PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR GOSS President Miller called the meeting to order and the following business was conducted: ROLL CALL Present were: Doug Goss, Kelley Cruse- Nicholson, Clayton Miller, Don Winget, Larry Parker, Misty Hollis, Ron Oler and Phil Quinn. Absent was Bruce Wissel. Also in attendance were Walt Chidester, City Attorney; Sally Hutton, Mayor; Karen Chasteen, City Clerk; Larry Habschmidt; Dave Snow; Diana Pappin; Police Chief Kris and Linda Wolski; Fire Chief Jerry Purcell; Sue Roberson, Human Resources; Bill Thistlethwaite, Park Department; Tracy Bosell, Street Department, Media; and, Sergeant at Arms. APPROVAL OF MINUTES Councilor Winget moved to approve the minutes of the meeting held October 20, 2014, supported by Councilor Goss. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS • RESOLUTION NO. 7-2014 —A RESOLUTION APPOINTING CITY'S APPOINTMENT TO FACT FINDING PANEL (AFSCME 1791) Councilor Winget moved to approve Gary Hackman and Porter Miller as recommended, supported by Councilor Cruse- Nicholson. Upon a vote viva voce, the motion carried. COMMUNICATION FROM THE MAYOR None REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the October 23, 2014, meeting were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and/or ORGANIZATIONS • BOARD OF ZONING APPEALS Councilor Oler moved to appoint Jeff Cook to the BZA Board, supported by Councilor Hollis. Upon a vote viva voce, the motion carried. Common Coundi Minutes November 3, 2014 Page 2 of 5 MISCELLANEOUS BUSINESS • ORDINANCE NO. 34-2014 — AN APPROPRIATION ORDINANCE AMENDING ORDINANCE NO. 53 -2013 KNOWN AS THE 2014 SALARY ORDINANCE (Metropolitan Development) Councilor Oler moved to strike Ordinance No. 34 -2014, supported by Councilor Winget. Upon a vote viva voce, the motion carried. • ORDINANCE NO. 45-2014 — A SPECIAL ORDINANCE VACATING A PUBLIC WAY (Street — North 11th & "J ") Councilor Oler moved to strike Ordinance No. 45 -2014, supported by Councilor Winget. Upon a vote viva voce, the motion carried. ORDINANCES ON FIRST READING None ORDINANCES ON SECOND READING ORDINANCE NO. 46 -2014 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Ahaus) The Clerk read Ordinance No. 46 -2014 on second reading by title only. This Ordinance is a petition of Ahaus Tool for a ten year tax abatement on equipment valued at Three Hundred Fifty Thousand Dollars and zero cents ($350,000.00).The Tax Abatement Committee recommended approval. Council President Miller declared Ordinance No. 46 -2014 on second reading and public hearing. There being no comments for or against this Ordinance, Councilor Parker for engrossment of Ordinance No. 46- 2014, supported by Councilor Quinn. Upon a vote viva voce, the motion passed. Councilor Parker moved to advance Ordinance No. 46 -2014 to third and final reading and suspend the rules and read by title only, supported by Councilor Winget. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 46 -2014 on third reading by title only. Ordinance No. 46 -2014 was adopted with an 8 -0 roll call vote. ORDINANCE NO. 47 -2014 - AN APPROPRIATION ORDINANCE AUTHORIZING ADDITIONAL APPROPRIATIONS FROM CERTAIN FUNDS (First Response) The Clerk read Ordinance No. 47 -2014 on second reading by title only. This Ordinance would authorize the appropriation of funds as follows: From First Response Fund (205.11.107.000.777.5139) $205,997.98 To 205.11.107.150.000.1302 $192,265.96 To 205.11.107.150.000.4490 $ 13,732.02 Council President Miller declared Ordinance No. 47 -2014 on second reading and public hearing. There being no comments for or against this Ordinance, Councilor Cruse - Nicholson moved for engrossment of Ordinance No. 47 -2014, supported by Councilor Goss. Upon a vote viva voce, the motion passed. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 47 -2014 on third reading by title only. This motion was defeated with a 7 -1 roll call vote. Dissenting was Councilor Miller. Ordinance No. 47 -2014 will be heard on third reading on November 17, 2014. ORDINANCE NO. 49 -2014 — AN APPROPRIATION ORDINANCE AMENDING THE 2014 BUDGET (Human Resources) The Clerk read Ordinance No. 49 -2014 on second reading by title only. This Ordinance would authorize the transfer of funds in the 2014 Human Resources Budget as follows: Delete $1,500.00 from Unemployment Compensation (101.01.003.110.000.1221) Add $1,000.00 to Travel (101.01.003.110.000.3240) $ 400.00 to Training and Education (101.01.003.110.000.3911) $ 100.00 to Office Supplies (101.01.003.110.000.2130) Council President Miller declared Ordinance No. 49 -2014 on second reading and public hearing. There being no comments for or against this Ordinance, Councilor Cruse - Nicholson moved for engrossment of Ordinance No. 49 -2014, supported by Councilor Winget. Upon a vote viva voce, the motion passed. Councilor Cruse- Nicholson moved to advance Ordinance No. 49 -2014 to third and final reading and suspend the rules and read by title only, supported by Councilor Parker. Upon a vote viva voce, the motion passed. Ordinance No. 49 -2014 was defeated with a 6 -2 roll call vote. Dissenting were Councilors Hollis and Miller. Ordinance No. 49 -2014 will be heard on third reading on November 17, 2014. ORDINANCE NO. 50 -2014 - AN APPROPRIATION ORDINANCE AMENDING THE 2014 BUDGET (Street) The Clerk read Ordinance No. 50 -2014 on second reading by title only. This Ordinance would authorize the transfer of funds in the 2014 Local Road and Street Fund as follows: Delete $25,000.00 from Other Contractual Services (218.18.180.180.000.3990) Add $25,000.00 to Fleet Gasoline & Maintenance (218.18.180.180.000.2211) Delete $120,000 from Hot/Cold Mix (210.18.180.180.000.2363) Add $120,000 to Other Equipment (210.18.180.180.000.4490) Council President Miller declared Ordinance No. 50 -2014 on second reading and public hearing. There being no comments for or against this Ordinance, Councilor Cruse - Nicholson moved for engrossment of Ordinance No. 50 -2014, supported by Councilor Goss. Upon a vote viva voce, the motion passed. ORDINANCE NO. 52 -2014 — AN APPROPRIATION ORDINANCE AMENDING THE 2014 BUDGET (EMS) The Clerk read Ordinance No. 52 -2014 on second reading by title only. This Ordinance would transfer funds as follows: First Response Fund (205) Delete $77,594.89 from Overtime (EMS) (205.11.107.150.000.1302) Add $74,288.73 to Overtime (General) (10 1. 11. 110. 150.000.1302) $ 3,306.16 to Part Time Help (General) (101. 11. 110. 150.000.1198) Delete $54,232.36 from Deputy Chief of EMS (205.11.104.150.000.1101) Add $54,232.36 to Salaries and Wages- Training Chief (General) (101. 11. 110. 150-000.1101 Council President Miller declared Ordinance No. 52 -2014 on second reading and public hearing. There being no comments for or against this Ordinance, Councilor Cruse- Nicholson moved for engrossment of Ordinance No. 52 -2014, supported by Councilor Parker. Upon a vote viva voce, the motion passed. Councilor Cruse - Nicholson moved to advance Ordinance No. 52 -2014 to third and final reading and suspend the rules and read by title only, supported by Councilor Winget. Upon a vote viva voce, the motion passed. Ordinance No. 52 -2014 was defeated with a 7 -1 roll call vote. Dissenting were Councilor Hollis. Ordinance No. 52 -2014 will be heard on third reading on November 17, 2014. ORDINANCE NO. 53-2014 — AN APPROPRIATION ORDINANCE AMENDING THE 2014 BUDGET (First Response) The Clerk read Ordinance No. 53 -2014 on second reading by title only. This Ordinance would authorize the transfer of funds as follows: First Response Fund (205) Delete $10,000.00 from Training (205.11.107.150.000.3911) Add $10,000.00 to EMS Supplies (205.101.107.150.000.2411) Council President Miller declared Ordinance No. 53 -2014 on second reading and public hearing. There being no comments for or against this Ordinance, Councilor Cruse - Nicholson moved for engrossment of Ordinance No. 53 -2014, supported by Councilor Quinn. Upon a vote viva voce, the motion passed. Councilor Winget moved to advance Ordinance No. 53 -2014 to third and final reading and suspend the rules and read by title only, supported by Councilor Winget.
