HomeMy Public PortalAbout2009-4 - AMENDMENT - CITY CODE FOR VENDORSORDINANCE 2009 -4 AN ORDINANCE AMENDING CHAPTER 4, ARTICLE 2, DIVISION I, Sections 4 -20 and 4 -23 OF THE GREENCASTLE CITY CODE, WI- 1EREAS, Chapter 4, Article 2, Division I of the Greencastle City Code sets out provisions for temporary vendors in the City, including Itinerant Merchants, Solicitors and Special Events; WI-IG:REAS, there is a need to change the language to provide for a seasonal Special Event Permit. NOW TI 11 REFORE be it ordained by the Conunon Council of the City of Greencastle that it hereby amends Chapter 4, Article 2, Division I as follows: Division I. Itinerant Merchants, Solicitors and Special Events Sec. 4 -20. Special Events Permits. a. Definition. A Special Event shall occur when two (2) or more vendors or exhibitors participate as a group in a sales event with a common theme or purpose, which event lasts for less than sixty (60) actual days. For purposes of calculating days, days are cumulative and it is not required that they be consecutive. Group events include, but are not limited to, antique shows, vehicles shows, festivals. hobby shows or similar events which are to be held for the propose of sale or rental of such items for services to the general public. Group events shall not include events which are not open to the general public. Sec. 4-23. Fees The following fees shall apply and must be paid prior to the issuance of a license under this Division. a. Itinerant. merchants and solicitors One day $10.00 Seven days $40.00 Thirty days $100.00 Seasonal (4 months) $250.00 h. Special Events Permit One Day $20.00 Two Days $35.00 Three Days $45.00 Seven Days $100.00 Seasonal (4 months) 5250.00 All other terms and conditions contained in Chapter 2, Article 4 ofthe Greencastle City Code not specifically amended hereby shall remain in full lorce and effect. F. outside Service Providers. In the event that the city engages a service provider to perform an activity in connection with one or more covered accounts the City shall review such arrangements in order to ensure that the service provider's activities are conducted in accordance with agreed upon policies and procedures that are designed to detect any red flags that may arise in the performance of the service provider's activities and take appropriate steps to prevent or mitigate identify theft. G. Periodic Updating and Reporting. At least annually, Utility staff shall evaluate the effectiveness of the program and suggest any changes to the program necessitated by evolving patterns in identity theft. In addition, the Utility staff shall provide a report to the Board of Public Works and Safety, addressing material matters related to the program and evaluate issues such as: I . The effectiveness of the policies and procedures of the City in addressing the risk of identity theft in connection with the opening of covered accounts and with respect to existing covered accounts; 2. Service provider arrangements; 3. Significant incidents involving identity theft and management's response; and 4. Recommendations for material changes to the Program. This Ordinance shall have full force and effect upon passage of the Greencastle Common Council and its approval by the Mayor.
