CITY OF TEMPLE CITY CITY COUNCIL MINUTES MARCH 4, 1986 the regular meeting of the City Council to Tuesday, March 4, 1986 in the Council 2. The invocation was given by City Manager 3. The Pledge of Allegiance 4. ROLL CALL: Present: Absent: Also Present: Koski. to the Flag was led by Mayor Dennis. Councilmen- Atkins, Froehle, Gillanders, Swain, Dennis Councilmen -None City Manager Koski, City Attorney Martin, Planning Director Shaw, Parks and Recreation Director Kobett and Julie Estrada of the Temple City Times PRESENTATION: Mayor Dennis presented on behalf of the City Council and the com- munity of Temple City a silver medallion commemorating the City's 25th Anniversary to Marion Tyrell and the Tyrell family as a tribute to Jack for his dedication to the City. Pat Myers, field representative for Assemblyman Richard Mountjoy, 42nd District, presented a California State Assembly Memorial Resolution for each member of the Tyrell family recognizing the late Councilman Jack Tyrell's contributions to the community. 5. CONSENT CALENDAR: Mayor Dennis requested that items A. and B. (1) be removed from the Consent Calendar; Councilman Gillanders requested items H. and J. be removed; and Councilman Swain requested item I. be removed. Councilman Atkins moved to approve the remaining items on the Consent Calendar, seconded by Councilman Froehle and unanimously carried. B. RECOMMENDATIONS FROM PARKS & RECREATION COMMISSION MEETING OF FEBRUARY 19, 1986 (2) APPLICATION FOR STATE GRANT FUNDS FOR PROPOSED IMPROVE- MENTS AT LIVE OAK PARK Council authorized filing of application for State Grant Funds in the amount of $60,000 to be used for the instal- lation of lights on the four tennis courts at Live Oak Park; authorize the Mayor and City Clerk to sign; and adopt Resolution No. 86 -2415 approving the application for State Grant Funds under the California Parks and Recreation Facilities Act of 1984. r 188 Council Minutes, March 4, 1986 - Page 2 (3) PROPOSAL FOR PRIVATE PRINTING OF QUARTERLY RECREATION SCHEDULE Council agreed to meet in a study session to review with City Attorney Martin the proposed contract with NNT Pub- lications, Inc. to print the Recreation Department's quarterly brochures at no cost to the City. C. HAZARDOUS MATERIALS DISCLOSURE LAW - AB 2185 Council acknowledged the Los Angeles County Fire Department's responsibility to provide and administer hazardous materials disclosure programs for the City per State mandate. D. RESOLUTION NO. 86 -2416 ORDERING THE CANVASS OF THE GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, APRIL 8, 1986, BE MADE BY CITY CLERK Council adopted Resolution No. 86 -2416. E. RESOLUTION NO. 86 -2417 ESTABLISHING VOTING PRECINCTS AND ELECTION OFFICERS FOR THE GENERAL MUNICIPAL ELECTION ON APRIL 3, 1986 Council Adopted Resolution No. 86 -2416. F. PLANNING COMMISSION ACTION - MEETING OF FEBRUARY 25, 1986 Council received and filed the Planning Commission memo relating to action taken at the Commission's February 25th meeting. G. CLAIM FOR PERSONAL INJURY: CARMELLA SULLI Council denied claim and referred it to Southern California Joint Powers Insurance Authority. K. RESOLUTION NO. 36 -2418: WARRANTS AND DEMANDS Council adopted Resolution to pay bills. A. APPROVAL OF MINUTES Mayor Dennis wished to make an addition to the motion in item 6. B. Estate of Gerald FitzGerald including the requirement that any disbursement of funds would have to be approved by the City Manager to insure compliance with the provisions of the trust. Councilman Atkins moved to amend the Minutes as stated by Mayor Dennis above, seconded by Councilman Swain and unani- mously carried. B. RECOMMENDATIONS FROM PARKS & RECREATION COMMISSION MEETING OF FEBRUARY 19, 1986 (1) PROPOSED IMPROVEMENTS AT TEMPLE CITY HIGH SCHOOL Mayor Dennis requested that Temple City Board of Education be provided Recreation Systems, Inc.'s Recre- ation Analysis of Temple City High School for the Board's information and comments as RSI recommends that proposed improvements at the high school be terminated. Councilman Gillanders moved to terminate the proposed improvements at Temple City High School subject to advis- ing the Board of Education of the Parks and Recreation Commission findings, seconded by Councilman Froehle and . unanimously carried. TRAFFIC SIGNAL STUDY Councilman Gillanders moved to hold the matter over to the study session scheduled for this evening, seconded by Council- man Froehle and unanimously carried. I. PROPOSALS FOR DIAL -A -RIDE SERVICE Councilman Swain moved to hold the matter over to the study session' scheduled for this evening, seconded by. Councilman Gillanders and unanimously carried. 