PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR ELSTRO President Parker called the meeting to order and the following business was conducted: ROLL CALL Present were: Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clayton Miller, Don Winget, Larry Parker, Misty Hollis, Ron Oler and Phil Quinn. Also in attendance were Walt Chidester, City Attorney; Sally Hutton, Mayor; Karen Chasteen, City Clerk; Sergeant James Mastriano, Lt Donnie Benedict, Major Mark Connery, Patrolmen Zachery Taylor & Jeremy Worch, Chief Kris Wolski, & Sergeant Curt Leverton; Peter Zaleski & Jeff Plasterer, Wayne County Council; Valerie Shafer & Brett Guiley, Economic Development Corporation; Dan Sawyer, Stride Rite Corporation; Carter Smith, Perpetual Recycling; Chris Coleman, Finance Systems; Dave Burns; Tammy Glenn, Controller; Tony Foster, Metropolitan Development; Sue Roberson, Human Resources; Amy Holthouse, Chamber of Commerce; Fire Batallion Chief Jerry Purcell; Sergeant -at -Arms; and, Media. APPROVAL OF MINUTES Ms. Hollis moved to approve the minutes of the meeting held December 2, 2013, supported by Mr. Oler. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS • RESOLUTION NO. 4-2013 — RESOLUTION APPROVING THE LEASE OF REAL ESTATE LOCATED AT 1400 INDUSTRIES ROAD AND 1500 INDUSTRIES ROAD IN RICHMOND, INDIANA Mr. Miller moved to add WHEREAS, Common Council of the City of Richmond, Indiana, finds that the sale price or rental value, as set forth above, is below market rate and will assist in increasing employment or private investment in a certified technology park, and This motion was supported by Mr. Winget. Upon a vote viva voce, the motion carried. Mr. Wissel moved to approve Resolution No. 4 as amended, supported by Ms. Hollis. Upon a vote viva voce, the motion carried. • RESOLUTION NO. 6-2013 — RE PERPETUAL RECYCLING LOAN AGREEMENT Perpetual Recycling has found it necessary to seek additional financing in order to bring their Project into full operating capacity and ORIX Public Finance, LLC is willing to provide such financing on a secured basis senior to the payment of the Bonds by the Borrower. In order to provide for the New Financing an amendment to the Loan Agreement (the "Amendment") is necessary and desirable. The City of Richmond has determined to assist in the furtherance of Common Council Minutes December 16, 2013 Page 2 of 5 the Project and assist the Borrower in obtaining the New Financing by entering an Amendment, which is incorporated into this resolution. The execution of the Amendment will not affect the status of the Bonds as limited obligations of the City. Mr. Quinn moved to approve, supported by Mr. Winget. Upon a vote viva voce, the motion carried. COMMUNICATION FROM THE MAYOR • Thank you to the Park Department, Sanitary District and Street Department for their work during the latest severe winter weather. • Congratulations to Veach's Toy Store for their recognition by the Today Show which will air February 1. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the November 27 & December 5, 2013, meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and /or ORGANIZATIONS • CITY CONTROLLER — Ms. Glenn reviewed the year end accounts and reported the City will have a certified budget in the next few days. MISCELLANEOUS BUSINESS • Major Connery introduced two new Patrolmen to the Police Department — Zachery Taylor and Jeremy Worch. ORDINANCES ON FIRST READING Mr. Elstro moved to suspend the rules and read Ordinance Nos 75, 76, 77, 78, 79 & 80 -2013 on first reading by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. ORDINANCE NO. 75 -2013 — A SPECIAL ORDINANCE AUTHORIZING THE CITY OF RICHMOND TO RECEIVE A DONATION OF ACTIVE LIVING WORKSHOPS FROM THE INDIANA STATE DEPARTMENT OF HEALTH The Clerk read Ordinance No. 75 -2013 on first reading by title only. This Ordinance would authorize the acceptance of a donation from the Indiana State Department of Health, Division of Nutrition and Physical Activity, for the purpose of acquiring the free Active Living Workshop with the donation match that the City will provide the venue and lunch for participants if the City is chosen to host the free Workshops. Mr. Wissel moved to advance Ordinance No. 75 -2013 to second reading, suspend the rules and read by title only, supported by Mr. Oler. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 75 -2013 as amended on second reading by title only. Council President Parker declared Ordinance No. 75 -2013 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Elstro moved for engrossment of Ordinance No. 75- 2013, supported by Mr. Oler. Upon a vote viva voce, the motion passed. ORDINANCE NO. 76 -2013 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 ( Vandor) The Clerk read Ordinance No. 76 -2013 on first reading by title only. This Ordinance is a petition of Vandor Corporation for a ten year tax abatement for manufacturing equipment valued at Five Million Five Hundred Forty Eight Thousand Dollars and zero cents ($5,548,000.00); and, Information Technology equipment valued at Fifty Thousand Dollars and zero cents ($50,000.00). Ordinance