WHEREAS, Cole County Public Water Supply District Number One, owner of the real estate hereinafter described, having submitted to the City Council An Amended PUD Plan of said real estate, being located in Jefferson City, Cole County, Missouri, and more particularly described as follows: Part of the west half of the Northeast Quarter of Section 18, Township 44, Range 12, Jefferson City, Cole County, Missouri. Containing 2.0 acres. WHEREAS, it appears that the procedures set forth in the zoning code relating to zoning have in all matters been complied with, as said property owner submitted to the Planning and Zoning Commission and City Council a PUD Plan Amendment for the above referenced property. NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,AS FOLLOWS: SECTION 1. The PUD Plan Amendment submitted by Cole County Public Water Supply District Number One, on file as Case No. P06034 in the Jefferson City Planning Division is hereby approved for the above land referenced herein. SECTION 2. The following principal land uses are approved for the site: Existing water tank; new telecommunications tower and equipment shelters. • SECTION 3. Approval is made subject to the following conditions: (1) Overall height not to exceed 195 feet; (2) Provide certifications as required by the building regulations division; (3) Compliance with Engineering Division recommendations and corrections to the site plan. No. 1. Based oil the maximum configuration consisting of the mounting platform,cable and twelve(12)antennae,the total weight would be 6,456 pounds. The tank was designed with a factor of safety to accommodate loads created by additional accessories, but not to a level that would permit the loads created by the proposed antennae • system. As you know, the additional load would be transferred through the steel tank to the reinforced concrete footings, which were designed In accordance with standard loading requirements based on the allowable bearing pressure of the soil. In my opinion,the entire foundation of the tank would need to be replaced to permit the proposed additional loads, Further consideration of Installing the proposed antennae on the tank is not recommended. Even if the installation was practical based on structural requirements, 1 suspect that potentially there would be opposition due to aesthetic issues. Le me know if you have any questions. T-Mobile is a member of the T-Mobile International Group, the mobile telecommunications subsidiary of Deutsche Tcickom AG. Deutsche Telckom and its subsidiaries and affiliates provide wireless services to approximately 72 million customers worldwide. T-Mobile and its affiliates have licenses to provide service to 95 percent of the U.S. population. T-Mobile is licensed by the Federal Communications Commission (FCC)and regulated by the Federal Aviation Administration(FAA). T-Mobile offers consumers, businesses and enterprise customers the most advanced mobile communications services available today, including voice, two-way text messaging, and high-speed wireless data services. T-Mobile operates the largest all digital, wireless network based exclusively on GSM (Global System for Mobile Communications) technology. GSM is the most widely used digital standard worldwide, accounting for more than 70 percent of the total digital wireless market. GSM's proven, feature-rich digital technology provides customers with integrated voice, high-speed data, paging and short message service capabilities,as well as excellent sound quality and call reliability. • Site Selection Once the decision has been made to expand wireless coverage to a community, T-Mobile engineers prepare a preliminary network design based on many factors, including the characteristics of the community, available radio frequencies and wireless equipment capabilities, A map of the selected "search area" and other requirements for the site are provided to property consultants who visit the community to identify and rank potential sites. This Search Area represents the area in which a facility must be located to allow it to function as an integral unit in T-Mobile's system. Whenever feasible, T-Mobile strives to acquire sites that bland with local character and are unobtrusive to the community. Existing structures such as water tanks, building rooftops, and competitor-owned towers are oflcn the first choice for sites. When construction of a new structure is required, sites are chosen by their proximity to compatible land uses. It is important to remember that wireless communication facilitics must be considered as part of a network, not as individual locations. Communication facilities can be likened to links in a chain, one link adds to the next, making ilia network design larger. Once these links,or communication facilities, are constructed, it is difficult to adjust the network design or move individual sites. Property Description The proposed facility will be located at 4935 Lohnnan Road,Jefferson City, Missouri, The subject parcel is owned by Cole County Water District. The parcel is located within the PUD(Planned Urban Development) Zoning District. T-Mobile will be leasing a 70' x 50' parcel of the property located in the southeastern • portion of the property. Access will be via an existing access road off Old Lohman Road. Nature of Request/Zoning Analysis • T-Mobilc is requesting an amendment to the Final PUD Plan and any other pcmnits necessary to allow the construction of a wireless facility consisting of a 195' monopole and accompanying equipment cabinets.T- Mobile will locate the monopole within the 3500' leased area. The lower will be built to accommodate multiple carrier's antennas and T-Mobile has leased enough ground space to accommodate multiple carrier's equipment. Components and Operations Each communication facility consists of a lower or other support structure and various wireless installations, including base station