HomeMy Public PortalAbout2007-051 Resolution Granting Preliminary Plat with Variances for Property North of Navajo Rd & E of Tamarack DrMember Johnson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2007-51 RESOLUTION GRANTING PRELIMINARY PLAT WITH VARIANCES FOR PROPERTY LOCATED NORTH OF NAVAJO ROAD AND GENERALLY EAST OF TAMARACK DRIVE WHEREAS, Bradley Moen and Michael Leuer (the "Applicants") have applied to the city of Medina (the "City") for preliminary approval to allow a seven lot subdivision located north of Navajo Road and generally east of Tamarack Drive (the "Subject Property"), which land is legally described on Exhibit A attached hereto; and WHEREAS, the preliminary plat of the Subject Property, to be known as Tuckborough Ridge, was reviewed by the Planning Commission at its meeting on July 10, 2007 and, following a public hearing thereon as required by law, the Planning Commission recommended approval thereof, subject to certain terms and conditions; and WHEREAS, the Applicants have requested approval of variances from the City's subdivision regulations to allow a 1,050-foot cul-de-sac and a 1,250-foot cul-de-sac; and WHEREAS, the City Council on September 18, 2007 reviewed the preliminary plat with variances for its conformance with the City's ordinances, considered the recommendations of the Planning Commission and heard comments from the Applicants and other interested parties; and WHEREAS, the City Council finds that the physical elements of the site limit the landowner's ability to locate the roadways in any other fashion which dictates the cul-de-sac lengths and justifies the requested variances; and WHEREAS, the City Council finds that these topographical conditions are unique to the Subject Property; and WHEREAS, the City Council finds that the requested variances for length of cul-de-sac will not be detrimental to the public welfare. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Medina, Minnesota that preliminary approval of a plat with variances be granted to the Applicants for the plat of Tuckborough Ridge, subject to the following terms and conditions: 1. A preliminary plat is approved to allow the creation of 7 single-family lots in accordance with the revised plans dated June 7, 2007, except as amended by this resolution. Resolution No. 2007-51 October 2, 2007 2. Variances from the City's subdivision regulations are approved to allow a 1,050-foot cul- de-sac and a 1,250-foot cul-de-sac. 3. The Applicants shall revise the plat to show the roadways platted as private roads within an outlot and agree to execute a private road agreement in a form acceptable to the City prior to final plat approval. 4. The contiguous suitable soils acreages for the seven lots shall be recalculated prior to final plat approval to confirm that these lots still meet the City's minimum lot size requirements. 5. The Applicants shall dedicate to the City a 15-foot trail easement along the south property line from Navajo Road to the east property line as partial satisfaction of their park dedication requirement prior to final plat approval, with the remainder of the park dedication requirement to be paid as cash in lieu of land prior to release of the plat for recording. 6. No wetland fill or impact is approved at this time. 7. A formal wetland delineation report will need to be submitted to the City for review and approval prior to final plat approval. 8. No floodplain fill or impact is approved at this time. 9. The Applicants shall obtain all necessary permits from the Elm Creek Watershed Management Commission. 10. The Applicants shall dedicate easements on the final plat for all wetlands as identified on the preliminary plat dated June 7, 2007. 11. The Applicants shall comply with the Wetland Conservation Act approval and all standards. 12. Development within the plat is subject to the floodplain management ordinance requirements identified in Section 826 of the Medina city code. 13. The Applicants shall comply with all City requirements as noted in the comments from the city engineer dated June 15, 2007. 14. The application for the final plat of Tuckborough Ridge must be submitted to the City within 180 days of preliminary plat approval or the preliminary plat shall be considered void, unless a written request for time extension is submitted by the Applicants and approved by the City Council. 15. Any application for a building permit must include grading, drainage and erosion control plans with each building plan submitted. Resolution No. 2007-51 2 October 2, 2007 16. The City's building official shall approve the soil percolation tests and septic system designs prior issuance of building permits. Primary and secondary site locations will also be provided and septic sites must be staked prior to beginning any construction on site. 17.
