HomeMy Public PortalAbout08) 7A6 Regular Meeting Minutes 2017-06-201. CALL TO ORDER CITY COUNCIL TEMPLE CITY, CALIFORNIA REGULAR MEETING MINUTES JUNE 20, 2017 AGENDA ITEM ?.A-6. Mayor Sternquist called the City Council Regular Meeting to order at 7:34p.m. in the Council Chambers located at 5938 Kauffman Avenue, Temple City. 2. ROLLCALL PRESENT: ABSENT: ALSO PRESENT: 3. INVOCATION Councilmember-Chavez, Fish, Yu, Man, Sternquist Councilmember -None City Manager Cook, Assistant City Attorney Murphy, and City Clerk Kuo Pastor Calvin Hsu, with Rock Mountain Baptist Church at 6019 Baldwin Avenue, will provide the invocation. 4. PLEDGE OF ALLEGIANCE Boy Scout Troop 161 provided a flag ceremony and led those present in the Pledge of Allegiance. Mayor Sternquist pulled "Update from City Attorney" out of agenda order for reporting. Assistant City Attorney Murphy reported out that the City Council met in Closed Session and discussed one item of "Anticipated Litigation" relating to the Mercy Housing Project at the Golden Motel site. He shared that City Council directed City Attorney's office to investigate this project. The City Attorney's office received verbal reports from Temple City residents, residents from adjoining areas, and written information that was given to city staff. The City Attorney's office also filed two different request letters with the county seeking publicly available documents relating to the project. City Attorney's office completed a thorough legal analysis of all available material focusing on environmental law and planning issues (i.e., facts and laws). Recently, City Council directed the City Attorney's office to complete their analysis and file their findings with the County. The City Attorney's office filed City Council Minutes June 20, 2017 Page 2 of 14 their letter with the County on Monday, June 19, 2017, at 8:12a.m. and about 2:00 p.m. of the same day; the county informed the city that the developer has withdrawn their application for the project. 5. CEREMONIAL MATTERS-PRESENTATIONS A. INTRODUCTION OF TEMPLE CITY'S SISTER CITY EXCHANGE STUDENTS Nancy Terry and Leanne Baroldi, Temple City Sister City Association, introduced the Temple City student ambassadors selected to travel to Hawkesbury City, Australia. Mayor and City Council presented the students each with a recognition certificate and a bag with city memorabilia. 6. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Jing Li, Temple City Library Manager, announced new operating hours for the library and invited everyone to go to the library. Steve Stafford, Temple City resident, commented on the potholes near his home. Jerry Jambazian, Temple City business owner, reminded everyone that the Relay for Life is coming up this weekend and also asked the City to start reminding the public regarding the fines for using illegal fireworks in July. Fang Lam Lieu, Lucy Liou, Michael Tom, Anny An, Maureen Wong, and Janet Wong, Temple City residents, thanked City Council for listening to the residents regarding the Mercy Housing Golden Motel Project and for their support on the matter. Michelle Shao, Temple City resident, asked regarding future use of the Golden Motel property and would like the city to keep the residents updated regarding its use. 7. CONSENT CALENDAR City Clerk Kuo made a correction to Consent Calendar Item 7 A. The meeting minute for approval should be Regular City Council Meeting of June 6 instead of Special City Council Meeting of May 30. Councilmember Chavez made a motion to approve the Consent Calendar items. Action: Approved. B. TRANSPORTATION AND PUBLIC SAFETY COMMISSION ACTIONS The City Council is requested to receive and file: 1. Actions of the Regular Transportation and Public Safety Commission Meeting of April12, 2017; and 2. Actions of the Regular Transportation and Public Safety Commission Meeting of May 10, 2017. Action: Received and filed. C. AWARD OF PUBLIC WORKS CONTRACT TO ALL AMERICAN ASPHALT FOR TEMPLE CITY BOULEVARD HIGHWAY SAFETY IMPROVEMENT PROGRAM PROJECT (CIP NO. P15-06) The City Council is requested to award a contract for Pedestrian and Bike Path Safety Improvements on Temple City Boulevard from El Camino Real Avenue to Ellis Land and Roadway Improvements. Upon award of contract, project construction is expected to begin later this month. Action: 1. Awarded a Public Works Contract to All American Asphalt as the lowest responsible bidder for STPL-5365(010) Pedestrian and Bike Path Safety Improvements on Temple City Boulevard from El Camino Real Avenue to Ellis Land and Roadway Improvements (CIP No. P15-06); 2. Authorized the City Manager to execute the Contract in an amount of $1,139,150; and 3. Authorized 10 