PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR WISSEL President Parker called the meeting to order and the following business was conducted: ROLL CALL Present were: Howard "Jack" Elstro, Kelley Cruse- Nicholson, Bruce Wissel, Clayton Miller, Don Winget, Larry Parker, Misty Hollis, Ron Oler and Phil Quinn. Also in attendance were Walt Chidester, City Attorney; Sally Hutton, Mayor; Karen Chasteen, City Clerk; Tim Brown, Battalion Chief, John Cahill; Scott Zimmerman, City Planner; Bruce Oesteding, Building Inspector; Tony Foster, Director of Metropolitan Development; Hayleigh Blevins; Elijah Welch, Sanitary District; Pete Bartel; Beth VanDerBurgt, Rose Garden Board of Directors; Media and Sergeant-at-Arms. APPROVAL OF MINUTES Mr. Miller moved to approve the minutes of the meeting held May 20, 2012, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS None COMMUNICATION FROM THE MAYOR • The Stellar Community decision is expected in mid June • The Park Department has been working diligently to mow tall grass — please be patient REPORT OF THE BOARD OF PUBLIC WORKS AND SAFETY Minutes of the May 16 and 23, 2013 meeting were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and/or ORGANIZATIONS • ELIJAH WELCH, SANITARY DISTRICT ENGINEER reviewed ongoing and upcoming projects • HUMAN RIGHTS COMMISSION — Ms. Cruse - Nicholson moved to reappoint Paul Mingus and Barbara Armstead, supported by Mr. Elstro. Upon a vote viva voce, the motion carried. Both terms will expire January 31, 2016. MISCELLANEOUS BUSINESS Common Council Minutes June 3, 2013 Page 2 of 4 None ORDINANCES ON FIRST READING Mr. Elstro moved to suspend the rules and read Ordinance Nos. 33 & 34 -2013 on first reading by title only, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion carried. ORDINANCE NO. 33 -2013 - AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM THE INDIANA DEPARTMENT OF HOMELAND SECURITY The Clerk read Ordinance No. 33 -3013 on first reading by title only. This Ordinance would authorize the City of Richmond to submit a grant application to the Indiana Department of Homeland Security for the 2010 State Homeland Security Grant Program, Chemical Biological Radiological Nuclear Explosives Project #2 and to accept grant funding in an amount up to Seven Thousand One Hundred Forty-two Dollars and Eighty-six Cents ($7,142.86). These funds would be used to procure two (2) grounding cables, a combustible gas monitor, software, non - sparking shovel, and a Smart Buy Elitebook 857 Core 17 computer notebook for the Richmond Fire Department. Mr. Miller moved to advance Ordinance No. 33 -2013 to second reading, suspend the rules and read by title only, supported by Ms. Hollis. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 33 -2013 on second reading by title only. Council President Parker declared Ordinance No. 33 -2013 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Elstro moved for engrossment of Ordinance No. 33- 2013, supported by Mr. Miller. Upon a vote viva voce, the motion passed. Mr. Wissel moved to advance Ordinance No. 33 -2013 to third and final reading and suspend the rules and read by title only, supported by Mr. Miller. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 33 -2013 on third reading by title only. Ordinance No. 33 -2013 was adopted with a 9-0 roll call vote. ORDINANCE NO. 34 -2013 - AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM THE INDIANA DEPARTMENT OF HOMELAND SECURITY The Clerk read Ordinance No. 34 -2013 on first reading by title only. This Ordinance would authorize the City of Richmond to submit a grant application to the Indiana Department of Homeland Security for the Indiana Homeland Security Foundation Grant, and to accept said grant funding in an amount up to Four Thousand Dollars and Zero Cents ($4,000.00). Said grant funding shall be used to procure miscellaneous Hazmat Equipment for the Richmond Fire Department. Mr. Miller moved to advance Ordinance No. 34 -2013 to second reading, suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 34 -2013 on second reading by title only. Council President Parker declared Ordinance No. 34 -2013 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Wissel moved for engrossment of Ordinance No. 34 -2013, supported by Ms. Hollis. Upon a vote viva voce, the motion passed. