FEBRUARY 19, 2013
The Common Council of the City of Richmond, Indiana met in regular session February 19, 2013 in the
Council Chambers in said City.
PLEDGE OF ALLEGIANCE
PRAYER BY COUNCILOR OILER
President Pro Tern Miller called the meeting to order and the following business was conducted:
ROLL CALL
Present were: Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clayton Miller, Don Winget,
Misty Hollis, Ron Oler and Phil Quinn. Absent was Larry Parker.
Also in attendance were Walt Chidester, City Attorney; Sally Hutton, Mayor; Karen Chasteen, City Clerk;
Tony Foster, Department of Metropolitan Development; Terri Quinter, Roseview Transit; Jeff Norris and
Doug Philbeck, Information and Technology; Linda and Police Chief Kris Wolski.
APPROVAL OF MINUTES
Mr. Wissel moved to approve the minutes of the meeting held February 4, 2012, supported by Mr.
Winget. Upon a vote viva voce, the motion passed.
PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS,
MOTIONS, RESOLUTIONS
A. RESOLUTION NO. 1-2013 - A RESOLUTION APPROVING THE AMENDMENT OF THE
COMPREHENSIVE PLAN
Mr. Foster reviewed the changes to the Comprehensive Plan. The Plan is a work in progress and
needs to be updated occasionally. Mr. Wissel reported the Plan Commission and Staff
recommended approval. Mr. Quinn moved to adopt, supported by Mr. Oler. Upon a vote viva
voce, the motion passed.
B. RESOLUTION NO. 2-2013 -A RESOLUTION APPOINTING A NEW COMMISSIONER TO THE
INDIANA MUNICIPAL POWER AGENCY
This Resolution would appoint James French, General Manager of Richmond Power and Light, to
serve as an Indiana Municipal Power Agency Commissioner replacing Mr. Parker. Mr. Wissel
moved to approve, supported by Mr. Winget. Upon a vote viva voce, the motion passed.
COMMUNICATION FROM THE MAYOR
• Thank you to Mr. Wolski for working with the Information and Technology Department in getting
the citywide e-mail up and running. We are now being hosted by an outside server which is also
less expensive.
REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY
Minutes of the January 17 & 31 and February 7, 2013, meetings were accepted as presented.

• POLICE MERIT COMMISSION APPOINTMENTS: Ms. Hollis moved to reappoint Max Duke and
Eric Marsh to serve additional terms as recommended by Chief Wolski. This motion was
supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed.
• EMERGENCY MEDICAL SERVICES: This report will be heard at the March 4, 2013 meeting.

ORDINANCES ON FIRST READING
Mr. Elstro moved to suspend the rules and read Ordinance Nos. 7, 8, 10, 11 & 12 -2013 on first reading by
title only, supported by Ms. Cruse- Nicholson. Upon a vote viva voce, the motion passed.
ORDINANCE NO. 7 -2013 — AN APPROPRIATION ORDINANCE AUTHORIZING THE CITY OF
RICHMOND TO RECEIVE DONATIONS (Environmental Sustainability Commission)
The Clerk read Ordinance No. 7 -2013 on first reading by title only.
This Ordinance would authorize the Environmental Sustainability, Commission to receive donations for
programs and uses to be held in 2013.

Mr. Wissel moved to advance Ordinance No. 7 -2013 to second reading, suspend the rules and read by
title only, supported by Mr. Quinn. Upon a vote viva voce, the motion passed.

Council Vice President Miller declared Ordinance No. 7 -2013 on second reading and public hearing.
There being no comments for or against the Ordinance, Ms. Cruse - Nicholson moved for engrossment of
Ordinance No. 7 -2013, supported by Mr. Elstro. Upon a vote viva voce, the motion passed.
Mr. Wissel moved to advance Ordinance No. 7 -2013 to third and final reading and suspend the rules and
read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed.

Ordinance No. 7 -2013 was adopted with an 8-0 roll call vote.
ORDINANCE NO. 8 -2013 — AN APPROPRIATION ORDINANCE AUTHORIZING THE CITY OF

This Ordinance would authorize the Historic Preservation Commission to receive donations for programs
and uses to be held in 2013.

ORDINANCE NO. 10 -2013 - AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL,
ACCEPTANCE AND APPROPRIATION OF A GRANT FROM THE AREA 9 AGENCY (Roseview)
The Clerk read Ordinance No. 10 -2013 on first reading by title only.
This Ordinance would authorize the City of Richmond, to submit a grant application to the Area 9 Agency
for the Title III Grant Program and to accept grant funding in an amount up to Eighty Thousand Eight
Hundred Eight Dollars and Zero Cents ($80,808.00). Matching funds from Rose View Transit
(Paratransit) Rider donations and funds from the Rose View budget, in the amount of Fourteen Thousand
Nine Hundred Dollars and Eighty -two Cents ($14,900.82) shall be appropriated to support the grant
application. All grant funding, if awarded to the City of Richmond, shall be appropriated to help fund the
Rose View Transit transportation services from fiscal year 2013 to 2015.
Ms. Hollis moved to advance Ordinance No. 10 -2013 to second reading, suspend the rules and read by
title only, supported by Ms. Cruse- Nicholson. Upon a vote viva voce, the motion passed.

ORDINANCE NO. 11 -2013 — A SPECIAL ORDINANCE VACATING A UTILITY EASEMENT (3767 E
Main)
The Clerk read Ordinance No. 11 -2013 on first reading by title only.
This Ordinance is a petition to vacate a utility easement at 3767 East Main Street_ The property is being
sold and the vacation is necessary for title purposes.
Ordinance No. 11 -2013 was referred to the Advisory Plan commission for its February 28, 2013 public
hearing.

ORDINANCE NO. 12 -2013 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A
STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C.
6 -1.1 -12.1 W.M. Hutton)
The Clerk read Ordinance No. 12 -2013 on first reading by title only.
This Ordinance is a request of J.M. Hutton & Co., Inc. for a ten -year tax abatement on equipment valued
at Two Hundred Twenty Thousand Seven Hundred Sixty Four Dollars and fifty cents ($220,764.50).
Ordinance o. 12 -2013 was referred to the Tax Abatement Committee for due diligence.
