HomeMy Public PortalAbout2007-074 Resolution Granting Final Plat Approval for Property N of Navajo Rd & E of Tamarack DrMember Smith introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2007-74 RESOLUTION GRANTING FINAL PLAT APPROVAL FOR PROPERTY LOCATED NORTH OF NAVAJO ROAD AND GENERALLY EAST OF TAMARACK DRIVE WHEREAS, Bradley Moen and Michael Leuer (the "Applicants") have applied to the City of Medina (the "City") for preliminary approval to allow a seven lot subdivision located north of Navajo Road and generally east of Tamarack Drive (the "Subject Property"), which is legally described on Exhibit A attached hereto; and WHEREAS, the plat of the Subject Property, to be known as "Tuckborough Ridge" received preliminary plat approval with variances by the city council on October 2, 2007; and WHEREAS, the Applicants have provided a final plat document consistent with those terms and conditions; and WHEREAS, the city council on December 4, 2007 reviewed the final plat for its conformance with the City's ordinances and the terms and conditions of preliminary approval, considered the recommendations of staff and heard comments from the Applicants. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MEDINA, MINNESOTA, that approval be granted to the Applicants for the final plat of Tuckborough Ridge, subject to the following terms and conditions: 1. A final plat is approved to allow the creation of seven single-family lots in accordance with the final plat and revised plans received November 21, 2007, except as amended by this resolution. 2. The Applicants shall enter into a private road agreement that is satisfactory to the City. The private road agreement shall be recorded with the final plat. 3. The Applicants shall enter into a development agreement that is satisfactory to the City. The development agreement shall be recorded with the final plat. 4. The Applicants shall enter into a stormwater maintenance agreement for the on -site stormwater management system that is satisfactory to the City. The stormwater maintenance agreement shall establish a responsible party and be recorded with the final plat. The Applicants also acknowledge that the City intends to establish a storm sewer improvement tax district pursuant to Minn. Stat. § 444.16, et seq., covering the subdivision. The Applicants shall dedicate a 15-foot trail easement along the south property line from Navajo Road to the east property line as park dedication and pay a fee of $31,705 as cash in lieu to satisfy the remainder of the park dedication requirement prior to release of the plat for recording. The trail easement document shall be recorded with the final plat. 6. No wetland fill or impact is approved at this time. 7. No floodplain fill or impact is approved at this time. 8. The final plat shall comply with all conditions of approval stated in the letter from the Elm Creek Watershed Management Commission dated November 13, 2007 prior to release of the final plat for recording. 9. Development within this plat is subject to the Wetland Conservation Act approval and all standards. 10. Development within the plat is subject to the Floodplain Management Ordinance requirements identified in Section 826 of the Medina City Code. 11. Final plat approval shall be subject to compliance with all City requirements as noted in the comments from the city engineer dated November 26, 2007. 12. The application for building permits must include grading, drainage and erosion control plans with each building plan submitted. 13. The building official must approve the soil percolation tests and septic system designs prior issuance of building permits. Primary and secondary site locations shall also be provided and septic sites must be staked prior to beginning any construction on site. 14. The Applicants shall enter into a wetland buffer easement agreement in a form satisfactory to the City and the Elm Creek Watershed Management Commission. The wetland buffer easement agreement shall be recorded with the final plat. 15. The Applicants shall submit a revised final plat for city council review and approval if any modifications occur prior to the release of the final plat for filing. 16. The Applicants shall pay to the City a fee in an amount sufficient to reimburse the City for the cost of reviewing the application and related documents. 17. The final plat must be filed with the county recorder within 60 days of the date of the city council resolution granting final approval or the final plat shall be considered void, unless a written request for time extension is submitted by the Applicants and approved by the city council.
