PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR HOLLIS President Parker called the meeting to order and the following business was conducted: ROLL CALL Present were: Howard "Jack" Elstro, Kelley Cruse- Nicholson, Bruce Wissel, Clayton Miller, Don Winget, Larry Parker, Misty Hollis, Ron Oler and Phil Quinn. Also in attendance were Kim Vessels, Assistant City Attorney; Sally Hutton, Mayor, Karen Chasteen, City Clerk; Jeff Plasterer, Wayne County Council; Police Chief Kris and Linda Wolski; Kevin Ahaus; Jeff and City Controller Tammy Glenn; Ted Somatis, General Manager of Color Box; Sergeant -at -Arms and Media. APPROVAL OF MINUTES Mr. Wissel moved to approve the minutes of the meeting held October 21, 2013, supported by Mr. Winget. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS None COMMUNICATION FROM THE MAYOR • Leaf Pickup has begun and will continue through December 19 • The demolition of targeted unsafe buildings is underway REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the October 10, 2013, meeting was accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and /or ORGANIZATIONS • ECONOMIC DEVELOPMENT CORPORATION BOARD APPOINTMENT: Mr. Winget moved to reappoint Nancy Green to the EDC Board as recommended by the Mayor. This motion was supported by Mr. Oler. Upon a vote viva voce, the motion carried. MISCELLANEOUS BUSINESS Mr. Wissel asked that Amended Ordinance No. 52 -2013 — An Appropriation Ordinance Fixing the Annual Compensation of all Elected Officers for 2014, be added to the Agenda. This Ordinance had been Common Council Minutes October 21, 2013 Page 2 of 5 cents ($181.65) bi- weekly which equates to a total annual salary of Seventy Two Thousand Eight Hundred Dollars and zero cents ($72,800.00). This Ordinance was adopted with a 7 -1 roll call vote. The Mayor did not sign the Ordinance which is considered a Pocket Veto. A two- thirds majority vote of Council is required to override the veto. Any one member of Council may request a vote of reconsideration which will result in a roll call vote. Councilor Wissel moved to override the Mayor's veto on Ordinance No. 52 -2013, supported by Ms. Hollis. The motion passed with a 7 -2 roll call vote. Dissenting was Ms. Cruse - Nicholson and Mr. Miller. ORDINANCES ON FIRST READING Mr. Elstro moved to suspend the rules and read Ordinance No. 64 -2013 on first reading by title only, supported by Mr. Miller. Upon a vote viva voce, the motion passed. ORDINANCES ON FIRST READING ORDINANCE NO. 64 -2013 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A APROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Finance Systems of Richmond Inc.) The Clerk read Ordinance No. 64 -2013 on first reading by title only. This Ordinance is a petition of Finance Systems of Richmond for a ten year tax abatement on real estate valued at Five Hundred Thousand Dollars and zero cents ($500,000.00). Ordinance No. 64 -2013 was referred to the Tax Abatement for due diligence. ORDINANCES ON SECOND READING ORDINANCE NO. 57 -2013 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Color Box) The Clerk read Ordinance No. 57 -2013 on second reading by title only. This Ordinance is a petition of Color Box for a ten year tax abatement on equipment valued at Twenty Six Million Seven Hundred Twenty Eight Thousand Dollars and zero cents ($26,728,000.00). The Tax Abatement Committee recommended approval with the following additions: WHEREAS, On January 17, 2012, the Common Council approved an ordinance establishing an alternative abatement deduction schedule pursuant to IC 6-1.1- 12.1 -17, known as Ordinance No. 76 -2012, in order that a business that receives a deduction under IC 6-1.1- 12.1 -4.5 may apply for the alternative deduction, provided that said business provide proof of applicable Justification for the requested deduction meeting the following criteria: 1. Alternative abatement deduction schedule of 75% for 10 years if all of the following requirements are meta a. $3,000,000 minimum investment, and b. A minimum of ten (10) new full -time employees are hired and maintained, and c. Wages paid to new employees must pay 50% above the state minimum wage, and d. Major medical health insurance is provided to all full -time employees, and e. All improvements and new hires must be completed within three years of the date of the signed ordinance approving the Statement of Benefits for a business, and f. Failure to meet any of the requirements outlined in a. through e. above shall require that the alternative abatement deduction schedule revert to the standard ten (10) year Common Council Minutes October 21, 2013 Page 3 of 5 abatement deduction schedule outlined in IC 6-1.1- 12.1- 4d(10) for real estate improvements and IC 6-1.1- 12.1- 4.5d(10) for personal property beginning with the number of years remaining for the abatement (for example, if a personal property abatement is in its 6th year, the final four years' deductions would be 40 %, 30 910, 20% and 10 %, respectively). 