No. 76 -2013 was referred to the Tax Abatement Committee for due diligence. ORDINANCE NO. 77 -2013 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6-1.1 -12.1 ( Vandor) The Clerk read Ordinance No. 77 -2013 on first reading by title only. This Ordinance is a petition of Vandor Corporation for a ten year tax abatement for manufacturing Equipment valued at Two Hundred Eighty Eight Thousand Dollars and zero cents ($288,000.00). Ordinance No. 77 -2013 was referred to the Tax Abatement Committee for due diligence. ORDINANCE NO. 78 -2013 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Stride Rite - equipment) The Clerk read Ordinance No. 78 -2013 on first reading by title only. This Ordinance is a request of The Stride Rite Corporation for a ten year tax abatement for equipment valued at Two Million Seven Hundred Fifty Thousand Dollars and zero cents ($2,750,000.00). Ordinance No. 78 -2013 was referred to the Tax Abatement Committee for due diligence. ORDINANCE NO. 79 -2013 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Stride Rite -real estate) The Clerk read Ordinance No. 79 -2013 on first reading by title only. This Ordinance is a request of The Stride Rite Corporation for a ten year tax abatement for real estate valued at Three Million Two Hundred Fifty Thousand Dollars and zero cents ($3,250,000.00). Ordinance No. 79 -2013 was referred to the Tax Abatement Committee for due diligence. ORDINANCE NO. 80-2013 - AN ORDINANCE AUTHORIZING THE ANNUAL COMPENSATION AND BENEFITS OF RICHMOND POLICE OFFICERS Common Council Minutes December 16, 2013 Page 4 of 5 The Clerk read Ordinance No. 80 -2013 on first reading by title only This Ordinance would establish the annual salaries for all police officers will be set forth in a fully executed contract between the Board of Public Works and Safety on behalf of the City of Richmond and John Hennigar Lodge No. 63 of the Fraternal Order of Police to be effective for the 2014 calendar year. Ordinance No. 80 -2013 will be read on second reading January 6, 2014. Council requested a copy of the proposed contract to review before voting. ORDINANCES ON SECOND READING ORDINANCE NO. 66 -2013 — A SPECIAL ORDINANCE ALLOWING CERTAIN OFFICES DEDUCTIONS FROM ASSESSED VALUE WITHIN AN ECONOMIC REVITALIZATION AREA The Clerk read Ordinance No. 66 -2013 on second reading by title only. This Ordinance would clarify that certain offices being redeveloped or rehabilitated within an Economic Revitalization Area may be considered for deductions if they meet the provided criteria. The Richmond Wayne County Chamber of Commerce and the Wayne County Economic Development Corporation have reviewed this Ordinance and concur that it is beneficial. Mr. Wissel moved to amend by deleting ...or the installation of new manufacturing equipment from the first WHEREAS, supported by Mr. Willer. Upon a vote viva voce, the motion carried. Mr. Wissel also reviewed other changes under NOW, THEREFORE, BE IT ORDAINED ... 1. Office, for the purpose of this ordinance, shall be defined as a place in which business, professional, and /or clerical activities can be performed in other geographic locations because the services undertaken are for clientele on a national or international level. 2. The Common Council ... a. stat b. Are committing to a minimum real estate improvement investment of $250, 000, and c. Commit to create 25 new full time jobs within two years, and d. Pay an average hourly wage of 1 -1/2 times the minimum wage, and e. Provide health insurance for their employees. Council President Parker declared Amended Ordinance No. 66 -2013 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Wissel moved for engrossment of Amended Ordinance No. 67 -2013, supported by Mr. Winget. Upon a vote viva voce, the motion passed. Mr. Wissel moved to advance Amended Ordinance No. 66 -2013 to third and final reading and suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. The Clerk read Amended Ordinance No.66 -2013 on third reading by title only. Amended Ordinance No. 66 -2013 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 64 -2013 — A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Finance Systems) The Clerk read Ordinance No. 64 -2013 on second reading by title only. This Ordinance is a request of Finance Systems, LLC for a ten -year tax abatement for real estate in the amount of Five Hundred Thousand Dollars and zero cents ($500,000.00). The Tax Abatement Committee recommended approval. Common Council Minutes December 16, 2013 Page 5 of 5 Council President Parker declared Ordinance No. 64 -2013 on second reading and public hearing. There being no comments for or against the Ordinance, Ms. Cruse- Nicholson moved for engrossment of Ordinance No. 64 -2013, supported by Mr. Miller. Upon a vote viva voce, the motion passed. Mr. Wissel moved to advance Ordinance No. 64 -2013 to third and final reading and suspend the rules and read by title only, supported by Mr. Winget. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 64 -2013 on third reading by title only. Ordinance No. 64 -2013 was adopted with a 9 -0 roll call vote.
