HomeMy Public PortalAbout12-20-2010PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, DECEMBER 20, 2010 The Common Council of the City of Richmond, Indiana met in regular session December 20, 2010 in the Council Chambers in said City. PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR MILLER President Miller called the meeting to order and the following business was conducted: ROLL CALL Councilors present were Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clay Miller, Bing Welch, Larry Parker, Robert Goodwin, Diana Pappin and Phil Quinn. Also present were: Sally Hutton, Mayor; Walt Chidester, City Attorney; Karen Chasteen, City Clerk; Kim Vessels, Assistant City Attorney; Gary Wiggans; Lynn Johnstone; Dave Dorsten; Gordon Moore; George Sowers; Kirit Patel; Mary Walker; Frank Schwartzel; Mr. Yun; Donna Geddes and, Tony Foster. APPROVAL OF MINUTES Mr. Parker moved to approve the minutes of the meeting of December 6, 2010 supported by Ms. Pappin. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS None COMMUNICATION FROM THE MAYOR ■ The State of Indiana Historic Preservation Award was presented to the Richmond Historic Preservation Commission and Preserve Richmond. ■ The Community Action Grant will end on December 23. ■ Wrapping up all work for the year. All Departments tightened their belt and had a little money remaining in their accounts. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the December 2 & 9 2010, meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and /or ORGANIZATIONS ■ COUNCIL APPOINTMENT TO THE BOARD OF ZONING APPEALS: Donna Scheiferl has asked to serve another term on the BZA. Alex Dickman was also nominated. All nominations were held until January 4. Common Council Minutes December 20, 2010 Page 2 of 4 ■ MAYOR APPOINTMENT TO ECONOMIC DEVELOPMENT CORPORATION: Mayor Hutton recommended Nancy Green. Ms. Pappin moved to accept the recommendation, supported by Ms. Cruse Nicholson. Upon a vote viva voce, the motion passed. MISCELLANEOUS BUSINESS None ORDINANCES ON FIRST READING Councilor Elstro moved to suspend the rules and read Ordinance Nos. 58, 59 & 60 -2010 on first reading by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. ORDINANCE NO. 58 -2010 - AN APPROPRIATION ORDINANCE AMENDING THE 2010 BUDGET (RPD) The Clerk read Ordinance No. 58 -2010 on first reading by title only. Presented by Chief Wolski, this Ordinance would authorize the City of Richmond to transfer funds within the Police Department Budget to Garage & Motor Supplies and Tires & Tubes. Mr. Elstro moved to advance Ordinance No. 58 -2010 to second reading and to suspend the rules and read by title only, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 58 -2010 on second reading by title only. Council President Miller declared Ordinance No. 58 -2010 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Parker moved for engrossment of Ordinance No. 58 -2010, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. Mr. Wissel moved to advance Ordinance No. 58 -2010 to third and final reading and suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 58 -2010 on third reading by title only. Ordinance No. 58 -2010 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 59 -2010 — AN ORDINANCE ESTABLISHING A UNIFORM FEE SCHEDULE FOR CERTIFICATION OF DOCUMENTS, COPYING OF DOCUMENTS AND POSTAGE REIMBURSEMENT FEES FOR REQUESTS FOR PUBLIC RECORDS OR DOCUMENTS MADE PURSUANT TO INDIANA CODE 5 -14 -3 The Clerk read Ordinance No. 59 -2010 on first reading by title only Presented by Ms. Vessels, this Ordinance would establish a fees schedule for document copies, certifications, etc. The Clerk read Ordinance No. 59 -2010 on second reading by title only. Council President Miller declared Ordinance No. 59 -2010 on second reading and public hearing. There being no comments for or against the Ordinance, Mr. Wissel moved for engrossment of Ordinance No. 59 -2010, supported by Mr. Parker. Upon a vote viva voce, the motion passed. Ms. Cruse - Nicholson moved to advance Ordinance No. 59 -2010 to third and final reading and suspend the rules and read by title only, supported by Mr. Elstro. Upon a vote viva voce, the motion passed. ORDINANCE NO. 60 -2010 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Belden) The Clerk read Ordinance No. 60 -2010 on first reading by title only. Presented by Mr. Wissel, this Ordinance is a request of Belden, Inc. for a ten -year tax abatement on equipment valued at $1.9 million. Ordinance No. 60 -2010 was referred to the Tax Abatement Committee for due diligence. ORDINANCES ON SECOND READING ORDINANCE NO. 51 -2010 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 ( Rahee Investments) The Clerk read Ordinance No. 51 -2010 on second reading by title only. This Ordinance is a request of Rahee Investments, LLC for a ten -year tax abatement for real estate valued at $6.8 million. Rahee Investments intends to construct a 100 room hotel with an approximately 7,000 square feet conference center which will seat 270 attendees banquet style or 450 theater style. Council President Miller declared Ordinance No. 51 -2010 on second reading and public hearing. Speaking in favor was Mr. Dorsten. Speaking against was Messrs. Wiggans, Yuan and Schwartzel. Mr. Elstro moved for engrossment of Ordinance No. 51 -2010, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. Mr. Elstro moved to advance Ordinance No. 51 -2010 to third and final reading and suspend the rules and read by title only, supported by Ms. Cruse - Nicholson. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 51 -2010 on third reading by title only. Ordinance No. 51 -2010 was adopted with an 8 -1 roll call vote. Dissenting was Mr. Welch. ORDINANCE NO. 52 -2010 - A SPECIAL ORDINANCE AUTHORIZING THE APPROVAL OF A STATEMENT OF BENEFITS FOR A PROPERTY OWNER APPLYING FOR DEDUCTIONS UNDER I.C. 6 -1.1 -12.1 (Perpetual Recycling Solutions) The Clerk read Ordinance No. 52 -2010 on second reading by title only. This Ordinance is a request of Perpetual Recycling Solutions for a ten -year tax abatement on real estate valued at $3.5 million. The Tax Abatement Committee requested this be tabled until further notice.