6. tUNFINISHED BUSINESS: A. ORDINANCE NO. 86 -582 (2nd reading) CHANGE OF ZONE FROM C -1 TO C -1 -0 FOR PROPERTY LOCATED AT 5909 -5927 CLOVERLY AVENUE (LUMBERYARD) APPLICANT /OWNER: HARRY SAGHEB City Manager Koski stated that on February 18, 1936 Council held a public hearing and approved a request for a change of zone from C -1 to C -1 -0 for property located at 5909 -5927 Cloverly Avenue. A change of zone to C -1 -0 would allow business and professional office type uses in addition to the retail sales uses presently allowed. The Planning Commission found the change of zone appropriate as the new zone main- tained the integrity of the existing C -1 zoned areas while providing some flexibility to: an area which has no frontage on Las Tunas Drive. A Negative Declaration of Environmental Impact was certified by the Council. Councilman Gillanders moved to waive further reading of Ordinance No. 86 -582, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING A CHANGE OF ZONE FROM C -1 TO C -1 -0 IN CASE NO. 85 -766, seconded by Councilman Swain and unanimously carried. Councilman Swain moved to adopt Ordinance No. 86 -582, seconded by Councilman Froehle and unanimously carried., 7. NEW BUSINESS: A. PUBLIC HEARING: APPEAL OF A DECISION BY THE PLANNING COM- MISSION APPROVING A REQUEST FOR CONDITIONAL USE PERMIT TO ALLOW A TAKE -OUT RESTAURANT AT 9570 LAS TUNAS DRIVE (DOMINO'S PIZZA) City Manager Koski provided background information stating that at their February 11, 1986 meeting, the Planning Com- mission approved a request for a Conditional Use Permit to operate a 1,650 square foot take -out restaurant in an exist- ing building. On February 13 City Council appealed the, decision of the Planning Commission, indicating concern re- lative to the new use as it pertains to the objectives of the Commercial Revitalization Committee Plan. Mayor Dennis declared the public hearing open and invited any- one wishing to speak to come forward. No one came forward to address the matter. Councilman Atkins moved to continue the matter to the meeting of March 18 in order that Domino's may have a representative from their headquarters in Ann Arbor, Michigan attend the public hearing, seconded by Councilman Froehle and unanimously carried. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: Virgil Graf, 6118 Primrose Avenue, stated that he was here this evening representing Pacific Bell. Mr. Graf presented the City withthree videos narrated by T.V..'s "Benson" on the subjects of drownings, heart attack, disasters, broken bones, seizures, poison, drugs, burns, earthquake, electric shock and choking. These may be used as desired by the City and may even be tele- vised over the government information channel. RECESS TO CRA: At this time Council recessed to meet as the Temple City Com- munity Redevelopment Agency; approved the Minutes of the regular meeting of February 18, 1986; and adopted Resolution No. CRA 264: Warrants and Demands. 