a. Foundation Request - Brittany Ramos (People to People)
Recommendation: Sponsor Brittany Ramos, in the amount of $2,000, to represent the
City of Beaumont as an Ambassador of People to People International.
Staff report was given by Frank Coe, Chief of Police.
Presentation was given by Brittany Ramos.
Motion by Council Member Fox, Seconded by Council Member Berg to donate $3,000
from the Beaumont Charitable Foundation to assist with funding on the People to
People Trip. Vote: 5/0
b. Ordinance No. 985 Amending Chapter 1.17 of the Beaumont Municipal Code
Administrative Code Enforcement Remedies.

Open the Public Hearing 7:20 p.m.
Mary New;�an- marked opposed on request to speak— Feels that there is too much
code enforcement and that code enforcement violates a person's rights. Does not like
the idea of code enforcement and feels there should be less of it.
Robert Newman — marked opposed on request to speak — Spoke about the constitution
and gave a sermon.
Mark Sohmer — marked opposed on request to speak — Concerns were addressed.
Everything he wanted to address has been spoken for. Feels that the things we do
effect everyone around us. We all need to use wisdom in what we do.
Sharon Sohmer — marked opposed on request to speak — Concerns were addressed.
Feels everyone should pray about everything, stand together, and help the young.
Gary Kennedy — marked opposed on request to speak — Spoke about the constitution
and feels it is the law of the land overall including the city codes.
Closed Public Hearing 7:46 p.m.
Motion by Council Member Fox, Seconded by Council Member Berg to approve with the
addition that the first time offence can be waived. Vote: 5/0

APPEALS" (ORDINANCE NO. 988)
Background
On February 1, 2011, the City Council approved Ordinance No. 985, which amends Chapter 1.17
of the Municipal Code concerning administrative code enforcement.
The process of administrative code enforcement includes a requirement that property owners
(and their tenants) who are cited for violating the Municipal Code be given the opportunity to
appeal. In practice, appeals are very rare, perhaps occurring at the rate of one a year (or less).
This is because administrative citations are not issued lightly, and they are only issued after
several contacts have been made with the property owner (or tenant, as the case may be) in order
to encourage remediation prior to citation.
Because appeals are rare, the City has not found it necessary to establish a formal procedure for
conducting appeals. However, because of the public - spirited interest in municipal affairs, there
has been an increase in the number of volunteers wishing to serve on City commissions and
committees. Thus, one means of tapping into this enthusiastic pool of volunteers could be by a
formally- established procedure for conducting administrative code enforcement appeals.
Summary of the Proposed Ordinance
If enacted, the Ordinance will authorize a `Board of Administrative Appeals ", consisting of at
least one panel of three members, up to three panels of three members each. The City Council
will appoint members to this Board, who must be at least 18 years of age and either residents or
owners of businesses that are located in the City. It is proposed that the appointees serve a term
of two years, without compensation.
Each panel of the Board of Administrative Appeals would be convened on a rotation basis as
needed, to hear appears concerning administrative code enforcement, animal control violations,
nuisance violations and mobilehome park rent complaints.
In most instances, the violator's appeal right will not end with an appeal to the Board. Our Code
allows for a final appeal to the City Council, such as in the case of nuisances and mobilehome
park rent issues, and every appellant reserves the right to judicial review in the event the
appellant disagrees with the City Council's final ruling.

Section 1: Chapter 2.30, entitled "Board of Administrative Appeals ", is hereby added to
the Beaumont Municipal Code as specifically set forth in Exhibit "A ", which Exhibit is attached
hereto and made a part hereof.
Section 2: This Ordinance shall take effect as provided by law.

There is hereby created a Board of Administrative Appeals, sometimes referred to in this
Chapter as the `Board." The Board shall consist of at least one panel of three members, but not

Section 2.30.020 Appointment and Qualifications of Board Members

BACKGROUND:
The Planning Commission reviewed and recommended City Council approval of two Municipal
Code updates at the January 11, 2011 meeting, related to the recently adopted Housing Element,
incorporate housing criteria updates to the Sixth Street Overlay Zone as well as the Urban
Village Specific Plan Overlay. These changes to the Municipal Code are before the Council for
consideration because they were not covered as part of the original Housing Element Update, but
are needed to be included in the Municipal Code to be in conformance with this approved
document.
With prior actions on the Housing Element Update by the City Council and Planning
Commission included:
A) The Planning Commission, at its meeting on October 12`h 2010, considered this item and
recommended approval to the City Council.

