PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR WISSEL President Miller called the meeting to order and the following business was conducted: ROLL CALL Present were: Doug Goss, Kelley Cruse- Nicholson, Bruce Wissel, Clayton Miller, Don Winget, Larry Parker, Misty Hollis, Ron Oler and Phil Quinn. Also in attendance were Walt Chidester, City Attorney; Sally Hutton, Mayor; Karen Chasteen, City Clerk; Tracy Bosell, Street Superintendent; Tony Foster, Metropolitan Development; Fire Chief Jerry Purcell; Police Chief Kris and Linda Wolski; Diana Pappin; Police Lt. Donnie Benedict; Nick Wilson; Pete Zaleski, Wayne County Councilor; Sergeant at Arms; and, Media. APPROVAL OF MINUTES Councilor Wissel moved to approve the minutes of the meeting held November 17, 2014, supported by Councilor Parker. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS None COMMUNICATION FROM THE MAYOR • On behalf of the Department of Metropolitan Development, an income survey will be mailed to residents. This is a requirement of any Community Development Block Grant. All information will be held in strict confidence. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the November 13 & 20, 2014, meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and/or ORGANIZATIONS None MISCELLANEOUS BUSINESS • Nepotism Disclosure Statements were given to Council Members and the Mayor for their signature. This is an annual compliance document. r Common Council Minutes December 1, 2014 Page 2 of 4 • Councilor Cruse - Nicholson reported there are 435 families in Richmond are homeless. All donations can be made through Councilor Cruse - Nicholson — 765 -465 -5432. ORDINANCES ON FIRST READING Councilor Parker moved to suspend the rules and read Ordinance Nos. 58, 59. 60 & 61 -2014 on first reading by title only, supported by Councilor Winget. Upon a vote viva voce, the motion passed. ORDINANCE NO. 58 -2014 - AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE AND APPROPRIATION OF A GRANT FROM BLOOMBERG PHILANTHROPIES (Metro — Capital Art Project) The Clerk read Ordinance No. 58 -2014 on first reading by title only. This Ordinance would authorize the City of Richmond to submit a grant application to Bloomberg Philanthropies, and to accept said grant funding in an amount up to One Million Dollars and Zero Cents ($1,000,000.00). If awarded, said funds shall be appropriated to fund a capital art project to be determined through a community committee. Councilor Wissel moved to advance Ordinance No. 58 -2014 to second reading, suspend the rules and read by title only, supported by Councilor Hollis. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 58 -2014 on second reading by title only. Council President Miller declared Ordinance No. 58 -2014 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Parker moved for engrossment of Ordinance No. 58 -2014, supported by Councilor Quinn. Upon a vote viva voce, the motion passed. Councilor Wissel moved to advance Ordinance No. 58 -2014 to third and final reading and suspend the rules and read by title only, supported by Councilor Winget. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 58 -2014 on third reading by title only. Ordinance No. 58 -2014 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 59 -2014 — AN APPROPRIATION (TRANSFER) ORDINANCE AMENDING THE 2014 BUDGET (Local Road and Street) The Clerk read Ordinance No. 59 -2014 on first reading by title only. This Ordinance would authorize the transfer of funds within the 2014 budget of the Local Road and Street Fund as follows: Delete $15,000.00 from Traffic Signs (210.18.180.000.4320) Add $15,000.00 to Repair Equipment (210.18.180.180.000.3620) These funds would be used for repair of a dump truck. Councilor Wissel moved to advance Ordinance No. 59 -2014 to second reading, suspend the rules and read by title only, supported by Councilor Hollis. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 59 -2014 on second reading by title only. Council President Miller declared Ordinance No. 59 -2014 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Parker moved for engrossment of Ordinance No. 59 -2014, supported by Councilor Quinn. Upon a vote viva voce, the motion passed. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 59 -2014 on third reading by title only. Ordinance No. 59 -2014 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 60 -2014 — A GENERAL ORDINANCE REPEALING CHAPTER 78 (MOPEDS AND POCKET BIKES) OF THE RICHMOND CITY CODE The Clerk read Ordinance No. 60 -2014 on first reading by title only. The Governor of Indiana signed House Enrolled Act No. 1343 which will become effective January 1, 2015. This Act pre -empts local jurisdiction and regulation of scooters and mopeds. This Ordinance would repeal City Code Chapter 78 (Mopeds and Pocket Bikes) and Ordinance Number 8 -2010 effective December 31, 2014. Councilor Wissel moved to advance Ordinance No. 60 -2014 to second reading, suspend the rules and read by title only, supported by Councilor Winget. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 60 -2014 on second reading by tide only. Council President Miller declared Ordinance No. 60 -2014 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Parker moved for engrossment of Ordinance No. 60 -2014, supported by Councilor Quinn. Upon a vote viva voce, the motion passed. Councilor Wissel moved to advance Ordinance No. 60 -2014 to third and final reading and suspend the rules and read by title only, supported by Councilor Winget. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 60 -2014 on third reading by title only. Ordinance No. 60 -2014 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 61 -2014 — A GENERAL ORDINANCE AMENDING SUBSECTION 74.29 OF THE RICHMOND CITY CODE (Handicap Parking) The Clerk read Ordinance No. 61 -2014 on first reading by title only. This Ordinance would amend City Code Section 74.29 relative to Handicap Parking. This amendment would allow the Traffic Division to utilize a "designated tag" system to identify citizens who have residential handicap spots reserved. Councilor Parker moved to advance Ordinance No. 61 -2014 to second reading, suspend the rules and read by title only, supported by Councilor Oler. Upon a vote viva voce, the motion passed. Ordinance No. 61 -2014 will be heard on second reading on December 15, 2014. ORDINANCES ON SECOND READING ORDINANCE NO. 57 -2014 — AN APPROPRIATION ORDINANCE AUTHORIZING ADDITIONAL APPROPRIATIONS FROM CERTAIN FUNDS (Cum Cap) The Clerk read Ordinance No. 57 -2014 on second reading by title only. e Common Council Minutes December 1, 2014 Page 4 of 4 This Ordinance would authorize an appropriation of Twenty Thousand Dollars ($20,000.00) from the Cumulative Capital Improvement Fund (212) to Other Contractual Services (212.02.024.311.000.3990). Council President Miller declared Ordinance No. 57 -2014 on second reading and public hearing. Speaking against this Ordinance was Nick Wilson. There being no comments for the Ordinance, Councilor Parker moved for engrossment of Ordinance No. 57 -2014, supported by Councilor Cruse - Nicholson. Upon a vote viva voce, the motion passed. Councilor Wissel moved to advance Ordinance No. 57 -2014 to third and final reading and suspend the rules and read by title only, supported by Councilor Winget. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 57 -2014 on third reading by title only. Ordinance No. 57 -2014 was adopted with a 7 -2 roll call vote. Dissenting were Councilors Hollis and Miller.