10. ACTION ON REQUEST BY CRA: None 11. MATTERS FROM CITY OFFICIALS: A. REQUEST FOR MATERNITY LEAVE. OF ABSENCE - STEPHANIE RIOS, SECRETARY Councilman Gillanders moved to authorize a maternity leave of absence without pay for Stephanie Rios from May 8 through August 1, 1986, seconded by Councilman Swain and unanimously carried. B. REQUEST FOR AUTHORIZATION TO ATTEND LEAGUE OF CALIFORNIA CITIES PLANNING COMMISSIONERS INSTITUTE - SAN DIEGO, MARCH 12 - 14, 1986 Councilman Swain moved to approve the attendance of Com- missioners Coolman, Stacy and Breazeal at the Planning Com- missioners Institute in San Diego on March 12 - 14, 1986; and authorize the necessary expenditures, seconded by Coun- cilman Froehle and unanimously carried. C. MEMBERSHIP IN THE SOUTHERN CALIFORNIA WATER COMMITTEE, INC. Mayor Dennis stated that he had received a letter from the Los Angeles County Board of Supervisors requesting that the City of Temple City participate in the Southern California Water Committee with annual dues of $750. Councilmembers felt the fee to be rather high; and concurred to receive and file the Board of Supervisors' letter of February 18, 1986. D. TIME CAPSULE Mayor Dennis stated that on Saturday, March 1, 1986, the Time Capsule was placed beneath the cornerstone of the City Hall and the opening date of the capsule be set for May 25, 2060. Councilman Gillanders moved that on May 25, 2060, which is 100 years from the incorporation of the City, the Mayor, City Council and duly selected Centennial Committee retrieve the Time Capsule, seconded by Councilman Swain and unanimously carried. tMet 1 5 . Council Minutes, March 4, 1986 - Page 5 12. STUDY SESSION: At 8:15 p.m. City Council recessed to a study session. 5. B. (3) PROPOSAL FOR PRIVATE PRINTING OF QUARTERLY RECREATION SCHEDULE Council discussed a proposal to have a quarterly recre- ation brochure published and mailed to each business and residence in the City at no cost to the City. NNT Publications' cost is offset by advertisements in the brochure which are sold by the company. Councilmembers concurred that a clearly distinguishable disclaimer must be shown on the cover of the brochure. H. TRAFFIC SIGNAL STUDY Council reviewed traffic studies from Willdan Associates and Barton-Aschman Inc. It was recommended that the preliminary meeting to be held with City staff be scheduled to include the Traffic Commission. The Traffic Commission will be in- volved with the overall study to the extent that they can provide adequate input on the work to be accomplished.. I. PUBLIC ADDRESS SYSTEM FOR COUNCIL CHAMBER Council reviewed the staff proposal for upgrading the sound system with new equipment. 'Members expressed a preference . for small pedestal -type microphones.` The sound system of various types of microphones are to be evaluated prior to a final determination. J PROPOSALS FOR DIAL -A -RIDE SERVICE Council reviewed the staff memo of February 28, which provi- ded an overview of the present Dial -A -Ride service. Staff memo also reviewed alternative programs offered to other com- munities with similar residential makeup as Temple City. It was the consensus of the Council that it was preferable to provide transportation services through a contract rather than using City personnel. 13. City Council reconvened at 9:10 p.m. following the study session. 5. B. (3) PROPOSAL FOR PRIVATE PRINTING OF QUARTERLY RECREATION SCHEDULE Councilman Gillanders moved to authorize staff to coordin- ate the publication of a quarterly brochure listing com- munity activities; and have the agreement for publication placed on the March 18; 1986 Council Agenda, seconded by Councilman Atkins and unanimously carried. H. TRAFFIC SIGNAL STUDY Councilman Atkins moved to accept the proposal of Willdan Associates in the amount of $18,749, seconded by Councilman Gillanders and unanimously carried. I PUBLIC ADDRESS SYSTEM FOR COUNCIL CHAMBER Councilman Atkins moved to authorize staff to engage the ser- vices of Southland Sound Corporation to proceed with the installation of a new sound system in the Council Chamber sub- ject to the execution of an agreement outlining the revised costs, seconded by Councilman Gillanders and unanimously carried. 1 r R4 Council Minutes, March 4, 1986 - Page 6 J. PROPOSALS FOR DIAL- A -RIDE SERVICE Councilman Atkins moved to accept the proposal of Community Transit Services, Inc. for a period of one year in the amount of $119,819, and seconded by Councilman Gillanders. Motion carried with Mayor Dennis objecting to the cost of $15 per round trip per person. 14. ADJOURNMENT;.