percent of the awarded contract amount as contingency allowance to be used if necessary at the City Manager's discretion for unforeseen conditions. City Council Minutes June 20, 2017 Page 4 of 14 D. AWARD OF PUBLIC WORKS CONTRACT TO CALPROMAX ENGINEERING, INC. FOR TRAFFIC SIGNAL UPGRADES, SIGNS, AND OTHER SAFETY IMPROVEMENTS AT VARIOUS LOCATIONS (CIP NO. P15-07) The City Council is requested to award a contract for the Highway Safety Improvement Program Project to upgrade traffic signals, signs, and other safety improvements at various locations. Upon award of contract, project construction is expected to begin later this month. Recommendation: 1. Awarded a Public Works Contract to Calpromax Engineering, Inc. as the lowest responsible bidder for HSIPL-5365(009) Traffic Signal Upgrades, Signs, and Other Safety Improvements at Various Locations (CIP No. P15-07) (Project); 2. Authorized the City Manager to execute the Contract in an amount of $143,000; and 3. Authorized 10 percent of the awarded contract amount as contingency allowance to be used if necessary at the City Manager's discretion for unforeseen conditions. E. CONSIDERATION OF A RATE ADJUSTMENT REQUEST FOR WASTE SERVICES FROM ATHENS SERVICES, INC. Per the provisions of the City agreement with Athens, the City Council is requested to approve the rate adjustment request by Athens. The new rates would be effective July 1, 2017. The new single-family rate would increase from $32.10 to $34.51 per month and the rate for a three cubic yard bin would increase from $192.43 to $205.72 per month. Action: Approved the rate adjustment request for waste services made by Athens Services to become effective July 1, 2017. F. ADOPTION OF RESOLUTION NO. 17-5264 EXTENDING THE DURATION OF THE TEMPLE CITY-CAMELLIA LIGHTING MAINTENANCE DISTRICT (DISTRICT) Extension of the duration is necessary to ensure a continued revenue stream through the collection Ad Valorem property taxes to support improvements, maintenance and operations of the District. Action: Adopted Resolution No. 17-5264 extending the duration of the Temple City-Camellia Lighting District for an additional 20 years. City Council Minutes June 20, 2017 Page 5 of 14 G. FISCAL YEAR (FY) 2016-17 CITY BUDGET -FOURTH QUARTER BUDGET AMENDMENTS City Council is requested to authorize staff to revise various budgeted appropriations for the FY 2016-17 City Budget. Action: Authorized staff to revise various budgeted appropriations for the FY 2016-17 City Budget to ensure revenue estimates are accurate and actual spending levels are within budgeted appropriations during the current fiscal year. H. ADOPTION OF RESOLUTION NO. 17-5256 ADOPTING THE FISCAL YEAR 2017-18 STATEMENT OF INVESTMENT POLICY The City's Statement of Investment Policy establishes a guideline for the prudent investment of the City's idle funds and outlines a policy for maximizing the efficiency of the cash management system. Action: Adopted Resolution No. 17-5256, adopting the Statement of Investment Policy for the City of Temple City for Fiscal Year 2017-18. I. REAFFIRMATION OF COMMITTED AND ASSIGNED FUND BALANCE CLASSIFICATIONS FOR THE GENERAL FUND FOR FINANCIAL STATEMENT REPORTING PURPOSES AT JUNE 30, 2017, IN ACCORDANCE WITH THE ADOPTED GOVERNMENT ACCOUNTING STANDARD BOARD STATEMENT NO. 54 (GASB 54) FUND BALANCE POLICY In order to be in compliance with the City's GASB 54 Fund Balance Policy, City Council must reaffirm the Committed Fund Balances and Assigned Fund Balances as designated for financial statement purposes before the end of June 2017. Action: Reaffirmed the Committed Fund Balance of $3,500,000 and the Assigned Fund Balance of $11,513,004 for the General Fund. J. ADOPTION OF RESOLUTION NO. 17-5265 APPROVING PAYMENT OF BILLS The City Council is requested to adopt Resolution No. 17-5265 authorizing the payment of bills. Action: Adopted Resolution No. 17-5265. ADOPTION OF RESOLUTION NO. 17-5262 APPROVING THE MASTER FEE AND FINE SCHEDULE FOR FISCAL YEAR 2017-18, AMENDING AND ESTABLISHING NEW FEES FOR PARKS AND RECREATION PROGRAMS The City Council is requested to approve the Master Fee and Fine Schedule for Fiscal Year 2017-18. The proposed fee increases would help defray the increase in cost of operating various recreation programs. City Manager Cook gave a brief overview regarding the proposed fees and fines schedule. Parks and Recreation Director gave a brief summary of the staff report. Mayor Sternquist opened public hearing. Hearing no request to speak, Mayor Sternquist closed public hearing. Councilmember Yu made a motion to adopt Resolution No. 17-5262 approving the Master Fee and Fine Schedule for Fiscal Year 2017-18, amending and establishing new fees