Staff previously prepared an Initial Study under Negative Declaration 10 -ND -08 pursuant to the
provisions of the California Environmental Quality Act (CEQA) that was considered with the
General Plan Housing Element Update and remains valid for use under these modifications;
based upon the finding that the project would not have a significant impact upon the
environment.
RECOMMENDATIONS:
Staff recommends that the City Council:
1. Conduct a Public Hearing on the items presented for consideration; and,
2. Approve the first reading of Ordinance 989 that will amend Section 17.03.130 relative to
"Sixth Street Overlay" of the Beaumont Municipal Code; and,

For reference, the Housing Element is a mandated by State Law to be prepared and updated in
eight -year increments, and the currently approved Element is for the period of 2006 -2014.
The Element also obligated the City to revise some of its zoning criteria and standards, most of
which was approved by the Planning Commission and City Council. This update was inclusive
of addressing Single -Room Occupant Facilities, Caretakers Units, Emergency Shelters, Animal
Keeping /Services, and Parking Requirements for Multi- Family Uses.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BEAUMONT, CALIFORNIA
IN OPPOSITION TO THE STATE OF CALIFORNIA ADMINISTRATION'S PROPOSAL TO
ABOLISH REDEVELOPMENT AGENCIES IN CALIFORNIA
WHEREAS, as part of its 2011 -2012 budget proposal, the Governor has proposed
permanently abolishing California's more than 400 local redevelopment agencies; and
WHEREAS, this proposal represents another misguided and unacceptable State
budget raid of local government funds that voters have repeatedly sought to end, most
recently in November 2010 when an overwhelming 61 % of voters elected to stop State raids
of local government funds, including redevelopment funds;
WHEREAS, this proposal will bring very little financial benefit to the State.
According to the State Controller's Office, redevelopment agencies have more than $87
billion in bond and other contractual obligations that legally must be repaid before revenues
are available to any other purpose. In fact, according to the State Department of Finance's
own budget documents, there will be no State savings in out years from eliminating
redevelopment; and
WHEREAS, throughout California, redevelopment activities support 304,000 jobs
annually, including 170,600 construction jobs, contribute over $40 billion annually to
California's economy in the generation of goods and services, and generate more than $2
billion in state and local taxes in a typical year; and
WHEREAS, eliminating redevelopment will destroy the development of affordable
housing in California. Redevelopment agencies are the second largest funder of affordable
housing, behind only the Federal government, responsible for over 98,000 units of
affordable housing since 1993; and
WHEREAS, the elimination of redevelopment agencies will destroy local economic
development, including hundreds of thousands of jobs and billions of dollars in local
economic activity throughout California. In fact, in the City of Beaumont, abolishing
redevelopment will halt the revitalization of 6th Street and Beaumont Avenue into a unique
downtown, eliminate the ability to fund fagade improvements in the downtown area,
eliminate sewer replacement and street repaving projects, and have a drastic and
detrimental effect to the City of Beaumont's efforts to eliminate blight, enhance activity,
reduce unemployment and provide affordable housing; and
WHEREAS, eliminating redevelopment will take away one of the few tools local
governments have to comply with state requirements to plan for more compact urban
development supported by transit - oriented development, housing, jobs and infrastructure;
and
WHEREAS, without the Redevelopment Agency for the City of Beaumont there is no
mechanism to recover lost jobs, remedy blight and bring much needed public projects into
the City; and
WHEREAS, shutting down redevelopment agencies is a violation of multiple State
and Federal constitutional provisions; and
WHEREAS, the City Council of City of Beaumont urges local and state officials to
join them in support the Redevelopment Agency for the City of Beaumont and
Redevelopment Agencies statewide.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BEAUMONT, CALIFORNIA formally opposes the Administration's proposal to abolish
redevelopment in California.

Subject: "Name that Bridge" — Bridge Naming Contest
Background and Analysis:
On January 4t" Council opened a public contest to name the new bridge being built. Over the
month hundreds of name suggestions have come in for the new bridge in San Timoteo Canyon.
Suggestions range from historic to humorous to logical to "in honor of'. Some names are