equipment. Once construction of the facility is complete and the telephone switching equipment is fine-tuned, visitation to the site by service personnel for routine maintenance will occur an average of once a month. The site is entirely self-monitored and connects directly to a central office where sophisticated computers alcrl personnel to any equipment malfunction or breach of security. Because the communication facility will be unstaffed, there are no regular hours of operation and no impact to existing traffic patterns. Water or sewer services are not required. Ingress and egress is already provided along with parking for service personnel who arrive infrequently to service the site. Statement Regarding Nuisances No nuisances will be generated by the proposed modifications. The only facilities necessary for this site are telephone and electric facilities which are already provided. The facility will be unstaffed, will have no • impact on traffe and will involve no loading or unloading of supplies. Further, no materials will be handled, stored, discharged or discarded. The only noise generated by the operation of a wireless communications facility will be that from standard heating and cooling units. The proposed facility will not injure the public health,safety,morals or general welfare. Compliance with Federal Regulations T-Mobile will comply with all FCC rules governing construction requirements, technical standards, interference protection, power and height limitations, and radio frequency standards. Bryn Mawr Avenue Chicago, Illinois 60631 Re: Impact to Surrounding Property Values Created by Communications Towers (File 95081605)) Dear Ms. Sinkler: Pursuant to your request, this letter has been compiled to provide you and your colleagues with an overview of my experience relative to evaluating the impact on surrounding property values created by installation of wireless communications towers, specifically monopole towers with associated equipment shelters at the ground level. • As you are aware, I have extensive experience in evaluating the effect on surrounding properties ofsites ofthis type.*file following is a brief synopsis ofthat experience. For your general information, I am the owner and president of the real estate appraisal/consuhing firi shown on the above letterhend. I have been directly invoived in the valuation and analysis of real estate of all types since 1981. 1 hold the MAI designation from the Appraisal Institute,am licensed with the State of Illinois as a Certified General Appraiser, and additionally ant a licensed real estate broker in Illinois, holding the commercial brokerage designation of CCIM. A more detailed summary of my educational and professional background, as well as my experience in the real estate valuation/consultation field, is attached, Specifically with regard to the type of situation you have called upon me to address,my firm has been involved in a number of consultation assignments specific to this issue over the past 8 to 10 years. All of these assignments have been in the Chicago metropolitan area, including the communities of Aurora, Barrington, Barrington Hills, Buffalo Grove, Chicago, Glencoe, Homewood, Lincolnshire, Kenilworth, Maple Park, Midlothian, North Barrington, Oak Forest, Streamwood, Vernon !dills, Westmont, Willow Springs and Winnetka. These locations have involved a variety of neighborhood types, including residential, commercial, industrial, and farmland. The work we have performed in each case has varied, ranging from providing written studies on specific sites, to giving presentations at Village hearings and/or testifying in court for litigation matters relating to this property type. • Ms. Kelly Sinkler T-Mobile Page Two August 19, 2005 In the process of completing these assigmnents, the request specifically made of us in each case has been to determine what effect, if any, a communications tower site may have on the value of surrounding andlor nearby properties. Of significant importance to these consultation assignments is the following: We are not paid, nor do we accept assignments in which a specific position on this issue is advocated. Our sole impetus is to be entirely objective, providing sound reasoning for our conclusions, and based upon the actions and reactions of the buying and selling real estate market. In each of these situations our basic plan of analysis has been twofold. first, we have researched property sales, including all details of the transactions and the physical characteristics of the properties involved, fn order to ascertain if any difference in actual sale prices could be detected due to location near or in view of a communications tower. The basic premise of this analysis type is founded in the principles of real estate valuation commonly accepted and utilized by all courts of law, governmental bodies, and major banks. This premise is that of the direct comparison of physical and locational characteristics of properties that have sold, resulting in a determination of the market reaction, if any, to various factors relative to those properties, and expressed in dollars. • The second aspect of our analysis plan has been to interview and consult with other real estate professionals, specifically those directly involved in the marketing and sale of properties, to discover their opinions of this sane issue, relative to their daily professional lives in dealing directly with buyers and sellers of real estate. As we have completed these assignments, we have determined essentially three categories of potential impact and concern exist,These categories are as follows: 1) Ein,h omaental-The potential for pollution of the air, surface, and/or sub-surface. 2) Health-The potential impact on nearby inhabitants and/or property users. 