PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR WINGET President Parker called the meeting to order and the following business was conducted: ROLL CALL Present were: Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clayton Miller, Don Winget, Larry Parker, Misty Hollis, Ron Oler and Phil Quinn. Also in attendance were Walt Chidester, City Attorney; Sally Hutton, Mayor; Karen Chasteen, City Clerk; Tony Foster, Department of Metropolitan Development; Emergency Medical Service Chief Tim Parrott; William Harris, Sanitary District; Tammy Glenn, Controller, Linda and Kris Wolski; Sharon Brandley, Human Rights Commission and Jeff Cook, Reid Hospital. APPROVAL OF MINUTES Ms. Hollis moved to approve the minutes of the meeting held April 15, 2013, supported by Mr. Miller. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS None COMMUNICATION FROM THE MAYOR • Work is progressing on the application for the Stellar Community Designation • Roads and Streets will be the beneficiary of additional funds this year. Dollars historically used by law enforcement are being redirected. • Spring Clean up is going well and will continue for the next couple of weeks • A venting system is being installed to eliminate Radon in the Police Department REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the April 11, 18 & 25, 2013, meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and/or ORGANIZATIONS None Common Council Minutes May 6, 2013 Page 2 of 4 MISCELLANEOUS BUSINESS Mr. Miller reported on the dedication of a tree on Highland Golf Course in honor of Bing Welch. Messrs. Miller and Winget represented Council at the ceremony. ORDINANCES ON FIRST READING Mr. Elstro moved to suspend the rules and read Ordinance Nos. 23, 24, 25, 26, 28 & 29, 2013 on first reading by title only, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. ORDINANCE NO. 23-2013 - AN APPROPRIATION ORDINANCE AUTHORIZING ADDITIONAL APPROPRIATIONS FROM CERTAIN FUNDS (Sanitary District) The Clerk read Ordinance No. 23 -2013 on first reading by title only. This Ordinance is a request of the Sanitary District for an additional Six Hundred Twenty Five Thousand Dollars and zero cents ($625,000.00) to be appropriated to Solid Waste for the purchase of three fully automated residential trash trucks and two commercial side loader trucks.. Mr. Wissel moved to advance Ordinance No. 23 -2013 to second reading, suspend the rules and read by title only, supported by Ms. Hollis. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 23 -2013 on second reading by title only. Council President Parker declared Ordinance No. 23 -2013 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Elstro moved for engrossment of Ordinance No. 23- 2013, supported by Ms. Cruse- Nicholson. Upon a vote viva voce, the motion passed. Mr. Wissel moved to advance Ordinance No. 23 -2013 to third and final reading and suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 23 -2013 on third reading by title only. Ordinance No. 23 -2013 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 24-2013 — A SPECIAL ORDINANCE VACATING A UTILITY EASEMENT (Hunters Pointe) The Clerk read Ordinance No. 24 -2013 on first reading by title only. This Ordinance is a petition requesting a portion of a platted, but unused, utility easement at 0 Eagle Trace and 3502 Eagle Trace. Ordinance No. 24 -2013 was referred to the Plan Commission for public hearing at its May 23, 2013 meeting. ORDINANCE NO. 25-2013 - AN APPROPRIATION ORDINANCE AUTHORIZING ADDITIONAL APPROPRIATIONS FROM CERTAIN FUNDS (First Response) The Clerk read Ordinance No. 25 -2013 on first reading by title only. This Ordinance is a request for an additional appropriation of One Hundred Eighty Four Thousand Four Hundred Six Dollars and zero cents ($184,406.00) to First Response. ORDINANCE NO. 26 -2013 - AN APPROPRIATION ORDINANCE AMENDING THE 2013 BUDGET (Street Dept.) The Clerk read Ordinance No. 26 -2013 on first reading by title only. This Ordinance is a request of the Street Department to transfer funds as follows: Motor Vehicle Highway: Delete $62,000.00 from Salt Add $62,000.00 to Other Equipment Local Road and Street: Delete $100,000.00 from Hot/Cold Mix Add $100,000.00 to Other Equipment Mr. Quinn moved to delete "not have enough votes to" from the second Whereas, supported by Ms. Hollis. Upon a vote viva voce, the motion passed. Mr. Wissel moved to advance Ordinance No. 26 -2013 as amended to second reading, suspend the rules and read by title only, supported by Ms. Hollis. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 26 -2013 as amended on second reading by title only. Council President Parker declared Ordinance No. 26 -2013 as amended on second reading and public hearing. There being no comments for or against the Ordinance, Ms. Hollis moved for engrossment of Ordinance No. 26 -2013 as amended, supported by Mr. Miller. Upon a vote viva voce, the motion passed. Mr. Wissel moved to advance Ordinance No. 26 -2013 as amended to third and final reading and suspend the rules and read by title only, supported by Mr. Winget. ORDINANCE NO. 28 -2013 — A GENERAL ORDINANCE AMENDING SECTION 96.10 AND ADDING SECTION 96.99 OF THE CITY OF RICHMOND CODE (re excavation work in right -of -way areas) The Clerk read Ordinance No. 28 -2013 on first reading by title only. Ordinance No. 28 -2013 was held on first reading. ORDINANCE NO. 29- 2013 -AN APPROPRIATION ORDINANCE OF THE CITY OF RICHMOND, INDIANA AS APPLICANT, AUTHORIZING THE SUBMITTAL OF THE COMMUNITY DEVELOPMENT BLOCK GRANT ( "CDBG -) APPLICATION TO THE INDIANA HOUSING AND COMMUNITY DEVELOPMENT AUTHORITY, RECEIPT OF CDBG FUNDS; AND ADDRESSING RELATED MATTERS The Clerk read Ordinance No. 29 -2013 on first reading by title only. This Ordinance would authorize the submittal for and acceptance of Community Development Block Grant award from the Indiana Housing and Community Development Authority in an amount up to Three hundred Seventy-Two Thousand Dollars and Zero Cents ($372,000.00). The ten percent required match has already been banked with the Indiana Housing and Community Development Authority. Mr. Foster stated these funds will be used for home rehabilitation in the Vaile Neighborhood. ORDINANCES ON SECOND READING ORDINANCE NO. 22 -2013 - AN ORDINANCE AUTHORIZING A MAJOR AMENDMENT TO REID HOSPITAL PLANNED UNIT DEVELOPMENT AND AMENDING ORDINANCE NO. 11 -2004 The Clerk read Ordinance No. 22 -2013 on second reading by title only. This Ordinance is a request of Reid Hospital to amend Ordinance 11 -2004 which established the final development plan for the hospital's planned unit development. This petition was heard on public hearing at the April 25, 2013 Advisory Plan Commission. The Planning Staff recommended approval of the Ordinance with the condition that lighting and landscaping will be consistent with what already exists for the site. The Plan Commission voted unanimously to recommend approval with the suggested conditions. Council President Parker declared Ordinance No. 22 -2013 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Miller moved for engrossment of Ordinance No. 29- 2013, supported by Mr. Winget. Upon a vote viva voce, the motion passed. Ms. Hollis moved to advance Ordinance No. 22 -2013 to third and final reading and suspend the rules and read by title only, supported by Mr. Miller. Upon a vote viva voce, the motion passed.