for several parks and recreation programs. ADOPTION OF RESOLUTION NO. 17-5263 CONFIRMING THE FACTORS USED FOR CALCULATING THE ANNUAL APPROPRIATIONS LIMIT FOR THE FISCAL YEAR 2017-18 Article XIII-B provides limits to the amount of tax proceeds stated and local governments can spend each year. Staff has complied with all the provisions of Article XIII-B in determining the Limit for Fiscal Year 2017-18. In order to be in compliance with California State Law, City Council adoption of the resolution is necessary. City Manager Cook spoke briefly on the factors used for calculating the annual appropriations limit for the upcoming fiscal year. Councilmember Yu made a motion to adopt Resolution No. 17-5263, confirming the factors used for calculating the annual Appropriations Limit for Fiscal Year 2017-18. ADOPTION OF RESOLUTION NO. 17-5256 ORDERING THE LEVY OF CITYWIDE LIGHTING AND MAINTENANCE DISTRICT ASSESSMENTS FOR FISCAL YEAR 2017-18 City Council approval of the Fiscal Year 2017-18 levy of the Citywide Lighting and Maintenance District assessments will allow the City to continue with its annual Lighting and Maintenance District program. City Manager Cook gave a brief overview regarding the citywide lighting and maintenance district assessments. Councilmember Yu wanted to clarify that sometimes in the near future, staff will bring to City Council for consideration a way for the city to fund the district assessments. Administrative Services Director Hause gave a brief summary of the staff report. Mayor Sternquist opened public hearing. Steve Stafford, Temple City resident, suggested for the City to consider having the County provide power for the lights in the assessment district. Hearing no further request to speak, Mayor Sternquist closed public hearing. Mayor Pro Tem Man made a motion to adopt Resolution No. 17-5256, ordering the levy and collection of assessments Fiscal Year 2017-18. ADOPTION OF THE PROPOSED FISCAL YEAR 2017-18 CITY BUDGET City Council Minutes June 20, 2017 Page 8 of 14 AND FIND THAT THE CITY IS IN COMPLIANCE WITH GOVERNMENT CODE SECTION 66000 Pursuant to Section 901 of the City Charter, the City Council is required to conduct a public hearing prior to the adoption of the Proposed Fiscal Year 2017-18 City Budget which includes the proposed revenues and corresponding expenditures. City Manager Cook gave a brief overview of the budget process. Administrative Services Director Hause gave a brief summary of the staff report and an overview of the City's budget using the fiscal diagnostic tool. Mayor Sternquist opened public hearing. Helen Marston and Lucy Liou, Temple City resident, supports increase in public safety budget. Jerry Jambazian, Temple City business owner, commented regarding curbside painting and city entrance sign. City Manager Cook shared information regarding Assembly Bill 109 - Realignment of Law (i.e., realignment of punishable crimes) and how it is having an impact on crime in the community. Jane Tong, Temple City resident, supports the city having its own police department. Pastor Hsu, Rock Mountain Church, commented on the value of the real estate in Temple City. Jerry Jambazian, Temple City business owner, commented about the City's monthly Neighborhood Watch meetings and shared that the City did look into having its own police department a few years ago. Councilmembers made comments regarding the cost of having a City police department and the services the Los Angeles County Sheriffs provides to the City. Mayor Pro Tem Man made a motion to adopt Resolution No. 17-5261 approving the proposed Fiscal Year 2017-18 City Budget and making the finding that the City is in compliance with Government Code Section 66000. INTRODUCTION AND FIRST READING OF ORDINANCE NO. 17-1022 AMENDING TITLE 9, CHAPTER 1 OF THE TEMPLE CITY MUNICIPAL CODE PERTAINING TO THE REGULATION OF ACCESSORY DWELLING UNITS AND AMENDING TITLES 5 AND 9 OF THE TEMPLE CITY MUNICIPAL CODE TO MAKE ADMINISTRATIVE CHANGES This Zoning Code amendment is in response to recent changes to State Law pertaining to the regulation of accessory dwelling units. City Manager Cook gave a brief overview regarding the ordinance relating to the Accessory Dwelling Units. Planning Manager Reimers gave a brief summary of the staff report. Mayor Sternquist opened public hearing. Hearing no request to speak, Mayor Sternquist closed public hearing. Councilmember Chavez made a motion to introduce for first reading by title only and waive further reading of Ordinance No. 17-1022, amending Title 9, Chapter 1 of the Temple City Municipal Code pertaining to the regulation of accessory dwelling units and amending Titles 5 and 9 of the Temple City Municipal Code