3) Vien,-The potential impact on nearby inhabitants and/or property users. In the process of completing the aforementioned consultation assignments, we have completed the above two step analysis plan on 40 to 50 locations involving wireless communications facilities; several of which we have analyzed during separate time periods. As mentioned above, these locations involved a variety of property types (residential, commercial, etc,), however approximately 35 to 40 of these were residential in character. Although every situation has the potential for unique variables, our experience with those locations analyzed have repeatedly resulted in the following 5 points of finding: • DAVID A.KUNKEL&ASSOCIATES,INC. • Ms. Kelly Sinkicr T-Mobile Page Three August 19, 2005 I) To our knowledge there is no evidence to suggest that any environmental or health issues arise as a result of communications tower sites. 2) To our knowledge there is no perception, within the general buying and selling real estate populace, suggesting any environmental or health issues arise as a result of communications tower sites. 3) We have found no ascertainable difference in properly values as a result of this specific locational characteristic. 4) Market evidence of the lack of an ascertainable difference in property values as a result of this specific locational characteristic has been reiterated repeatedly by other rent estate professionals. 5) Changes in market 'values, specifically appreciation, are not restrained as a result of this specific locational characteristic. • Although every situation is different and should be evaluated independently, it has been my opinion in each of these cases that no negative impact on the use, enjoyment, or value of surrounding properties resulted from the construction of facilities of this type. T-Mobile continues to develop a system to provide improved wireless telecommunications technology to the Jefferson City area. The design of our system consists of a network of antenna locations,where cacti location may be Lion-uniformly spaced. T-Mobile strives to design its system using existing structures. In this instance we have considered all options of existing structures. We have evaluated the proposed location at heights of 195', 150' and 100'. The coverage objective of the proposed antenna location is to provide in-building service to the neighborhoods south of Hwy 50 near Country Club Rd.and near Westview Rd;also we desire to provide increased in-building service to the neighborhoods north of liwy 50 near Rainbow Dr. Currently we have • no in-building coverage In any of those areas. A proposed site at this location with a height of 195' would enable us to meet 100%of this objective. At a height of 150',our in-building coverage would be compromised in the neighborhoods near Rainbow Dr.,north of Idwy 50,and in dnc neighborhoods near London Way,southeast of the site location,as Indicated on the map. Also,at 150' we would lose 25%of our in-building coverage that we would have at 195'. By co-locating on Ilse water tank on the property,our antenna height would be 100'. The proposed tower will be a 195' monopole. The applicant is required to demonstrate the proposed tower ))eight in excess of 150 feet is necessary for the proper functioning of the system. New towers over 70 feet must have the capacity to accommodate one additional carrier or provider. The applicant states in its narrative that file new tower and lease area will provide collocation for multiple additional carriers'antennas and related equipment and the site plan depicts antemine and equipment shelters for additional carriers. Setbacks. New towers are required to set back from all property lines at least 50%ofthe tower height unless designed far co-location. As a single carrier monopole of 195 feet, the proposed tower would be required to set back a distance of at least 97'-0 from all property lines. The proposed tower will set back 434'-6" from the north property line(Old Lohman Rd),39'-9" from the cast properly line, 109'-9"from the west property line, and 100'-9" from the south property line. Buffering. Towers designed for co-location are required to be buffered from nearby residential dwellings and vacant residentially zoned land by a distance of at least the height of the tower. In Ibis case, the proposed tower would be located at least 434'-6', over twice ilia height of the tower, from any existing dwellings or vacant residentially zoned land. Use of Existing Towers. There are no existing cellular towers within 1,500' of the proposed tower. Separation. New monopole towers 75 feet in height or greater are required to be separated from existing towers by 1,500 feel or more. There are no existing lowers within 1,500' of the proposed tower. Fencing. The site plan indicates a fence around Ilia facility compound,the proposed fence will be galvanized chain link, 8 feet in height,topped with 3 strands of barbed wire. Safety Standards, An Airspace Obstruction Analysis Report has been submitted. Structural integrity of the structure may be certified by the engineer's signature and seal on the site plan and upon other plans provided. Equipment Shelter(s). Multiple equipment shelters will be located on the site. Parking. Two parking spaces must be provided within 100' of the tower and on the Sallie parcel. The proposed extension would include a 12' wide 36' long spur that could accommodate one parking space or be used as a vehicle turnaround. One additional parking space is required within 100' of the tower. The parking area for the existing water tower could accommodate this requirement. Staff Recommendation The substantive requirements of the City's telecommunications ordinance have been met. The Planning and Zoning Commission shall consider the information presented bythe applicant and detennine if approval of the cell lower would conflict with the purposes of this Section, would create a blight on adjacent property, or would interfere with adjacent uses, If approved, staff recommends the following conditions: I.