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 34 -2013 on third reading by title only. Ordinance No. 34 -2013 was adopted with a 9 -0 roll call vote. ORDINANCES ON SECOND READING ORDINANCE NO. 24-2013 —A SPECIAL ORDINANCE VACATING A UTILITY EASEMENT (Hunters Pointe) Mr. Wissel moved to table this Ordinance until July 1, supported by Mr. Winget. Upon a vote viva voce, the motion carried. ORDINANCE NO. 30 -2013 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 — A Plus Realty The Clerk read Ordinance No. 30 -2013 on second reading by title only. This Ordinance is a petition of A Plus Realty for a ten year tax abatement on real estate valued at Seventy Five Thousand Dollars and no cents ($75,000.00). Due to the fact no insurance is offered to employees, Mr. Wissel moved to amend this Ordinance to reflect an abatement for nine years, supported by Mr. Miller. Upon a vote viva voce, the motion carried. Council President Parker declared Amended Ordinance No. 30 -2013 on second reading and public hearing. There being no comments for or against the Amended Ordinance, Mr. Wissel moved for engrossment of Amended Ordinance No. 30 -2013, supported by Mr. Miller. Upon a vote viva voce, the motion passed. Mr. Miller moved to advance Amended Ordinance No. 30 -2013 to third and final reading and suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. The Clerk read Amended Ordinance No. 30 -2013 on third reading by title only. Amended Ordinance No. 30 -2013 was adopted with a 9-0 roll call vote. ORDINANCE NO. 31-2013 — A GENERAL ORDINANCE AMENDING CHAPER 95.11: ALCOHOLIC BEVERAGES ON CITY OF RICHMOND PARK PROPERTY The Clerk read Ordinance No. 31 -2013 on second reading by title only. This Ordinance would revise the Parks Department alcoholic beverage permit policy to allow individuals or entities to hire caterers to serve and sell beer and wine at special events that may held at the Rose Garden Reception Lawn Council President Parker declared Ordinance No. 31 -2013 on second reading and public hearing. Speaking in favor of this Ordinance was Ms. VanDerBurgt. There being no comments against the Ordinance, Mr. Elstro moved for engrossment of Ordinance No. 31 -2013, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. Mr. Wissel moved to advance Ordinance No. 31 -2013 to third and final reading and suspend the rules and read by title only, supported by Mr. Winget. Ordinance No. 31 -2013 was adopted with an 8 -1 roll call vote. Dissenting was Ms. Hollis. ORDINANCES ON THIRD READING ORDINANCE NO. 32-2013 — A SPECIAL ORDINANCE IN CONNECTION WITH INTERIM PROTECTION OF THE PROPERTY LOCATED AT 1225 SOUTH A STREET The Clerk read Ordinance No. 32 -2013 on third reading by title only. This Ordinance is relative the property located at 1225 South "A" Street and has been affirmed by the Unsafe Building Commission to be an unsafe and blighted structure. A fire occurred on the property in 2005 and the property has remained uninhabited and in a state of disrepair since that time. Mr. Wissel moved to strike the second paragraph after NOW, THEREFORE on page 2, supported by Ms. Hollis. Upon a vote viva voce, the motion carried. Mr. Wissel moved to have paragraph 1 read as follows: The map attached as "Exhibit A, " showing the address boundaries of the property located at 1225 South A Street, Richmond, Indiana, is hereby rejected and the interim protection granted by the Historic Preservation is rejected. This motion was supported by Mr. Miller. Upon a vote viva voce, the motion carried. Amended Ordinance No. 32 -2013 was adopted with a 9-0 roll call vote. UNFINISHED BUSINESS CALL FOR ADJOURNMENT There being no further business, on a motion duly made, seconded and passed, the meeting was adjourned.
