PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR HOLLIS President Parker called the meeting to order and the following business was conducted: ROLL CALL Present were: Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clayton Miller, Don Winget, Larry Parker, Misty Hollis, Ron Oler and Phil Quinn. Also in attendance were Walt Chidester, City Attorney; Sally Hutton, Mayor; Karen Chasteen, City Clerk; Bill Thistlethwaite & Blair Beach, Park Department; Nick Wilson; Russell Mayberry; Darren Duncan; Tammy Glenn, City Controller; Bill Harris, Sanitary District; Paige Sonsone, Umbaugh; Jeff Plasterer, Gary Saunders & Peter Zaleski, Wayne County Council; Denny Burns, Wayne County Commissioner; Mike Crawley, Fire Department; Linda and Chief Kris Wolski, Major Mark Connery, Police Department; Susan Isaacs, Wayne County Trustee; Terry Smith & Martha Dwyer, Wayne Township Board; Adolph Werner, Norma Wright & Merlin Clark, Spring Grove Town Board; Media and Sergeant-at-Arms. APPROVAL OF MINUTES Mr. Wissel moved to approve the minutes of the meeting held January 22, 2012, supported by Mr. Winget. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS None COMMUNICATION FROM THE MAYOR • 300 were in attendance at the Boost Luncheon — a really good beginning for initiating Positive Place projects. • So far no weather related accidents. Keep up the good driving. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the January 17 & 24, 2013, meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and /or ORGANIZATIONS • POLICE MERIT COMMISSION APPOINTMENTS — Max Duke and Eric Marsh have indicated their desire to serve another term. Council will vote on the Police Department recommendation February 19. Common Council Minutes February 4, 2013 Page 2 01`4 MISCELLANEOUS BUSINESS None ORDINANCES ON FIRST READING Mr. Elstro moved to suspend the rules and read Ordinance Nos. 5, 6 & 9 -2013 on first reading by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. ORDINANCE NO. 5 -2013 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE AND APPROPRIAION OF A GRANT FROM THE FIRE PREVENTION AND SAFETY GRANT PROGRAM The Clerk read Ordinance No. 5 -2013 on first reading by title only. This Ordinance would authorize the City of Richmond to submit a grant application to the federal Fire Prevention & Safety Grant Program and to accept said grant funding in an amount up to Five Thousand Seven Hundred Fifteen Dollars and Zero Cents ($5,715.00). The local match of Six Hundred Thirty-five Dollars ($635.00) will be supplied by the Richmond Fire Department budget. Said grant funding shall be used to procure smoke detectors, educational materials, and iPads. Mr. Miller moved to advance Ordinance No. 5 -2013 to second reading, suspend the rules and read by title only, supported by Mr. Quinn. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 5 -2013 on second reading by title only. Council President Parker declared Ordinance No. 5 -2013 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Elstro moved for engrossment of Ordinance No. 5- 2013, supported by Mr. Wissel. Upon a vote viva voce, the motion passed. Mr. Wissel moved to advance Ordinance No. 5 -2013 to third and final reading and suspend the rules and read by title only, supported by Mr. Miller. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 5 -2013 on third reading by title only. Ordinance No. 5 -2013 was adopted with a 9-0 roll call vote. ORDINANCE NO. 6 -2013 — AN APPROPRIATION ORDINANCE AUTHORIZING THE CITY OF RICHMOND TO RECEIVE DONATIONS (Park Department) The Clerk read Ordinance No. 6 -2013 on first reading by title only. This Ordinance would authorize the City of Richmond Parks Department to receive donations during the calendar year 2013 for their programs and uses to be held in 2013 would be accepted and gratefully acknowledged by the citizens of Richmond. Mr. Wissel moved to advance Ordinance No. 6 -2013 to second reading, suspend the rules and read by title only, supported by Ms. Hollis. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 6 -2013 on second reading by title only. Council President Parker declared Ordinance No. 6 -2013 on second reading and public hearing. There being no comments for or against the Ordinance, Ms. Hollis moved for engrossment of Ordinance No. 6- 2013, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 6 -2013 on third reading by title only. Ordinance No. 6 -2013 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 9 -2013 - AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE AND APPROPRIATION OF A GRANT FROM THE INDIANA DEPARTMENT OF HOMELAND SECURITY (Fire Department) The Clerk read Ordinance No. 9 -2013 on first reading by title only. This Ordinance would authorize the City of Richmond to submit a grant application to the Indiana Department of Homeland Security for the 2011 State Homeland Security Grant Program and to accept said grant funding in an amount up to Six Thousand Two Hundred Fifty Dollars and Zero Cents ($6,250.00). Said grant funding would be used to procure Hazmat Equipment for the Richmond Fire Department. Mr. Miller moved to advance Ordinance No. 9 -2013 to second reading, suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 9 -2013 on second reading by title only. Council President Parker declared Ordinance No. 9 -2013 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Wissel moved for engrossment of Ordinance No. 9- 2013, supported by Ms. Cruse- Nicholson. Upon a vote viva voce, the motion passed. Mr. Wissel moved to advance Ordinance No. 9 -2013 to third and final reading and suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 9 -2013 on third reading by title only. Ordinance No. 9 -2013 was adopted with a 9-0 roll call vote. ORDINANCES ON SECOND READING ORDINANCE NO. 4 -2013 — AN ORDINANCE FOR THE ESTABLISHMENT OF A FIRE PROTECTION TERRITORY PURSUANT TO INDIANA CODE 36 -8 -19 The Clerk read Ordinance No. 4 -2013 on second reading by title only. This Ordinance would authorize the Common Council of the City of Richmond, Indiana, together with the Trustee and Board of Wayne Township, Wayne County, Indiana, and the Trustee and Board of Spring Grove, Inc., to join together under the provisions of I.C. 36 -8 -19 for the purpose of entering into an agreement to establish a fire protection territory. The area constituting the fire protection territory ( "Territory") would include the entire geographic areas of the City of Richmond, Indiana, Wayne Township in Wayne County, and the Town of Spring Grove, Inc. It would be stipulated and agreed that Wayne Township and the Town of Spring Grove, Inc. are contiguous to the City. The provider unit, which is the participating unit that is responsible for providing the fire protection administrative services, and to serve as the fiscal body within the territory, would be the City of Richmond. Merlin Clark, representing Ernie Hendricks, President of the Spring Grove Town Board, called the meeting of the Spring Grove Town Board to order. Also present were Adolph Werner and Norma Wright, members of the Board. Common Council Minutes February 4, 2013 Page 4 of 4 Martha Dwyer, President, called the meeting of the Wayne Township Board to order. Also present was Terry Smith, Board member; and Susan Isaacs, Wayne County Trustee. Council President Parker declared Ordinance No. 4 -2013 on second reading and public hearing. Speaking against this Ordinance were Messrs. Wilson and Plasterer. Members of the Wayne Township Board and the Spring Grove Town Board indicated they were not in favor and their respective Boards will be voting on this issue at their next meeting. In order for this Fire Protection Territory to be established as proposed, all three entities are required to approve their Ordinances and /or Resolutions. Mr. Miller moved to strike Ordinance No. 4 -2013, supported by Mr. Parker. Upon a vote viva voce, the motion passed. ORDINANCES ON THIRD READING None CALL FOR ADJOURNMENT There being no further business, on a motion duly made, seconded and passed, the meeting was adjourned.
