PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR ELSTRO President Parker called the meeting to order and the following business was conducted: ROLL CALL Present were: Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clayton Miller, Don Winget, Larry Parker, Misty Hollis and Phil Quinn. Absent was Ron Oler. Also in attendance were Walt Chidester, City Attorney; Sally Hutton, Mayor; Karen Chasteen, City Clerk; Steve Stevens; Jan Passmore; Mary Walker, Wayne County Tourism; Tammy Glenn, City Controller; Kim Poinsett; Jackie Carberry; Dan Stamper, Dave Stryker, Dave Burns; Jane Warren; Dave Stidham; Doris Ashbrook; Kelly Hale; Sergeant -at -Arms and Media. APPROVAL OF MINUTES Mr. Wissel moved to approve the minutes of the meeting held July 15, 2013, supported by Mr. Winget. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS • RESOLUTION NO. 3-2013 —A RESOLUTION WAIVING NONCOMPLIANCE RELATED TO LATE -FILED ASSESSED VALUATION DEDUCTION DOCUMENTS OF RAHEE INVESTMENTS, LLC (Holiday Inn) Tabled until August 19, 2013 COMMUNICATION FROM THE MAYOR • There have been several adjustments relative to the Sanitary Sewer Bills due to an error of Indiana American Water. • The EXCEL Center will be opening at C.R. Richardson in August. The program is tuition free, day care is provided, etc. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the July 11, 18 & 25, 2013, meetings were accepted as presented. Common Council Minutes August 5, 2013 Page 2 of 3 REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and/or ORGANIZATIONS None MISCELLANEOUS BUSINESS ORDINANCE NO. 25 -2013 - AN APPROPRIATION ORDINANCE AUTHORIZING ADDITIONAL APPROPRIATIONS FROM CERTAIN FUNDS (EMS) Mr. Quinn moved to strike Ordinance No. 25 -2013, supported by Ms. Hollis. Upon a vote viva voce, the motion carried. ORDINANCES ON FIRST READING ORDINANCE NO. 43 -2013 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE AND APPROPRIATION OF A GRANT FROM THE INDIANA DEPARTMENT OF TRANSPORTATION (Roseview) Ordinance No. 43 -2013 was tabled until August 19, 2013. ORDINANCES ON SECOND READING AMENDED ORDINANCE NO. 40 -2013 — AN APPROPRIATION ORDINANCE AUTHORIZING ADDITIONAL APPROPRIATIONS FROM CERTAIN FUNDS (EDIT — Crossroad Commons) The Clerk read Amended Ordinance No. 40 -2013 on second reading by title only. This Ordinance would appropriate Three Hundred Seventy Five Thousand Dollars and zero cents ($375,000.00) to the Economic Development Income Tax Fund (245) to support the construction of infrastructure for Crossroad Commons. Council President Parker declared Amended Ordinance No. 40 -2013 on second reading and public hearing. Speaking to the Ordinance was Dave Stidham and Joe Schroeder. Speaking against the Ordinance was Tom Glenn, Mike Grace, Nick Wilson, Don Nobbe, Mark Hoelscher and Jan Passmore. Speaking for the Ordinance was Mary Walker, Wayne County Tourism. Mr. Quinn stated due to a potential conflict of interest, he will not be participating in the final vote on this Ordinance. Mr. Parker referred this matter to Mr. Miller for due diligence. ORDINANCE NO. 42 -2013 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 —12.1 ( Primex — Equipment) The Clerk read Ordinance No. 42 -2013 on second reading by title only. This Ordinance is a request of Primex Plastics Corporation for a ten year tax abatement on equipment valued at Five Million Two Hundred Sixty Three Thousand Dollars and zero cents ($5,263,000.00). The Tax Abatement Committee recommended approval. Council President Parker declared Ordinance No. 42 -2013 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Miller moved for engrossment of Ordinance No. 42- 2013, supported by Mr. Quinn. Upon a vote viva voce, the motion passed. Common Council Minutes August 5, 2013 Page 3 of 3 Mr. Wissel moved to advance Ordinance No. 42 -2013 to third and final reading and suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 42 -2013 on third reading by title only. Ordinance No. 42 -2013 was adopted with a 7 -0 roll call vote.