2. Additionally, if the minimum conditions outlined in #1b., #1c., and #1d. above are met, increase the alternative abatement deduction described above by 5% if the business invests a minimum of $5,000,000 or by ten (10 96') percent if the business invests a minimum of $10,000,000. 3. If the minimum conditions outlined in #1a., #1c., and #1d. are met, the Richmond Common Council may increase the alternative abatement deduction described above by 5% if the business adds a minimum of twenty (20) new employees, or by ten (10 %) percent if the business adds a minimum of thirty (30) new employees. 4. If the minimum conditions outlined in #1a., #1b., #1c., and #1d. above are met, increase the alternative abatement deduction described above by 5% if the business pays at least double the state minimum wage for new employees hired. 5. The percentage increases described in #2, #3, and #4 above are independent of each other. As such, a qualifying applicant could possibly achieve a one hundred (100 %) percent deduction. 6. A business requesting an alternative abatement deduction schedule shall provided a letter requesting an alternative abatement deduction schedule and shall provide proof of the applicable justification with the standard application materials. NOW THEREFORE, be it also ordained by the Common Council of the City of Richmond, Indiana, that in accordance with criteria #6 as listed on the alternative abatement deduction schedule, the above - listed property owner has provided a letter requesting an altemative abatement deduction schedule, has requested a ninety percent (90 916) deduction for ten (10) years, and has provided proof of the applicable justification to show that the property owner has met the following applicable criteria: A. The investment will exceed the $10,000,000.00 minimum investment requirement in accordance with criteria #1a. and #2. B. The investment will exceed the ten (10) new full -time employees requirement in accordance with criteria #1b. C. The wages paid to new employees will exceed double the state minimum wage in accordance with criteria #4. D. Major medical health insurance is provided to all full -time employees in accordance with criteria #1d. E. All improvements and new hires will be completed within three (3) years of the signed ordinance approving the Statement of Benefits in accordance with criteria #1 e. NOW THEREFORE, be it also ordained by the Common Council of the City of Richmond, Indiana, that the above - referenced property owner may receive the requested ninety percent (90 9,66) deduction for the ten (10) year period. Council President Parker declared Amended Ordinance No. 57 -2013 on second reading and public hearing. Speaking for the Ordinance was Mr. Somatis. There being no comments against the Ordinance, Mr. Miller moved for engrossment of Amended Ordinance No. 57 -2013, supported by Mr. Quinn. Upon a vote viva voce, the motion passed. Mr. Miller moved to advance Amended Ordinance No. 57 -2013 to third and final reading and suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. The Clerk read Amended Ordinance No. 57 -2013 on third reading by title only. Amended Ordinance No. 57 -2013 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 58 -2013 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A APROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 ( Ahaus Tool) The Clerk read Ordinance No. 58 -2013 on second reading by title only. This Ordinance is a petition of Ahaus Tool for a ten year tax abatement on equipment valued at Three Hundred Fifty Thousand Dollars and zero cents ($350,000.00). The Tax Abatement recommended approval. Council President Parker declared Ordinance No. 58 -2013 on second reading and public hearing. Speaking for the Ordinance was Mr. Ahaus. There being no comments against the Ordinance, Mr. Wissel moved for engrossment of Ordinance No. 58 -2013, supported by Ms. Hollis. Upon a vote viva voce, the motion passed. Mr. Miller moved to advance Ordinance No. 58 -2013 to third and final reading and suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 58 -2013 on third reading by title only. Ordinance No. 58 -2013 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 60 -2013 — AN APPROPRIATION ORDINANCE AUTHORIZING ADDITIONAL APPROPRIATIONS FROM CERTAIN FUNDS (Phone System) The Clerk read Ordinance No. 60 -2013 on second reading by title only. This Ordinance would authorize the appropriation of additional sums of money for funding part of the purchase of a new City wide phone system as follows: Rainy Day Fund - $ 99,550.00 Solid Waste - $ 23,648.00 First Response Fund - $ 32,670.00 Drug Enforcement Administration - $ 35,088.00 Council President Parker declared Ordinance No. 60 -2013 on second reading and public hearing. Speaking for the Ordinance was Ms. Glenn and Chief Wolski. Ms. Hollis questioned the use of Rainy Day Funds. Mr. Wissel moved for engrossment of Ordinance No. 60 -2013, supported by Mr. Winget. Dissenting were Councilors Cruse - Nicholson, Hollis and Quinn.
