CITY OF MEDINA
RESOLUTION NO.2007-59
RESCINDING LOT REARRANGEMENT APPROVAL FOR
DARREL A. FARR DEVELOPMENT AND MARK S. BRYANT FOR
PROPERTY LOCATED AT 155 HAMEL ROAD AND 165 HAMEL ROAD
(PIN 12-118-23-41-0035 AND PIN 12-118-23-41-0036)
WHEREAS, Darrel A. Farr Development and Mark S. Bryant (the "Applicants")
are fee owners of two parcels of property (the "Subject Property") within the City of
Medina (the "City) legally described on Exhibit A, attached hereto; and
WHEREAS, the Applicants applied to the City for approval of a lot line
rearrangement for the Subject Property; and
WHEREAS, on August 21, 2007, the City adopted Resolution 2007-39, granting
approval of a Lot Line Rearrangement for the Subject Property, subject to certain terms
and conditions; and
WHEREAS, the Applicants have submitted written documentation that they do
not intend to move forward with the Lot Line Rearrangement, do not intend to meet the
terms and conditions of Resolution 2007-39, and request that the City rescind the
approval.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina, Minnesota, that it should and hereby does rescind the approval of a Lot
Rearrangement granted by Resolution 2007-39 to Darrel A. Farr Development and Mark
S. Bryant, subject to the following conditions:
1. The parcels shall continue to be legally described as before the application for lot
line rearrangement and adoption of Resolution 2007-39. This legal description is
included as Exhibit A, attached hereto; and
2. The Applicants shall pay the city an administrative fee in an amount necessary to
reimburse the city for the cost of reviewing the original lot line rearrangement
application.

The motion for the adoption of the foregoing resolution was duly seconded by member
Johnson upon vote being taken thereon, the following voted in favor thereof:
Smith, Weir, Johnson, Cavanaugh
And the following voted against same: (Absent: Crosby)
None
Whereupon said resolution was declared duly passed and adopted.

Legal Description (155 Hamel Road, PID# 12-118-23-41-0035)
That part of Lot 1, Block 4, Plat of Hamel, and unvacated Mill Street dedicated therein,
according to the recorded plat thereof, Hennepin County, Minnesota, described as
follows:
Commencing at a point on the South line of Block 5 Plat of Hamel, distant 115.12
feet East of the Southeast corner of Lot 4, said Block 5, and marked by a Judicial
Landmark set pursuant to Torrens Case No. 5412; thence Northerly along the Westerly
line of the street as traveled a distance of 107.4 feet to a Judicial Landmark set pursuant
to said Torrens case; thence continuing along the Northerly extension of said line,
hereafter referred to as Line A, to its intersection with the Northerly line of said Block 4,
said intersection being the Northeast corner of said Lot 1 and the actual point of
beginning of the land being described herein; thence Northwesterly along said Northerly
line a distance of 41 feet; thence Southwesterly parallel with the Southeasterly line of
said Lot 1, a distance of 124 feet; thence Northwesterly at right angles a distance of 25
feet; thence Southwesterly to a point on the Southwesterly line of said Lot 1 distant 66
feet Northwesterly from the Southeast corner of said Lot 1; thence Southeasterly along
said Southwesterly line and its extension to said Line A; thence Northerly along said Line
A to the point of beginning.
