HomeMy Public PortalAbout05-03-2010PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MAY 3, 2010 The Common Council of the City of Richmond, Indiana met in regular session May 3, 2010 in the Council Chambers in said City. PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR GOODWIN President Miller called the meeting to order and the following business was conducted: ROLL CALL Councilors present were Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clay Miller, Bing Welch, Larry Parker, Robert Goodwin, Diana Pappin and Phil Quinn. Also present were: City Engineer Greg Steins; Police Chief Kris Wolski; Mayor Sally Hutton; City Attorney Walt Chidester and City Clerk Karen Chasteen. Several students from Centerville High School government class were in attendance. APPROVAL OF MINUTES Ms. Pappin moved to amend the name of Mr. Zimmerman to Mr. Foster as presenting Ordinance Nos. 16 & 17 -2010 on April 19, 2010, supported by Mr. Parker. Upon a vote viva voce, the motion passed. Ms. Pappin moved to approve the minutes of the meeting of April 19, 2010 as amended, supported by Mr. Goodwin. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS The Indiana Department of Transportation presented the City of Richmond with a check in the amount of Five Hundred Seventeen Thousand Six Hundred Dollars and Zero Cents ($517,600.00) for the removal of the South 9th Street (LPA Bridge). This amount represents 80% of the total cost of the project. The Economic Development Income Tax fund will provide the remaining 20 %. COMMUNICATION FROM THE MAYOR • Hot Mix is ready • Most of the paving will be done in -house this year • Spring Clean -up is underway • Mowing of public rights of way is beginning • The Mayor noted this is the 21St year of being a Street Tree City REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the April 15 & 22, 2010, meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and /or ORGANIZATIONS None Common Council Minutes May 3, 2010 Page 2 of 3 MISCELLANEOUS BUSINESS Mr. Parker asked the Law Department to review the Animals section of the Richmond City Code and begin discussion about banning Pit Bulls in the City limits. ORDINANCES ON FIRST READING Mr. Elstro moved to suspend the rules and read Ordinance No. 12 -2010 in its entirety and No. 19 -2010 on first reading by title only, supported by. Upon a vote viva voce, the motion passed. ORDINANCE NO. 12 -2010 — A SPECIAL ORDINANCE AUTHORIZING THE CITY OF RICHMOND TO RECEIVE A DONATION FROM THE WAYNE COUNTY FOUNDATION (Street Tree Commission) The Clerk read Ordinance No. 12 -2010 on first reading in its entirety. WHEREAS, the City of Richmond, Indiana, has the option of accepting or rejecting donations for a specific purpose; and WHEREAS, the acceptance of a donation for a specific purpose constitutes the appropriation of such property for the intended purpose. NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that the following shall be accepted and gratefully acknowledged by the citizens of Richmond: From the Wayne County Foundation, a donation of One Thousand Dollars and No Cents ($1,000.00) to the City of Richmond, to be used for the Richmond Area Environmental Fund for the Street Tree Commission. Mr. Wissel moved to advance Ordinance No. 12 -2010 to second reading and to suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 12 -2010 on second reading by title only. Council President Miller declared Ordinance No. 12 -2010 on second reading and public hearing. There being no comments for or against the Ordinance, Ms. Cruse - Nicholson moved for engrossment of Ordinance No. 12 -2010, supported by Mr. Elstro. Upon a vote viva voce, the motion passed. Mr. Wissel moved to advance Ordinance No. 12 -2010 to third and final reading and suspend the rules and read by title only, supported by Mr. Welch. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 12 -2010 on third reading by title only. Ordinance No. 12 -2010 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 19 -2010 - AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM INDIANA CRIMINAL JUSTICE INSTITUTE (digital recording system) The Clerk read Ordinance No. 19 -2010 on first reading by title only. Presented by Chief Wolski, this Ordinance would authorize the City of Richmond Police Department to submit a grant application to the Indiana Criminal Justice Institute, to pay for one (1) digital interview recording system and to accept said grant funding in an amount up to Four Thousand Six Hundred Five Dollars and Zero Cents ($4,605.00). The Police Department will provide a local match from the D.E.A. Asset Forfeitures account in an amount up to Five Hundred Twelve Dollars and Zero Cents ($512.00) which is the 10% minimum local match required for said grant. Said funds, if awarded to the City of Richmond, shall be appropriated to pay for one (1) Digital Interview Recording system. Council President Miller declared Ordinance No. 19 -2010 on second reading and public hearing. There being no comments for or against the Ordinance, Ms. Cruse - Nicholson moved for engrossment of Ordinance No. 19 -2010, supported by Mr. Elstro. Upon a vote viva voce, the motion passed. Mr. Welch moved to advance Ordinance No. 19 -2010 to third and final reading and suspend the rules and read by title only, supported by Mr. Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 19 -2010 on third reading by title only. Ordinance No. 19 -2010 was adopted with a 9 -0 roll call vote.