to make administrative changes; and schedule the second reading of Ordinance No. 17-1022 for July 5, 2017. LETTER OF OPPOSITION, SENATE BILL 231 Senate Bill 231 seeks to pass the cost of a city's storm water collection program to local property owners without voter approval. City Council is requested to authorize the Mayor to sign a letter opposing Senate Bill 231. City Manager Cook gave a brief summary of the staff report and overview of Senate Bill 231. City Council Minutes June 20, 2017 Page 10 of 14 Mayor Sternquist opened public comment. Helen Marston, Temple City resident, shared that she contacted Assembly member Chau's office and asked for his support to oppose Senate Bill 231. Councilmember Yu encouraged the public to contact the Senator's office to oppose Senate Bill 231. Hearing no further request to speak, Mayor Sternquist closed public hearing. Councilmember Fish made a motion to approve a letter in opposition to Senate Bill 231, which if adopted, would impose storm water management fees on property owners without voter approval; and authorize the Mayor to submit said letter on behalf of Council. CO-SPONSOR 2017 MOON FESTIVAL AND FUN PARTY WITH WORLD JOUNAL LA, LLC The City received interest from World Journal LA, LLC requesting the City host and co-sponsors a 2017 Festival to bring the community together to celebrate the Moon Festival. City Manager Cook gave a brief summary of the staff report. City Councilmembers made comments regarding the proposed festival and asked questions regarding the logistic and timing of the proposed festival. Mayor Sternquist opened public hearing. Steve Stafford, Temple City resident, asked if alcohol will be served at the festival and if Las Tunas Drive will be closed for the carnival rides. Jerry Jambazian, Temple City business owner, made comments regarding City's financial responsibility for the proposed festival. Lucy Liou, Temple City resident, asked for the date and time of the proposed festival. Jerry Jambazian, Temple City business owner, asked questions regarding the festival. Representatives from the World Journal, LA, LLC, answered City Council questions regarding the festival. Councilmember Yu made a motion to approve hosting and co-sponsorship of·· a 2017 Moon Festival and Fun Party with World Journal LA, LLC on Saturday, September 30, 2017; waive all fees and deposits for use of Temple City Park and the Performing Arts Pavilion; and authorize City staff to hang a street banner on Las Tunas Drive with a not to exceed expense to city as stated in the staff report. Seconded by Mayor Pro Tern Man. The motion failed by the following votes: AYES: NOES: RECUSED: ABSENT: Councilmember-Yu, Man, Councilmember-Chavez, Fish, Sternquist Councilmember-None Councilmember-None City Council directed staff to bring the item back for Council consideration with more detailed information. 11. COMMUNICATIONS-None 12. UPDATE FROM CITY MANAGER City Manager Cook provided information regarding the sale and use of fireworks for the upcoming July 4 holiday. He reminded the public that the only fireworks permitted in the city are the safe and sane labeled fireworks. Violation can go up to $5,000. City will have several patrol cars out on July 4. 13. SCHOOL DISTRICT/CITY STANDING COMMITTEE (Councilmember Chavez and Councilmember Fish)-Formed 1/3/2012 Councilmember Fish reported on the standing committee's meeting on Thursday, June 15. The committee discussed different ways to help students find work/internships opportunities with local businesses and received an update regarding paving on Temple City Boulevard. B. PUBLIC ARTS COMMISSION AD HOC COMMITTEE (Councilmember Chavez and Mayor Pro Tern Man)-Formed 8/2/2016 No report. Mayor Sternquist established a City Attorney Performance Evaluation Ad Hoc Committee and appointed Mayor Pro Tern Man and herself to the committee. 15. COUNCIL ITEMS SEPARATE FROM THE CITY MANAGER'S REGULAR AGENDA A. MAYOR STERNQUIST City Council Minutes June 20, 2017 Page 13 of 14 Mayor Sternquist announced that the July 4 City Council meeting has been moved to Wednesday, July 5, 7:30p.m., in the Council Chambers. B. COUNCILMEMBER CHAVEZ-None C. COUNCILMEMBER FISH Announced upcoming Relay for Life event dates and time. D. COUNCILMEMBER YU Encourage residents to get involved and thanked the public for coming out to express their feelings about the Mercy Housing Project. E. MAYOR PROTEM MAN Shared that the City will host community meetings to receive public comments regarding the City's General Plan on Monday, June 26 and Saturday, July 8. 16. REIMBURSEMENT OF EXPENSES TO CITY OFFICIALS FOR CONDUCT OF CITY BUSINESS AND FOR CITY PAYMENT OF CONFERENCE EXPENDITURES-None 17.
