PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR OLER President Parker called the meeting to order and the following business was conducted: ROLL CALL Present were: Howard "Jack" Elstro, Kelley Cruse- Nicholson, Bruce Wissel, Clayton Miller, Don Winget, Larry Parker, Misty Hollis, Ron Oler and Phil Quinn. Also in attendance were Walt Chidester, City Attorney; Sally Hutton, Mayor, Tammy Glenn, City Controller, Tony Foster, Metropolitan Development; Jeff Norris, Information and Technology; Elijah Welch, Sanitary District; Sue Roberson, Human Resources; Mike Crawley, Fire Chief; Greg Steins, Public Works and Engineering; Neil Patel and George Sowers representing Rahee Investments; Paris Pegg, Morrison Reeves Library; Wendy Nelson, Don Nordstrom, Joe Schroeder, Historic Preservation; John Veach, Dan Stamper, Jackie Carberry, Eastside Commercial Paris, LLC; John McBride; Dave Burns; Gordon Moore, Beals & Moore; Peter Zaleski and Jeff Plasterer, Wayne County Councilors; Karen Chasteen, City Cleric; Sergeant -at -Arms and Media. APPROVAL OF MINUTES or Ms. Hollis moved to approve the minutes of the meeting held June 17, 2012, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS. • RESOLUTION NO. 3-2013 -A RESOLUTION WAIVING NONCOMPLIANCE RELATED TO LATE -FILED ASSESSED VALUATION DEDUCTION DOCUMENTS OF RAHEE INVESTMENTS, LLC (Holiday Inn) This Resolution would waive the noncompliance resulting from the late- filing of Forms 322/RE and CF -1 with the Wayne County Auditor as allowed by IC 6-1.1- 12.1 -5(a) and (c). Speaking to this Resolution was Mr. Sowers. Resolution No. 3 -2013 was referred to the Tax Abatement Committee and will be heard on Public Hearing August 5, 2013. COMMUNICATIONS FROM THE MAYOR • The Flags at the City Building is at half -staff to honor nineteen firefighters who lost their lives battling a fire in the northwestern part of Arizona. REPORT OF THE BOARD OF PUBLIC WORKS AND SAFETY • Minutes of the June 13 & 20, 2013 meetings are included in packets. Common Council Minutes July 1, 2013 Page 2 of 4 REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and/or ORGANIZATIONS • GREG STEINS — DEPARTMENT OF PUBLIC WORKS AND ENGINEERING: Mr. Steins reviewed all projects in which his Departments are involved. They include Engineering, Airport and Transportation. MISCELLANEOUS BUSINESS • Mr. Chidester reviewed the "computer glitch" by Indiana American Water that issued several high dollar sewer bills. The problem has been remedied. • MORRISON REEVES LIBRARY BOARD APPOINTMENT: On behalf of the Morrison Reeves Library Board of Trustees, Paris Pegg, Secretary, recommended Laura Retherford to fill the position vacated by Linda Ronald. Mr. Winget nominated Nancy Wissel also. This matter will be brought back to Council July 15 for approval. ORDINANCES ON FIRST READING Mr. Elstro moved to suspend the rules and read Ordinance Nos. 35, 37, 39, 40 and 41 -2013 on first reading by title only, supported by Ms. Cruse- Nicholson. Upon a vote viva voce, the motion carried. ORDINANCE NO. 35 -2013 — A SPECIAL ORDINANCE AUTHORIZING THE CITY OF RICHMOND TO RECEIVE DONATIONS FOR RICHMOND FIRE DEPARTMENT PROGRAMS The Clerk read Ordinance No. 35 -2013 on first reading by title only. This Ordinance would authorize the Fire Department to seek and accept donations for programs during the 2013 calendar year. Mr. Wissel moved to advance Ordinance No. 35 -2013 to second reading, suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 35 -2013 on second reading by title only. Council President Parker declared Ordinance No. 35 -2013 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Elstro moved for engrossment of Ordinance No. 35- 2013, supported by Mr. Quinn. Upon a vote viva voce, the motion passed. Mr. Wissel moved to advance Ordinance No. 35 -2013 to third and final reading and suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 35 -2013 on third reading by title only. Ordinance No. 35 -2013 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 37 -2013 — A GENERAL ORDINANCE AMENDING SECTIONS 57.04, 59.05, 59.12, 59.1.04 AND 59.1.10 OF THE RICHMOND CITY CODE ( Stormwater Management) The Clerk read Ordinance No. 372013 on first reading by title only. This Ordinance would transfer the functions of the Department of Stormwater Management and the associated responsibilities of stormwater management and stormwater conveyance from the City Engineers Office to the Richmond Sanitary District. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 37 -2013 on second reading by title only. Council President Parker declared Ordinance No. 37 -2013 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Miller moved for engrossment of Ordinance No. 37- 2013, supported by Mr. Quinn. Upon a vote viva voce, the motion passed. Mr. Elstro moved to advance Ordinance No. 37 -2013 to third and final reading and suspend the rules and read by title only, supported by Ms. Cruse- Nicholson. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 37 -2013 on third reading by title only. Ordinance No. 37 -2013 was adopted with a 9 -0 roll call vote. AMENDED ORDINANCE NO. 39-2013 - AN APPROPRIATION ORDINANCE AMENDING ORDINANCE NO. 52 -2013 KNOWN AS THE 2013 SALARY ORDINANCE (IT) The Clerk read Ordinance No. 39 -2013 on first reading by title only. This Ordinance would increase the number of Computer Technicians in the Department of Information and Technology from one (1) to two (2) with a Bi Weekly Salary of One Thousand Two Hundred Seventy Nine Dollars and Seventy Five Cents ($1,279.75). Mr. Miller moved to table Amended Ordinance No. 39 -2013, supported by Ms. Cruse- Nicholson. Upon a vote viva voce, the motion carried. ORDINANCE NO. 40 -2013 — AN APPROPRIATION ORDINANCE AUTHORIZING ADDITIONAL APPROPRIATIONS FROM CERTAIN FUNDS (EDIT) The Clerk read Ordinance No. 40 -2013 on first reading by title only. This Ordinance would appropriate Three Hundred Seventy Five Thousand Dollars and zero cents ($375,000.00) to the Economic Development Income Tax Fund (245) to support the construction of infrastructure for Crossroad Commons. Mr. Quinn moved to amend this Ordinance by adding the following to the third WHEREAS: These funds would be used by the Eastside Commercial Park, LLC for the construction of streets. This motion was supported by Mr. Winget. Upon a vote viva voce, the motion carried. Speaking to this Ordinance was Jackie Carberry who is a principle with Eastside Commercial Park LLC. Ordinance No. 40 -2013 will be heard on second reading and public hearing July 15, 2013. ORDINANCE NO. 41 -2013 - A SPECIAL ORDINANCE AUTHORIZING THE CITY OF RICHMOND TO RECEIVE A DONATION FROM ECONOMIC GROWTH GROUP OF RICHMOND INDIANA INC. The Clerk read Ordinance No. 41 -2013 on first reading by title only. Mr. Miller moved to advance Ordinance No. 41 -2013 to second reading, suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. Mr. Wissel moved to advance Ordinance No. 41 -2013 to third and final reading and suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 41 -2013 on third reading by title only. Ordinance No. 41 -2013 was adopted with a 9 -0 roll call vote. ORDINANCES ON SECOND READING ORDINANCE NO. 24-2013 — A SPECIAL ORDINANCE VACATING A UTILITY EASEMENT (3502 Eagle Trace) The Clerk read Ordinance No. 24 -2013 on second reading by title only. This Ordinance is a petition to vacate an unused utility easement at 0 and 3502 Eagle Trace. The Plan Commission voted unanimously to recommend approval on June 27, 2013. Council President Parker declared Ordinance No. 24 -2013 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Miller moved for engrossment of Ordinance No. 24- 2013, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. Mr. Wissel moved to advance Ordinance No. 24 -2013 to third and final reading and suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed.
