PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR PARKER President Parker called the meeting to order and the following business was conducted: ROLL CALL Present were: Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clayton Miller, Don Winget, Larry Parker, Misty Hollis, Ron Oler and Phil Quinn. Also in attendance were Walt Chidester, City Attorney; Sally Hutton, Mayor; Karen Chasteen, City Clerk; Ardene Schaeffer; Michelle, Gray and Kyra Walker; Lynn Johnstone, Jill Nelson, Joe Schroeder, Historic Preservation Commission; Matt Stegall; Donna Geddes; John Cahill; Mike Allen, Economic Growth Group; Dave Snow; Dave Bums; Police Chief Kris Wolski; Assistant City Attorney Kim Vessels; Director of Public Works, Greg Steins; Park Superintendent Bill Thistlethwaite; and, Building Commissioner Bruce Oesterling. APPROVAL OF MINUTES Ms. Hollis moved to approve the minutes of the meeting held May 6, 2013, supported by Mr. Winget. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS None COMMUNICATION FROM THE MAYOR • The judges for the Stellar Community Designation application were amazed at our presentation. The results will be announced in mid June. • Grass has grown so quickly due to the warm, moist weather, people are having a difficult time keeping up with mowing. Any help to the City or neighbors is appreciated. • There have been several issues with dogs biting children and mailmen. We are cracking down. Incidentally, this National Dog Bite Prevention Week. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the May 2 & 9, 2013, meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and/or ORGANIZATIONS None Common Council Minutes June 3, 2013 Page 2 of 4 MISCELLANEOUS BUSINESS None ORDINANCES ON FIRST READING Mr. Elstro moved to suspend the rules and read Ordinance Nos. 27, 28, 30, 31 & 32 -2013 on first reading by title only, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. ORDINANCE NO. 27-2013 — A GENERAL ORDINANCE AMENDING CHAPTER 58 OF THE CITY OF RICHMOND CODE - Landfill fees The Clerk read Ordinance No. 27 -2013 on first reading by title only. This Ordinance would dispense with the need of the City to pay itself on construction /demolition waste that goes to the landfill for City projects or projects on behalf of the City that directly benefit the City. Mr. Miller moved to advance Ordinance No. 27 -2013 to second reading, suspend the rules and read by title only, supported by Ms. Hollis. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 27 -2013 on second reading by title only. Council President Parker declared Ordinance No. 27 -2013 on second reading and public hearing. Speaking in favor were Messrs. Allen and Bums. A letter in favor from Pete Bartel was read for the record. There being no comments against the Ordinance, Mr. Quinn moved for engrossment of Ordinance No. 27 -2013, supported by Mr. Winget. Upon a vote viva voce, the motion passed. Mr. Wissel moved to advance Ordinance No. 27 -2013 to third and final reading and suspend the rules and read by title only, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 27 -2013 on third reading by title only. Ordinance No. 27 -2013 was adopted with a 9-0 roll call vote. ORDINANCE NO. 28-2013 —A GENERAL ORDINANCE AMENDING SECTION 96.10 AND ADDING SECTION 96.99 OF THE CITY OF RICHMOND CODE - excavation of public rights -of -way The Clerk read Ordinance No. 28 -2013 on first reading by title only. This Ordinance would update all sub - sections of Section 96.10 to reflect and clarify the current application practices currently in place in the City of Richmond Department of Public Works and Engineering and omit any outdated language, practices and procedures in connection with the excavation of right -of -way areas process. Mr. Miller moved to advance Ordinance No. 28 -2013 to second reading, suspend the rules and read by title only, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 28 -2013 on second reading by title only. Council President Parker declared Ordinance No. 28 -2013 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Miller moved for engrossment of Ordinance No. 28- 2013, supported by Mr. Winget. Upon a vote viva voce, the motion passed. Mr. Wissel moved to advance Ordinance No. 28 -2013 to thins and final reading and suspend the rules and read by title only, supported by Ms. Cruse - Nicholson. Ordinance No. 28 -2013 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 30 -2013 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6-1.1 -12.1— A Plus Realty The Clerk read Ordinance No. 30 -2013 on first reading by title only. This Ordinance is a petition of A -Plus Realty for a ten -year tax abatement on real estate valued at Seventy Five Thousand Dollars and no cents ($75,000.00.) Ordinance No. 30 -2013 was referred to the Tax Abatement Committee for due diligence. ORDINANCE NO. 31-2013 — A GENERAL ORDINANCE AMENDING CHAPER 95.11: ALCOHOLIC BEVERAGES ON CITY OF RICHMOND PARK PROPERTY The Clerk read Ordinance No. 31 -2013 on first reading by title only. This Ordinance would revise the Parks Department alcoholic beverage permit policy to allow individuals or entities to hire caterers to serve and sell beer and wine at special events that may held at the Rose Garden Reception Lawn. Mr. Miller moved to advance Ordinance No. 31 -2013 to second reading, suspend the rules and read by title only, supported by Ms. Cruse Nicholson. Upon a vote viva voce, the motion failed. Dissenting were Ms. Hollis and Mr. Oler. Ordinance No. 31 -2013 will be held on first reading until June 3, 2013 ORDINANCE NO. 32-2013 — A SPECIAL ORDINANCE IN CONNECTION WITH INTERIM PROTECTION OF THE PROPERTY LOCATED AT 1225 SOUTH A STREET The Clerk read Ordinance No. 32 -2013 on first reading by title only. This Ordinance is relative the property located at 1225 South "A" Street and has been affirmed by the Unsafe Building Commission to be an unsafe and blighted structure. A fire occurred on the property in 2005 and the property has remained uninhabited and in a state of disrepair since that time. Mr. Wissel moved to advance Ordinance No. 32 -2013 to second reading, suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 32 -2013 on second reading by title only. Council President Parker declared Ordinance No. 32 -2013 on second reading and public hearing. Speaking against the Ordinance were Ms. Nelson, Ms. Schoeffler, Ms. Geddes, Messrs. Schroeder and Stegall. There being no comments for the Ordinance, Mr. Quinn moved for engrossment of Ordinance No. 32 -2013, supported by Mr. Elstro. Upon a vote viva voce, the motion failed. Dissenting were Ms. Hollis and Ms. Cruse - Nicholson. Ordinance No. 32 -2013 will be heard on third reading June 3 -2013. ORDINANCES ON SECOND READING ORDINANCE NO. 25-2013 —AN APPROPRIATION ORDINANCE AUTHORIZING ADDITIONAL APPROPRIATIONS FROM CERTAIN FUNDS - EMS —First Response Common Council Minutes June 3, 2013 Page 4 of 4 Mr. Wissel moved to hold Ordinance No. 25 -2013 until June 3, supported by Ms. Hollis. Upon a vote viva vote, the motion passed. This Ordinance will be discussed at the May 23, 2013 meeting of the Finance Committee. ORDINANCES ON THIRD READING None CALL FOR ADJOURNMENT There being no further business, on a motion duly made, seconded and passed, the meeting was adjourned.
