance, Councilor Parker moved for
engrossment of Amended Ordinance No. 40 -2014, supported by Councilor Hollis. Upon a vote viva voce,
the motion passed.
Councilor Parker moved to advance Amended Ordinance No. 40 -2014 to third and final reading and
suspend the rules and read by title only, supported by Councilor Winget. Upon a vote viva voce, the
motion passed.

ORDINANCE NO. 41 -2014 — AN APPROPRIATION ORDINANCE AUTHORIZING PAYMENT FOR
SERVICES FROM THE RICHMOND SANITARY DISTRICT, ROSEVIEW TRANSIT, RICHMOND
POWER & LIGHT, MOTOR VEHICLE HIGHWAY AND PARK AND RECREATION DEPARTMENT
FUNDS TO THE GENERAL FUND IN 2015
The Clerk read Ordinance No. 41 -2014 on second reading by title only.
Council President Miller declared Ordinance No. 41 -2014 on second reading and public hearing. There
being no comments for or against this Ordinance, Councilor Cruse - Nicholson moved for engrossment of
Ordinance No. 41 -2014, supported by Councilor Quinn. Upon a vote viva voce, the motion passed.
Councilor Wissel moved to advance Ordinance No. 41 -2014 to third and final reading and suspend the
rules and read by title only, supported by Councilor Winget. Upon a vote viva voce, the motion passed.

ORDINANCE NO. 42 -2014 – AN APPROPRIATION ORDINANCE TO BE KNOWN AS THE 2015
BUDGET
The Clerk read Ordinance No. 42 -2014 on second reading by title only.
Councilor Quinn moved to decrease the budget in the amount of Seven Hundred Eighty Thousand Four
Hundred Ninety Nine Dollars ($780,499) as recommended by Ms. Hill and to eliminate funds for the
Health Clinic, supported by Mr. Parker. The motion carried with a 6-3 roll call vote. Dissenting were
Councilors Goss, Hollis and Miller.
Councilor President Miller declared Amended Ordinance No. 41 -2014 on second reading and public
hearing. Speaking to the Ordinance were Messrs. Wilson and Bums. Councilor Wissel moved for
engrossment of Amended Ordinance No. 42 -2014, supported by Councilor Quinn.
Councilor Wissel moved to advance Amended Ordinance No. 42 -2014 to third and final reading and
suspend the rules and read by title only, supported by Councilor Winget. Upon a vote viva voce, the
motion carried.
The Clerk read Amended Ordinance No. 42 -2014 on third reading by title only.
Amended Ordinance No. 42 -2014 was adopted with a 6 -3 roll call vote. Dissenting were Councilors
Hollis, Quinn and Miller.
ORDINANCE NO. 46 -2014 – A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A
STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C.
